Provisions on Intellectual Property Protection of the 26th Summer Universiade in Shenzhen (revised in 2020)
Article 1 In order to strengthen the intellectual property protection of the 26th Summer Universiade in Shenzhen (hereinafter referred to as Shenzhen Universiade), safeguard the legitimate rights and interests of intellectual property rights holders of Shenzhen Universiade, and ensure and promote the sustained and healthy development of college sports, these Provisions are formulated in accordance with relevant laws and regulations. Article 2 These Provisions shall apply to the management, protection and other related activities of intellectual property rights of Shenzhen Universiade. Where there are other provisions on the protection of special symbols of Shenzhen Universiade, those provisions shall prevail. Article 3 The intellectual property rights of Shenzhen Universiade as mentioned in these Provisions refer to the exclusive rights of trademarks, patents, works, special signs, trade secrets and other creative achievements related to Shenzhen Universiade. Article 4 The trademarks, patents, works, special signs, trade secrets and other creative achievements related to Shenzhen Universiade as mentioned in these Provisions refer to:

(1) Names, graphics, or combinations thereof such as the emblem of the International University Sports Federation (hereinafter referred to as FISU), the trademark of FISU International Universiade, the FISU anthem, the Universiade flame, the name of FISU project, and the FISU project badge;

(two) the name, emblem and logo of China University Sports Association (hereinafter referred to as China Sports Association);

(3) The emblem, mascot, name, logo, anthem and slogan used by the Shenzhen Universiade Bid Committee and the Organizing Committee (hereinafter referred to as the Organizing Committee) or entrusted by others in the process of bidding for and hosting the Shenzhen Universiade;

(4) Artistic performances, film and television works and other creative achievements organized by the Shenzhen Universiade Organizing Committee;

(5) Patented products involving the logo of Shenzhen Universiade;

(6) Design of special items such as trophies and medals for Shenzhen Universiade. Article 5 Intellectual property rights holders of Shenzhen Universiade refer to FISU, China Sports Association, Shenzhen Universiade Organizing Committee, legally authorized licensees and other legal rights holders. Article 6 The intellectual property protection of Shenzhen Universiade follows the principles of safeguarding the dignity of college students' sports, inviolability of exclusive rights, legal protection and legal use.

No organization or individual may infringe the intellectual property rights of Shenzhen Universiade. Article 7 The Organizing Committee of Shenzhen Universiade shall formulate a work plan for intellectual property protection of Shenzhen Universiade, and take the following measures to protect intellectual property rights of Shenzhen Universiade in a timely manner according to law:

(1) applying for trademark registration;

(2) applying for the registration of special signs;

(3) applying for a patent;

(four) timely registration of related works;

(5) adopting confidentiality measures for business secrets;

(6) applying for customs filing of intellectual property rights. Article 8 The use of intellectual property rights in Shenzhen Universiade should contribute to the healthy development of college students' sports.

The use of the intellectual property rights of Shenzhen Universiade in Items (1), (3), (4), (5) and (6) of Article 4 of these Provisions shall be approved by the Shenzhen Universiade Organizing Committee, FISU or its authorized institution; The use of the intellectual property rights of Shenzhen Universiade in Item 2 of Article 4 of these Provisions shall be approved by China Sports Association.

The Organizing Committee of Shenzhen Universiade shall issue a plan for the use of Shenzhen Universiade intellectual property rights, and authorize Shenzhen Universiade partners and Shenzhen Universiade commodity franchisees to use Shenzhen Universiade intellectual property rights as needed. Article 9 The following acts that infringe the intellectual property rights of Shenzhen Universiade are prohibited:

(1) Using a trademark identical with or similar to the registered trademark of the Universiade on the same kind of goods and services or similar goods and services without permission;

(2) Selling goods that infringe upon the exclusive right to use the registered trademark of the Universiade;

(3) Forging or manufacturing identical or similar Universiade trademarks without authorization, or selling forged or manufactured Universiade trademarks without authorization;

(4) exploiting the Universiade patent without permission;

(5) Using the Universiade patent number on products, product packaging, advertisements or other promotional materials without permission;

(6) Using Universiade works or other creative achievements without permission, except as otherwise provided by laws and regulations;

(seven) providing places, storage, transportation, mailing, concealment and other convenient conditions for the above-mentioned infringement;

(eight) other violations of relevant laws and regulations. Article 10 Advertisers, advertising agents and publishers shall not infringe upon the intellectual property rights of Shenzhen Universiade in advertising design, production, agency and publishing activities.

Advertising agents and publishers should strengthen the examination and strictly check the supporting documents in advertising activities. Article 11 The market supervision department shall assist the Organizing Committee of Shenzhen Universiade in the registration of intellectual property rights, earnestly perform its duties and strengthen the law enforcement inspection of intellectual property protection of Shenzhen Universiade. Article 12 Illegal acts that infringe upon the trademark rights, patents, copyrights, exclusive rights of special signs and trade secrets of Shenzhen Universiade shall be investigated and dealt with by the market supervision department according to law.

Public security, urban management, comprehensive law enforcement and other administrative law enforcement departments should do a good job in intellectual property protection of Shenzhen Universiade in accordance with their respective responsibilities. Article 13 The market supervision department may exercise the following functions and powers when investigating and dealing with intellectual property infringement of Shenzhen Universiade:

(a) ask the parties, interested parties and witnesses;

(2) consulting and copying files, contracts, drawings, account books and other materials related to this case;

(three) to conduct on-site inspection by means of inspection, photography, video recording and measurement;

(4) Registering and preserving the evidence of articles related to the case according to law;

(five) to investigate other circumstances related to the case;

(six) other functions and powers as prescribed by laws and regulations.

When investigating and dealing with the infringement of intellectual property rights of Shenzhen Universiade, the market supervision department may, in addition to exercising the functions and powers listed in the preceding paragraph, seal up or detain the goods that have evidence to prove the infringement of the trademark rights of Shenzhen Universiade according to law.
