Article 2 Student-origin credit student loans in Qinghai Province refer to student loans issued by banking financial institutions to eligible Qinghai freshmen and students with financial difficulties in colleges and universities, and handled in the county (city, district) where the students are registered before entering school. (At present, it is piloted by Qinghai Branch of China Development Bank)
Article 3 The term "borrower" as mentioned in these Measures refers to Qinghai students and their parents (or other legal guardians) who apply for student-origin credit student loans from the undertaking bank.
Article 4 Qinghai Rural Credit Cooperatives Association (hereinafter referred to as the agent bank) handles the credit student loan for students in Qinghai Province. Entrusted by the undertaking bank, the agent bank assists in the settlement management of student credit loan business in counties (cities, districts).
Article 5 Student-origin credit student loans shall be handled by the rural credit cooperatives in the county (city, district) where the borrower's account is located in accordance with the principle of "preventing risks and facilitating loans".
Chapter II Organization and Management
Article 6 In order to ensure the smooth implementation of student-origin credit student loans, the Qinghai Provincial Leading Group for Student Financial Assistance is responsible for the coordination of student-origin credit student loans, and strengthen the leadership of student-origin credit student loans. Its main responsibilities are to study and solve the problems in the implementation of student-origin credit student loans, coordinate the relationship between education, finance and banking financial institutions, organize and publicize relevant policies, and implement relevant work.
Article 7 The Provincial Department of Education is the lead unit of student-origin credit student loans in Qinghai Province, and the Qinghai Provincial Student Financial Assistance Management Office (hereinafter referred to as the Provincial Financial Assistance Office) is responsible for the organization, coordination and management of student-origin credit student loans, guiding the state (prefecture, city and district) education bureaus to establish and improve student financial assistance management centers (hereinafter referred to as state and county financial assistance centers), and organizing, guiding, assessing and supervising the county financial assistance centers to carry out loan management and debt service. Responsible for applying for and collecting financial discount funds and risk compensation for student-origin credit student loans, and transferring them to the special account of the undertaking bank in full and on time; Relying on the personal credit inquiry function of the credit information system of China People's Bank, we will establish and strengthen the personal information management of student-origin credit student loans.
Article 8 The Provincial Department of Finance is responsible for fully arranging and timely allocating discount interest funds and risk compensation in the annual financial revenue and expenditure budget, strengthening the management, use and supervision of discount interest funds and risk compensation, and improving the efficiency in the use of funds.
Article 9 The Central Sub-branch of the People's Bank of China is responsible for coordinating the Education Bureau within its jurisdiction to set up a special account for student-origin credit student loans in the correspondent bank, and supervising and managing it.
Article 10 The undertaking bank shall, in accordance with the national credit policy, scientifically and reasonably design the loan method and term structure, formulate the operating rules for student-origin credit student loans, be responsible for the examination, issuance and management of loans, ensure smooth loan channels, and enable eligible students with financial difficulties who have loan needs to apply for student-origin credit student loans. In conjunction with the Provincial Department of Education and the Provincial Department of Finance, according to the characteristics of different stages of the student-origin credit loan commitment cycle, loan products, information and credit links between student-centered families, universities and employment units will be established to form credit management in the whole process of student loans.
Article 11 The state (prefecture, city) and county (city, district) governments should further improve the leading group for student financial assistance, and the administrative department of education should set up a student financial assistance management center with legal personality, equipped with corresponding full-time staff, and the staffing should be adjusted and implemented from the existing educational establishment of the administrative department of education, so as to strengthen the leadership and management of the credit student loan work of students' origin.
Article 12 The financial departments of states (prefectures, cities) and counties (cities, districts) should actively participate in the management of student-origin credit student loans, participate in the coordination of related matters, make overall arrangements for the business funds of state and county aid centers, and guide and supervise the student-origin credit student loans in conjunction with the education departments.
Thirteenth state relief center is mainly responsible for the statistical summary, supervision and inspection of local loan work. As the specific agency of student-origin credit student loans, the county financial aid center is responsible for the pre-loan organization and post-loan management of student-origin credit student loans. Its main responsibilities are:
(a) responsible for collecting, sorting out and summarizing the information on the family economic status of freshmen and students in colleges and universities whose household registration is counties (cities, districts) before enrollment, as well as the demand for credit student loans from their places of origin; Investigate and identify the family financial difficulties of students applying for loans; Establish a student credit and loan qualification evaluation team, determine the list of students who meet the loan conditions, calculate the loan demand, and prepare the loan plan; Handle the application and preliminary examination of credit student loans from students' origin.
(two) to accept the entrustment of universities, students' credit student loans and universities' national student loan handling banks, establish a contact system with loan students' families, and track the changes in the economic situation of loan students' families; Entrusted by the undertaking bank to urge repayment of loans; Responsible for regularly submitting relevant information about loan students to provincial financial aid offices, universities and handling banks.
(III) To be responsible for the publicity work of student-origin credit student loans, organize news media in conjunction with relevant local departments, and carry out publicity and consultation on student-origin credit student loan policies within the county (city, district) in a form loved by the broad masses of the people and students.
Fourteenth ordinary high schools should cooperate with the county funding center and the undertaking bank to provide students with the enrollment situation of the college entrance examination in that year and the demand for credit student loans from the students' places of origin, and assist in the application, approval and issuance of loans. Colleges and universities should strengthen the honesty education for students, cultivate their honesty consciousness, and urge them to fulfill their repayment obligations according to the contract after graduation; According to the needs of the county financial aid center, assist in providing relevant information of students with credit student loans from their places of origin, strengthen communication with the county financial aid center and avoid repeated loans.
Chapter III Loan Objects and Conditions
Article 15 Student-origin credit student loans are issued to freshmen or college students who have been officially admitted to full-time undergraduate colleges, higher vocational schools and colleges (including private colleges and independent colleges) that have been approved to set up and implement higher education in accordance with the relevant provisions of the state, and have obtained a true, legal and effective admission notice.
Sixteenth students and families applying for student-origin credit loans should meet the following conditions.
(1) Students applying for student-origin credit student loans must meet the following conditions:
1, with China nationality;
2. Have full capacity for civil conduct;
3, honest and trustworthy, law-abiding;
4 students themselves, their parents or other legal guardians have the county (city, district) household registration and family residence.
(2) Students' families applying for student source credit student loans must meet the following conditions:
1, no bad credit record;
2. The family's financial difficulties are not enough to pay the basic expenses required for students to complete their studies during school, which meets one of the following characteristics.
(1) poverty-stricken households and urban low-income households in agricultural and pastoral areas;
(2) Families of orphans and disabled students;
(3) Family members suffer from major diseases;
(4) the creator of the main income of the family loses the ability to work for some reason;
(5) Single-parent families with no stable income;
(6) Both parents are unemployed;
(7) Suffering from natural and man-made disasters, causing heavy losses and unable to afford the students' expenses;
(8) Other poor families.
Chapter IV Loan Amount, Term and Interest Rate
Article 17 The maximum amount of student credit loan is 6000 yuan per student per academic year. The specific amount is determined according to the tuition and accommodation standards of the school where the students attend and the poverty level of the family, which is mainly used for the tuition and accommodation of the students during their school days. Apply for loans once, sign loan contracts year by year, and issue loans year by year.
Article 18 In principle, the term of student-origin credit student loans shall be determined according to the full-time undergraduate academic system plus 14 years, and the longest term shall not exceed 14 years. For those who have studied for more than 4 years or continue to study for a postgraduate degree or a second bachelor's degree, the repayment period after graduation will be shortened accordingly.
Article 19 The interest rate of student-origin credit student loans shall be based on the benchmark interest rate of the same period and grade published by the People's Bank of China, and shall not go up.
Twentieth students credit student loan interest charged annually. Students' interest during school is fully subsidized by the finance, and the interest after graduation is shared by the students and their parents (or other legal guardians). The two-year grace period for students at school and after graduation is the grace period. After the grace period is over, students and their parents (or other legal guardians) will repay the loan principal in installments as agreed in the loan contract. Encourage early repayment. Except the principal and interest payable, there is no extra charge for early repayment.
Chapter V Application, Approval and Issuance of Loans
Article 21 loan application. Under the guidance of the county aid center, ordinary high schools in the province publicize the credit loan policy of students' origin to the students who are about to graduate. Students who are preparing for further studies and have loan needs fill in the pre-application form of student-origin credit student loan (provided by the county financial aid center) according to the prescribed format, and submit the pre-application for loan to their middle school. Each middle school takes the class as a unit and puts forward a list of poor students who meet the loan conditions according to the loan objects and conditions. After publicity and audit in the school, the list of students to be loaned and the performance certificate during the school period will be submitted to the county financial aid center.
After receiving the formal admission notice, the poor students who intend to borrow money should submit a formal application to the county financial aid center, fill in the Unified Application Form for Student-origin Credit Student Loan of Qinghai Branch of China Development Bank (provided by CDB), and provide the following supporting materials:
(a) the borrower (students and their parents) legal and valid identity certificate and its copy.
(2) the detailed address and contact information of the household registration.
(3) Student status certificate: the freshmen submit the university admission notice and its copy; Students in school should show their student ID card and the certificate issued by the university where the borrower is located that I have not obtained the national student loan in this university.
Twenty-second loan review and contract signing. County (city, district) township government (street office) and village committee (community) carefully verify the students' family situation, and sign the audit opinion on the loan application form. The county aid center examines the application materials and signs contracts with the students and borrowers who have passed the examination in time. After the contract is signed, the county rescue center will transfer the relevant information to the agent bank and open a personal account for the borrower (for issuing loan funds and recovering principal and interest).
Article 23 Fill in the receipt. Borrowing students report to the school with the receipt of the student-origin credit student loan, which is filled in and stamped by the school according to the receipt requirements, and the borrowing students send the receipt back to the local county rescue center before the prescribed time limit. The county funding center collates and summarizes the loan contract and receipt, and submits it to the undertaking bank.
Article 24 loan approval. The undertaking bank shall timely examine and approve the loan contract, and send the examination and approval results to the provincial aid office, and then send them to the county aid center step by step, and the county aid center shall transfer them to the handling bank for the record.
Article 25 Open a special loan account. Education bureaus of counties (cities, districts) set up special accounts for student-origin credit student loans in settlement agencies according to the regulations on account management of the People's Bank of China, which are used to undertake the issuance of student-origin credit student loans and the recovery of loan principal and interest.
Article 26 Loan issuance. According to the examination and approval results, the undertaking bank will distribute the loan to the account opened by the provincial financial aid office in the development bank, and then the provincial financial aid office will put it in the special account of the county financial aid center in the handling bank, and the handling bank will transfer the loan funds to the personal account of the borrower, and then transfer the loan funds from the personal account to the account of the borrower's school according to the requirements of the borrower's attending colleges and universities.
Chapter VI Loan Discount and Recovery of Principal and Interest
Article 27 The loan interest of borrowing students during their school days shall be fully subsidized by the financial department, and the loan interest of students enrolled in central colleges and universities and students studying in local colleges and universities across provinces shall be borne by the central finance. Studying in this province, the loan discount shall be borne by the provincial finance. The loan interest of the borrower after graduation shall be borne by the student and his parents (or other legal guardians).
Article 28 The agent bank of student-origin credit student loan shall prepay the interest 30 working days before the annual interest settlement date (65438+February 20th), and the county funding center shall review the prepay interest and report it to the provincial funding office for summary step by step, and the provincial funding office shall report it to the undertaking bank for review and confirmation. After the confirmation of interest settlement, the provincial aid office shall apply to the competent department for discount. The discount interest borne by the central government shall be summarized by the provincial financial assistance office and reported to the National Student Financial Assistance Management Center, and the central financial discount interest funds shall go through the payment procedures in accordance with relevant regulations; The provincial financial burden of discount interest funds, collected by the provincial aid office, will be paid directly to the designated undertaking bank before the annual interest settlement.
Article 29 The interest-bearing period of the self-paid loan interest of the borrowing students after graduation starts from September of that year 1 (inclusive). When the borrower graduates, drops out of school, or is cancelled according to the regulations on student status management, the borrower shall pay the principal and interest from 1 day (including 1 day) next month after the relevant formalities are handled; When the borrowing students who have dropped out of school resume their studies, the starting date for resuming the discount is the current month 1.
Thirtieth students after graduation, the loan into the repayment period. According to the loan contract, the county student aid center checks the loan student list, loan amount, term, interest rate and other information with the handling bank before the loan principal and interest expire, and notifies the borrower in advance to deposit the corresponding funds into the personal account. The agent bank deducts the due loan principal and interest from the student's personal account on the interest settlement date or repayment date, transfers it into the settlement account, and issues a deduction list in time.
Chapter VII Risk Compensation Management
Thirty-first to establish a special fund for risk compensation of student credit loan. The risk compensation is determined according to 15% of the loan amount in the current year, and the undertaking bank implements special account management as a special risk reserve, which is mainly used to prevent and make up for the loss of student credit loan. For students admitted to central universities, the risk compensation shall be borne by the central finance; If students enrolled in local colleges and universities study across provinces (autonomous regions and municipalities directly under the Central Government), the risk compensation shall be borne by the central finance; For students studying in provincial universities, the risk compensation shall be shared by the central finance and the provincial finance respectively. The risk compensation paid by the central government shall be collected by the provincial financial assistance office and reported to the National Student Financial Assistance Management Center, and the transfer procedures shall be handled in accordance with the relevant provisions of the central government; The risk compensation for the financial burden of the province is collected by the provincial aid office and directly transferred to the development bank before February 20 of each year.
Article 32 Establish an incentive and restraint mechanism for risk compensation. If the risk compensation exceeds the loan loss, the excess will be awarded to the county financing center by the undertaking bank to make up for the daily work expenses of the county financing center; If it is not enough to compensate the principal and interest of the corresponding default loan, the insufficient part shall be shared by the undertaking bank and the county-level financial department.
Article 33 After the default principal and interest of the student-origin credit student loan are compensated in the above way, the county financial aid center will continue to be responsible for collecting the principal and interest owed by the loan students, and will be included in the risk compensation account management after recovery, and will be returned to the county financial aid center according to the corresponding principal and interest ratio when the risk compensation is settled in the next year.
Thirty-fourth bad debts of student-origin credit student loans shall be independently written off by the undertaking bank according to the relevant policies of the state.
Chapter VIII Supplementary Provisions
Thirty-fifth state and county funding centers may formulate corresponding implementation rules in light of local actual conditions.
Thirty-sixth these Measures shall be interpreted and revised by the Education Department of Qinghai Province, the Finance Department of Qinghai Province and the Xining Central Branch of the People's Bank of China, and shall be implemented as of the date of issuance.
