Judicial Examination for Master of Laws: Interpretation of Three Ways of Continuing Education
The registration of the national postgraduate examination is about to begin, and the registration of the national judicial examination is basically over. Many college graduates who are interested in working in the legal profession find it difficult to get a "place" in the legal field only at the bachelor's level when they leave school. Everyone turned their attention to the master of law and the master of law exam, as well as the judicial exam that attracted much attention. However, in the eyes of the legal profession, these three directions for further study have brought confusion to some readers. In order to help you understand their similarities and differences, the reporter interviewed several industry experts.

Master of Laws: the Way for Bachelor of Laws to Further Study

According to the reporter's understanding, LLM and LLM exams belong to academic education exams. The former is a postgraduate exam that has been held since the resumption of the college entrance examination. LLM's enrollment targets are limited to undergraduates majoring in law, and they are taking part in the increasingly difficult postgraduate entrance examination in recent years, which is quite difficult. Tutorial system is adopted in teaching, that is, each student has a tutor who can tutor at any time during the study period. For them, because they specialize in a certain department law and have specific research directions, some even specialize in legal academic research, so the courses offered are very professional. Wang Yue, deputy director of the Health Law Teaching and Research Section of peking university health science center, said that because LLM is highly targeted, belongs to research-oriented talents, and relatively focuses on legislative work, most judicial departments such as courts and procuratorates will choose such people, so they will generally engage in judicial legislation or legal academic research after graduation.

Master of Laws: the Road to the Growth of Compound Legal Talents

According to Ma, Dean of the Law School of the University of Political Science and Law, the Master of Law is a newly emerging academic education in recent five or six years, mainly imitating the JD exam in the United States. There is no lawyer major in American undergraduate education. If you want to take JD, you must get a bachelor's degree in other majors. The establishment of the Master of Laws Examination in China shows that the legal development in China is gradually moving towards internationalization. Lawyer Chen of Junzejun Law Firm also expressed his views on this. He believes that although the traditional view is that the professional level and quality of law majors after studying for four years will be better than that of master of law, there are reasons why some western countries advocate the education system of master of law, because non-law graduates generally have certain professional knowledge, such as economics, architecture, foreign languages and so on. These graduates have fully mastered the knowledge characteristics of their own fields, accumulated certain social experience, and possessed certain comprehensive abilities such as language expression ability, written expression ability, adaptability and social ability, which laid a good foundation for studying law in the future.

Although LLM has no tutor in teaching, it will be completed under the guidance of a tutor when writing a graduation thesis. It seems that LLM is more recognized without LLM. However, Deputy Director Wang Yue believes that it is not necessarily a bad thing to have no special instructors. Because the master of law is a compound talent regardless of major, it involves a wide range of legal fields, with emphasis on several major departmental laws. Therefore, under the premise of having a relatively fixed teacher, teachers from different departments can guide them in all aspects.

Wang Yue, deputy director, also told reporters that LLM trains applied compound talents, most of whom are engaged in the work of judges or lawyers, which is more important than the implementation of the law and emphasizes the application of the law. Although the Master of Laws also belongs to the postgraduate examination, the applicants are required to be non-law majors and have two years or more work experience. It is understood that LLM's academic system includes two years and two and a half years, and its learning methods include full-time learning and part-time learning.

Judicial examination: the only way for practicing lawyers

According to the introduction of the lawyer management office of Beijing Municipal Bureau of Justice, another legal examination-judicial examination was held in March 2002. It combines the lawyer qualification examination, the first-time judge qualification examination and the first-time prosecutor qualification examination, and cancels the above three popular independent examination items. Bachelor degree or above can sign up for the exam. In addition, this exam does not stipulate the nature and specialty of the applicants. According to Ma, Dean of Law School of University of Political Science and Law, LLM and LLM belong to the national academic education examination, while the judicial examination is a qualification examination, which is different from the academic education examination. In other words, LLM and LLM must pass the judicial examination if they want to qualify.

Why do you want to combine three separate exams? Lawyer Chen explained that in the past, some judges or prosecutors were fresh graduates of law schools. Most of them started as clerks and gradually rose to the positions of judges or prosecutors, but in fact it is difficult to reach the corresponding level. Therefore, the People's Procuratorate, the Ministry of Justice and the court jointly launched the judicial examination, and only those who have passed the judicial examination are qualified to be judges, prosecutors and lawyers. This has greatly improved the professional level and basic quality of judicial system personnel to a certain extent. At the same time, it also provides greater development space for legal system professionals who have passed the judicial examination in their career choice. In addition, due to the relatively loose registration conditions for the judicial examination, the candidates' majors are not restricted, and talents from all walks of life are generally absorbed, which has injected fresh vitality into the whole judicial circle to a certain extent. On the premise of high conditions and wide scope, it also provides a career path for those who love their major and suffer from nowhere to find employment.

Choose a career path that suits you.

The reporter learned in the interview that although tens of thousands of law graduates go to work every year, at present, the demand for legal talents in society is far from saturated. Lawyer Chen believes that professional legal talents are not limited to the four major legal departments of industry, prosecution, law and company. Many large companies will have a special legal advisory department to safeguard the interests of the company, or use the most perfect method to solve contract disputes. Even some small and medium-sized enterprises attach great importance to the legal advisory department. Therefore, from the market point of view, the legal profession is still very popular.

Ma, dean of the Law School of the University of Political Science and Law, said that due to the changes in the enrollment conditions for master of laws in recent years, students majoring in law could be enrolled a few years ago, but now applicants must not be law majors when they are studying undergraduate. After the system reform, the application of LLM has been further strengthened. For law graduates, if they want to continue their studies, they can only take the Master of Laws. Therefore, applicants must choose a master's degree category to take the exam according to their major at the undergraduate stage. In addition, some legal talents who have obtained corresponding academic qualifications but have not yet taken the judicial examination must pass the judicial examination and obtain qualification certificates in order to become a member of the legal work field.
