Being sentenced to three years' imprisonment without probation is a felony. In this case, although the subject of the crime is a soldier, it does not constitute a crime of violating military duties, but an ordinary crime of intentional injury. Three years' imprisonment is the maximum penalty for minor injuries and the minimum penalty for serious injuries, which is a crime with serious consequences. Crime of intentional injury in Article 234 of the Criminal Law

1. Minor injury: Whoever intentionally hurts another person's body shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance.

2. Serious injury: whoever commits the crime mentioned in the preceding paragraph and causes serious injury shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death or serious disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Where there are other provisions in this Law, such provisions shall prevail.
