Article 37 of the Land Administration Law of the People's Republic of China
Article 37 of the Land Administration Law of the People's Republic of China stipulates as follows:

1. Non-agricultural construction must save land. Those who can use wasteland shall not occupy cultivated land;

2. You can use the bad land, and you must not occupy the good land. It is forbidden to occupy cultivated land to build kilns and graves, or to build houses, dig sand, quarry, mine and borrow soil on cultivated land without authorization;

3. It is forbidden to occupy permanent basic farmland to develop forestry and fruit industry and dig ponds to raise fish.

The process of land ownership confirmation:

1, preliminary preparation, publicity and business training, policy formulation, organization establishment and determination of surveying and mapping units.

2. Conduct a thorough investigation, investigate and verify the contractor's representative, the co-owner of the contracted management right, the contracted land and other information. Go door to door.

3. Actual measurement confirmation: According to the Technical Specification for Surveying and Mapping of Rural Contracted Land, survey and map the contracted land, complete the cadastral sketch of the contracted land, carry out actual measurement and publicity confirmation, and improve the contract.

4. Registration and certification. Villages and towns will report the registration requirements to the county-level people's government for registration, and the county-level rural land contract management department will examine and compile the rural land contract management right certificate register, and report to the people's government at the same level for issuing the rural land contract management right certificate for certification and publicity.

5, the establishment of files, towns and villages to establish contracts, contract registration list and other files, county-level door-to-door register paper and electronic files, relevant registration materials should be filed together for future reference, and establish and improve the registration data database.

6, inspection and acceptance, step by step inspection and acceptance, focusing on whether the funds are disbursed in time, whether the contract documents are delivered to the household, whether the surveying and mapping area is accurate, and whether the files are complete and standardized.

Article 38

No unit or individual is allowed to idle or barren cultivated land. Non-agricultural construction that has gone through the examination and approval procedures occupies cultivated land and can be harvested within one year shall be recovered by the collective or individual who originally cultivated the cultivated land, or by the land-using unit; If construction has not started for more than one year, idle fees shall be paid in accordance with the provisions of provinces, autonomous regions and municipalities directly under the Central Government; If it has not been used for two consecutive years, with the approval of the original approval authority, the people's government at or above the county level shall recover the land use right of the land-using unit without compensation; Land originally owned by farmers' collectives shall be handed over to the former rural collective economic organizations to resume farming.

Idle land that has obtained the land use right of real estate development by means of transfer in urban planning area shall be handled in accordance with the relevant provisions of the People's Republic of China (PRC) Urban Real Estate Management Law.
