Article 3 of the Labor Law stipulates: "Laborers enjoy equal employment, career choice, remuneration, rest and vacation, occupational safety and health protection, vocational skills training, social insurance and welfare, labor dispute settlement and other labor rights stipulated by law. Laborers should complete labor tasks, improve their professional skills, implement labor safety and health regulations, and abide by labor discipline and professional ethics. " Article 68 stipulates: "The employing unit shall establish a vocational training system, draw and use vocational training funds in accordance with state regulations, and carry out vocational training for workers in a planned way according to the actual situation of the unit. Workers engaged in technical work must be trained before taking up their posts. "
Article 20 of the Vocational Education Law stipulates: "An enterprise shall, according to the actual situation of its own unit, carry out vocational education for its employees and persons to be hired in a planned way. Enterprises can independently or jointly set up vocational schools and vocational training institutions, or they can entrust schools and vocational training institutions to provide vocational education for their employees and persons to be hired. Employees engaged in technical jobs must be trained before taking up their posts; Employees engaged in special operations must pass special operations training. " Article 28 stipulates: "An enterprise shall bear the vocational education expenses of its employees and employees. The specific measures shall be formulated by the relevant departments of the State Council in conjunction with the financial department of the State Council or by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government according to law. "
Article 9 of the Regulations on Staff Training in Enterprises stipulates: "Enterprises shall incorporate staff training into their medium-and long-term and annual plans to ensure training funds and other training conditions." It can be seen that providing general training such as pre-job training for workers is the legal obligation of employers and the legal rights enjoyed by workers. Therefore, the employer shall not require the employee to bear the training expenses arising from the pre-job training, nor shall it have the right to recover these training expenses from the employee.
Secondly, Article 9 of the Labor Contract Law stipulates: "The employer shall not detain the employee's resident identity card and other documents, and shall not require the employee to provide a guarantee or collect property from the employee in other names". So it is illegal to collect training fees.
Re-employment, private schools that illegally charge for profits are definitely not worth signing!
