Case analysis of tourists drowning in Yanzhou Island, Dinghu District, Zhaoqing City, Guangdong Province.
Case background: On June 4, 2008, 10, a tourism safety accident occurred in Yanzhou Island, Dinghu District, Zhaoqing City, Guangdong Province. Two tourists who participated in the outbound tour with the unit violated the travel contract and swam in the Xijiang River in the throat when they were free. In deep water, they suddenly drowned.

On the eve of the National Day in 2008, Guangdong Staff International Travel Service was entrusted by the Guangzhou office of Zhengzhou Youde Ye Wei Technology Development Co., Ltd. to organize its 10 1 employees to go to Yanzhou Island near Xijiang River in Zhaoqing for a two-day tourism expansion activity. The tourism contract signed by both parties specifically stipulates that tourists are not allowed to travel to Xijiang without authorization. Before the activity, the manager of the travel agency group and the person in charge of the company conducted a survey on the tourism development area. There are warning signs in this area that prohibit traveling and swimming. On the basis of signing the travel contract, the two sides added the travel itinerary, activity arrangement, matters needing attention, relevant requirements and other contract annexes. The expansion of tourism activities is progressing smoothly according to the contract. 10 On the morning of June 4th, we visited Yanzhou Island in Dinghu District. After lunch, the person in charge of the company negotiated with the tour guide, giving the tourists an hour to tidy up, take a break and return to Guangzhou by bus at 4 pm. The tour guide immediately announced the free activities, and then reminded everyone not to go swimming in Xijiang. At 2: 30 pm that day, seven or eight tourists went to the seaside without authorization, about 2 o'clock.

After the accident, with the joint efforts of the local government, tourism, public security, sea trial and other relevant departments and the travel agency, after friendly consultation with the families of the deceased, the travel agency signed an agreement with the families of the deceased on behalf of the travel agency, and each deceased received economic compensation of 654.38+10,000 yuan, and the travel agency purchased travel accident insurance of 80,000 yuan for the tour group.

Expert commentator, Han Yuling, female, professor, deputy director of the Academic Committee of Beijing Tourism Development Research Base, director of the Research Department of beijing international studies university, and deputy director of the Research Center of Tourism Law and Industry Regulation, mainly engaged in teaching and research work in tourism policies and regulations, tourism safety, world heritage protection and tourism resources protection.

Generally speaking, the common reasons for violating tourists' right to safety and security are as follows: First, the safety awareness is weak. In this case, the expanding tourism organized by travel agencies belongs to special tourism relying on wading places. Before the incident, the tourist destination was flooded by heavy rain and tourists were unfamiliar with rice. Although warning signs prohibiting swimming in the water are set up, there are no corresponding obstacles to prevent tourists from getting into the water. There are security risks in the areas selected by travel agencies. During the free activities, no special personnel were arranged to patrol to prevent passengers from entering the water in time, and tourists lacked the necessary safety guarantee.

Second, blindly reducing the price to compete for tour groups and organizing tourism activities at a price lower than the cost greatly reduces the service quality, reception standards, accommodation conditions and means of transportation. Low prices will inevitably bring high risks. Hiring unqualified personnel, using means of transportation on the road with illness, providing simple accommodation facilities, and the lack of security in tourist sites have all laid the groundwork for the occurrence of tourism safety accidents.

Third, the tourism products provided, especially the characteristic tourism products, or the tourism environment does not meet the requirements of tourism safety. In tourist attractions, amusement facilities are aging, the quality is not up to standard, and there are hidden dangers in the natural environment, such as thunderstorm angel tourists being struck by lightning and getting lost. How to avoid or reduce safety risks when designing tourism products and how to take necessary measures against possible risks are the first problems to be considered.

Fifth, tourists lack due safety awareness and preventive knowledge. In practice, tourists' awareness of tourism safety is not strong, and the lack of tourism safety knowledge is a common phenomenon. The psychology of pursuing maximum benefits because of low prices leads some tourists to consider the price factor too much when choosing tourism products, ignoring the correct evaluation and judgment of the qualifications and abilities of the providers, the safety of tourism products and the reliability of tourism environment. Ignore the necessary constraints on one's own behavior and the exercise of power, and ignore the necessary protection measures for one's own interests to pass on the non-human risks in tourism activities.

This tourist safety accident could have been avoided. This case is thought-provoking:

First, ensure the safety of tourism products and reduce or even eliminate unsafe factors. Tourism products and services provided by tourism operators shall conform to national standards or industry standards. At present, there is no standard that should be guaranteed, correct and in line with personal health and safety. For tourism products or services that may endanger the safety of tourists, it is necessary to make a true explanation and clear warning to tourists and make an agreement in the contract. If it is found that there are serious defects in the tourism products and services provided, even if the tourists adopt the correct use method.

The second is to carry out new special tourism activities and adhere to safety first. In this case, it is very difficult for travel agencies to expand their tourism, design interesting and exciting projects by using natural environments such as mountains and rivers through experience, so as to temper their will, cultivate their sentiments, improve their personality, smelt the harvest of the team, and carry out similar special tourism activities, which is very difficult in terms of risk and prevention. This requires tourism operators to choose product design and location.

Third, the travel contract should clearly define the team travel of the organization unit and stipulate the organization and command responsibility in the travel process. According to the particularity of projects and activities, safety emergency plans should be formulated. The reception unit of the travel agency entrusts the organization of tourism activities, is the party to the tourism contract, and bears reasonable responsibility for ensuring the personal safety of the group tourists. When signing a tourism contract, we should make clear the organizational authority and responsibility division in the process of tourism, so as to avoid the difficulty of responsibility sharing after the accident. In order to increase the management cost of travel agencies, it is necessary to formulate emergency plans for safety accidents according to the particularity of the activity environment to ensure that tourism safety runs through the whole process of tourism activities.
