Article 1 In order to effectively protect the legitimate rights of students, these Measures are formulated in accordance with the Regulations on the Administration of Students in Colleges and Universities and relevant laws and regulations.
Article 2 These Measures are applicable to graduate students, undergraduates and junior college students who receive general higher education in our university. Adults, self-taught students and all kinds of advanced students studying in our school shall refer to these measures.
Article 3 The term "appeal" as mentioned in these Measures refers to the appeal made by students against the school's disqualification, withdrawal or violation of discipline and discipline.
Article 4 The complaint handling committee for school students' violation of discipline (hereinafter referred to as the complaint handling committee) is composed of school leaders, Communist Youth League Committee, supervision office, academic affairs office, student affairs office leaders, school legal advisers, teachers' representatives and students' representatives.
Article 5 If a student refuses to accept the punishment decision made by the school, he shall submit a written complaint to the Appeal Committee within 65,438+00 working days from the date of service of the notice of punishment decision. If the notice of punishment decision cannot be delivered to the student himself, and it is delivered by announcement on the homepage of the college where the student is located, the student shall file a complaint application within the announcement period or within 5 working days from the date of announcement. The time when the appeal handling committee accepts the appeal application shall be subject to the time when the appeal application is received.
Article 6 If a student is really unable to file an appeal application within the appeal period due to force majeure, he shall explain the reasons and provide relevant supporting materials after the force majeure is eliminated. After verification by the complaint handling committee, the case shall be deemed to have been filed within the complaint period, but the time for making the review conclusion shall be counted from the date of receipt of the complaint.
Article 7 If a student applies for a complaint after the appeal period, the complaint handling committee will no longer accept it.
Article 8 A student shall submit an application to the complaint handling committee, which shall include the following contents:
1. Basic information such as the complainant's name, class and student number;
2 complaints, reasons and requirements;
3. Mailing address and telephone number;
4. Date of submission of the complaint;
5. A copy of the school's disciplinary decision.
Article 9 The complaint handling committee shall, according to the complainant's complaint reasons and requests, extract the original materials of the original punishment decision, conduct examination, verify or verify the new clues put forward by the complainant, and listen to the opinions of the original punishment handler and relevant leaders and teachers.
Tenth conditional, the complaint handling committee shall notify the complainant and the representative of the original handling unit to attend the meeting and explain the situation. If the complainant is unable to attend the meeting for some reason, he may entrust an agent to attend the meeting in writing or submit written materials to make a complaint. If he no longer provides a written complaint, the content of the complaint application shall prevail.
Article 11 A meeting of the Complaints Handling Committee can only be held when two-thirds of the members are present. Matters resolved at the meeting must be approved by more than half of the members present. When a member is unable to attend the meeting for some reason, he may not entrust an agent.
Article 12 After reexamination and necessary re-evidence collection, the complaint handling committee shall make a reexamination conclusion in time and form a reexamination decision. Do not change the original treatment or punishment decision, directly inform the complainant and send a copy to the office of the school student disciplinary Committee; If it is necessary to change the original punishment decision, it shall be submitted to the corresponding department for re-study and decision according to the authority of punishment decision.
Thirteenth complaint handling committee shall, within 15 working days from the date of receiving the student's complaint, deliver the review decision to the complainant. If the situation is complicated and the conclusion cannot be made within the prescribed time limit, it may be extended by 15 working days with the approval of the person in charge of the school. If the student complaint handling committee deems it necessary, it may suggest that the school suspend the implementation of relevant decisions.
After examination, the student complaint handling committee thinks that the facts, basis and procedures of handling or punishment are improper, and it can put forward the review opinions that suggest revocation or change, and submit them to the relevant functional departments for study, and then resubmit them to the principal's office meeting or special meeting for decision.
Article 14 The service procedure of the appeal handling committee's review decision shall be implemented with reference to the relevant provisions of the Detailed Rules for the Implementation of the Punishment of Students in Inner Mongolia University of Technology.
Fifteenth students can withdraw their appeal in the form of application before making the conclusion of appeal review. After receiving the application for withdrawing the complaint, the complaint handling Committee shall stop accepting the work.
Sixteenth students who have objections to the review decision can submit a written complaint to the Education Department of Inner Mongolia Autonomous Region within 15 working days from the date of receiving the school review decision.
Seventeenth members of the complaint handling Committee have a direct relationship with the complaint affairs, and should be avoided.
Article 18 The meeting of the Complaints Handling Committee shall be held irregularly and shall be convened by the director. If the director is unable to attend for some reason, he may entrust the deputy director to convene a meeting.
Nineteenth complaint handling committees have the right to investigate and collect evidence, and the relevant departments and individuals of the school have the obligation to assist. According to the needs of complaints, the student complaint handling Committee may invite relevant personnel to attend the meeting as nonvoting delegates.
