Article 2 The term "residents of this Municipality" as mentioned in these Interim Provisions refers to persons with permanent residence in this Municipality.

Article 3 The term "household registration management" as mentioned in these Interim Provisions refers to household registration, household registration transfer and the application and issuance of household registration certificates such as resident identity cards.

Article 4 The public security organs of this Municipality and residents of registered permanent residence shall abide by these provisions when registering, moving into their household registration, applying for and issuing household registration certificates such as resident identity cards.

Boat people who take ships as their home in the waters within the scope of this Municipality shall register their household registration in accordance with relevant regulations.

The account management of China citizens, servicemen of the armed police force and foreigners, stateless persons, overseas Chinese and residents of Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Province Province living in this Municipality shall be implemented in accordance with the provisions of relevant laws, regulations and rules.

Personnel from other provinces and cities entering the city's account management shall be implemented in accordance with the relevant provisions of the city's floating personnel and blue-printed account management.

Article 5 The household administration department of the Municipal Public Security Bureau is the competent department of household registration management in this Municipality; The household administration departments of district and county public security organs are responsible for household registration management within their respective jurisdictions.

The police station is the household registration management organ, which is specifically responsible for the household registration management within its jurisdiction.

Article 6 Non-active servicemen living in military camps shall be assigned by their units to assist the household registration authority in household registration.

Organs, organizations, schools, enterprises, institutions and other units with collective accounts shall designate special personnel to assist the household registration authority in household registration.

Article 7 Residents of this Municipality shall register their household registration according to the principle of giving priority to the registration of permanent residence. Residents of this Municipality who have more than two legally fixed residences can only register their permanent residence in one of them, and truthfully fill in the household registration items listed in the Registration Form of Permanent Population.

Residents of this Municipality shall register their household registration according to law, and the right to register their household registration shall be protected by law.

Eighth birth and adoption of household registration, shall be handled in accordance with the following provisions:

(1) If both parents are residents of this Municipality, the children born may report their birth registration to the household registration authority where their parents are registered. If the mother is a non-resident of this Municipality, she shall declare her birth registration in accordance with the relevant provisions;

(2) If both parents are residents of this city, children born out of plan (including children born out of wedlock) shall report their birth registration with relevant certificates;

(3) If the children born by the residents of this Municipality in other provinces and cities, abroad, overseas or during the journey are unable to obtain the birth medical certificate issued by the health department, they shall declare their birth registration in accordance with the relevant provisions of the state and this Municipality;

(four) children adopted by residents of this Municipality who apply for registered permanent residence shall be handled in accordance with the Adoption Law of People's Republic of China (PRC).

Article 9 Before being drafted into the army, residents of this Municipality who have been enlisted for active service shall apply to the household registration authority where their household registration is located with the relevant documents such as the draft notice, and at the same time collect their identity cards.

Demobilized, demobilized, and veterans shall declare their accounts with legal and valid certificates to the household registration authority at the resettlement place.

Article 10 If a resident of this Municipality intends to leave the country for more than 1 year, he/she shall designate a special person to apply to the household registration authority where his/her household registration is located for cancellation of his/her household registration, and at the same time obtain a resident identity card; If you have been abroad for less than one year, the household registration authority will not cancel your household registration.

Residents of this Municipality who have gone abroad or settled in Shanghai shall, in accordance with the relevant provisions of the state and this Municipality, apply to the household registration authority where their original household registration is located for restoration of their household registration.

Article 11 If a resident of this Municipality is arrested or reeducated through labor, the relevant executing organ shall, while notifying his relatives or the unit where he works, notify the household registration authority where his household registration is located to cancel his household registration, and at the same time confiscate his Resident Identity Card.

Residents of this city who have been released from prison or released from reeducation through labor shall apply to the household registration authority where their original household registration is located for the restoration of their household registration with the relevant certificates issued by the prison or the reeducation through labor management unit.

Twelfth city residents died, the head of the household, relatives, guardians or neighbors should hold the relevant certificates (vouchers) issued by the hospitals, public security, health and epidemic prevention departments of this city to the household registration authority where the household registration is located to cancel the household registration.

If a resident of this Municipality dies in other provinces, cities, abroad or overseas, the head of household, relatives and guardians shall cancel their accounts with the death appraisal certificate issued by the public security, justice, health and epidemic prevention departments or foreign and overseas relevant departments within one month after death.

Thirteenth residents of this city who have been declared missing or dead by the people's court shall cancel their accounts with the relevant certificates of the people's court. If the people's court cancels the declaration of disappearance or death, the household registration organ shall, on the basis of the relevant certificates of the people's court, restore the household registration for the residents in time.

Residents of this city who have been missing for more than two years after verification by the public security department shall be notified by the household registration authority where their household registration is located to apply for cancellation of their household registration. For the re-emergence of residents in this city, the household registration authority shall promptly restore their household registration.

Article 14 Where the registered items of permanent residence of residents in this Municipality change, the procedures for change shall be handled in accordance with the following provisions:

(a) 18 years old or 18 years old or above, but under special circumstances, it can be renamed with relevant certificates. However, persons under criminal punishment or reeducation through labor and other detainees may not change their names;

(2) If the age of household registration is inconsistent with the actual situation, I shall apply and provide the necessary proof. I can change my age if it is verified through investigation;

(3) I can change my nationality if I apply and have a certificate issued by the district or county ethnic affairs department;

(4) Native place should be filled in with the father. Due to the adjustment of administrative divisions, parents' divorce, remarriage and adoption, the head of household or himself can apply for changing his native place with relevant certificates;

(5) Upon the application of the head of household or the unit in charge of collective households, the head of household may be changed;

(six) upon my application, with the identification certificate issued by medical institutions and other units, I can change my gender;

(7) Where an application is made to change the household registration matters such as education level, marital status, military service, height, occupation, etc., the applicant or the household registration place shall go through the change formalities with the applicant's resident identity card, household registration book and the applicant's education certificate, marital status certificate or relevant certificates issued by the labor and personnel department of the work unit.

Changes in household registration items specified in Items (1) to (6) of the preceding paragraph shall be handled after preliminary examination by the household registration authority and approval by the household administration department of the district or county public security organ. Changes in household registration items specified in Item (7) shall be handled directly by the household registration authority after acceptance and examination.

Fifteenth "residence booklet" issued by households.

Sixteenth organs, organizations, schools, enterprises, institutions and other units with living conditions may apply to the household registration authority to establish a collective household registration. The head of the household is the person designated by the unit.

Seventeenth non agricultural registered permanent residence migration reasons, complete procedures, and hold legal documents, the household registration authority shall allow registered permanent residence to move in.

If agricultural registered permanent residence moves in the same township, it should be approved by the household registration authority where the household registration is located, and then registered permanent residence will move; Cross-township agricultural registered permanent residence migration shall be examined and approved by the household registration authority where the household registration is moved, and reported to the household administration department of the district or county public security organ for examination and approval before the registered permanent residence migration formalities can be completed.

Eighteenth to apply for registered permanent residence relocation (relocation), it shall apply to the household registration authority where the household registration is located; To apply for household registration (relocation), the person moving in (relocation) shall go through the formalities of household registration in registered permanent residence, where he moved in (relocation), and shall obtain the written consent of the head of household in advance.

The account transfer of a person without or with limited capacity for civil conduct shall be handled by his guardian.

The relocation of the whole family is handled by the head of the household.

Nineteenth people who are unable to handle the demolition procedures for some reason shall issue a power of attorney and entrust family members with civil capacity to handle it on their behalf.

Twenty-first changes in household registration items such as the head of household, household number and household number, and household transfer, involving the legitimate rights and interests of the elderly, the household registration authority shall obtain the consent of the elderly, and check the written materials signed by the elderly.

Twenty-second units and residents of this Municipality shall actively cooperate with the household registration survey of public security organs.

Twenty-third residents of this city who have reached the age of 16 shall apply for the "Resident Identity Card" from the household registration authority where their household registration is located.

Residents of this Municipality shall, within 3 months before the expiration of the "Resident Identity Card", apply to the household registration authority where the household registration is located for a new card.

If a resident of this Municipality loses his "Resident Identity Card", he shall promptly report the loss to the household registration authority where the household registration is located and apply for a replacement.

Twenty-fourth city residents lost the "household registration book", should promptly report to the household registration authority where the household registration is located. If it has not been found within 30 days from the date of reporting the loss, the householder shall submit a written application signed by an adult with civil capacity in the house, which shall be reissued after verification by the household registration authority.

Twenty-fifth people who have lost their Household Registration Certificate shall report the loss to the household registration authority that issued the certificate in time. If the "Household Registration Certificate" has not been found after 30 days, it shall be reissued according to the contents of the original certificate on the basis of my written application and the proof that the household registration authority has not reported the household registration.

If the holder loses his immigration permit, he shall report the loss to the issuing unit in time. If it is still not found after 40 days, it will be reissued according to the original content within 6 months from the date of issuance upon my written application and approval of the original issuing department.

If the "Household Registration Certificate" and "Certificate of Permission to Move in" have exceeded the validity period and have not been reported to the household registration authority, they shall show the original certificate to the household registration authority at the place where the original certificate was issued and renew it according to the original certificate. However, if the certificate of moving-in permit is valid for more than 6 months, it will not be renewed, and it is necessary to re-apply for settlement.

Twenty-sixth household registration certificate is only used in China (except Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Province Province).

Need a "household registration certificate", by himself or the head of the household to the household registration authority to submit a written application, after examination, issued in accordance with the contents of household registration.

Twenty-seventh in any of the following circumstances, the public security organ may take compulsory measures for account management:

(1) If a party refuses to carry out the effective judgment of the people's court on the transfer of registered permanent residence, the registered permanent residence shall be forcibly transferred;

(2) If one party moves the account of the other party without authorization or moves the account normally by other methods, the person to be removed or the person to be removed shall submit a written application to the local account registration authority, and the account will be forcibly moved;

(three) account migration, family members or entrusted agents in registered permanent residence to conceal the real situation, forged documents or through improper procedures to declare the account, forced to move to registered permanent residence;

(four) children or other relatives living in the elderly own or rented housing, to solve the housing problem, the elderly do not agree to continue to live together, their accounts should be moved out in time. Refuse to move out, the elderly can apply in writing to the household registration authority, to be forced to transfer accounts;

(5) Those who have been released from prison and released from reeducation through labor, those who have come to settle in Shanghai with the approval of other provinces and cities, and those who have returned to settle in Shanghai from abroad (overseas), if their families do not let them, will be forced to resume their accounts;

(six) due to prominent family conflicts, not separating households and households will seriously infringe on the legitimate rights and interests of indoor personnel, and have the conditions for separating households and households. After mediation by the household registration authority is invalid, they are forced to separate households and households;

(seven) because of the disappearance, death and other reasons, the cancellation of the account, after being notified by the household registration authority where the account is located, refuses to implement it, and shall be forcibly cancelled;

(8) If the account should be cancelled due to going abroad or leaving the country for more than one year, if the household registration authority at the place where the account is located refuses to implement it, it will be forcibly cancelled;

(nine) for other acts that do not meet the requirements of household registration management, take corresponding compulsory measures for household registration management.

The provisions of item (1) of the preceding paragraph shall be implemented by the household registration authority with the letter of assistance from the people's court; The provisions of items (2) to (9) shall be investigated and verified by the household registration authority, and implemented after being reported to the household administration department of the district or county public security organ for examination and approval, and I shall be notified in writing.

Article 28 The household registration authority shall, within 7 days after receiving the compulsory execution decision of the people's court or the public security organ, go through the corresponding compulsory procedures on the permanent population registration form. For those who refuse to hand over the household registration book, they shall issue another household registration book with the same number, and write "renewal" in the remarks column.

Twenty-ninth in violation of these provisions, which constitutes a violation of public security management, shall be punished by the public security organs in accordance with the relevant provisions of the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirtieth public security organs should do a good job in the management of various accounts in a timely manner, collect production fees according to the charging standards set by the municipal price department, and announce them to the public.

Thirty-first parties or indoor interested parties who are dissatisfied with the provisions of the public security organs on household registration management may apply for administrative reconsideration or bring an administrative lawsuit according to law.

Thirty-second these Provisions shall be interpreted by the Municipal Public Security Corps.

Article 33 These Provisions shall come into force as of February 2000. Where the provisions on account management issued by the former Municipal Bureau are inconsistent with these provisions, these provisions shall prevail.
