Article 1 In order to strengthen the administrative supervision of education, promote and guarantee the implementation of educational laws, regulations, principles and policies, and achieve educational goals, these Provisions are formulated in accordance with the provisions of Article 24 of the Education Law of the People's Republic of China and in light of the actual situation of this Municipality.
Article 2 Educational supervision means that the government supervises, inspects, evaluates and guides the educational work within its jurisdiction according to law.
The scope of educational supervision is all kinds of education and related work at all levels and below the secondary level within the administrative area of this Municipality.
The objects of educational supervision include: the people's governments at lower levels and their educational administrative departments; The relevant departments of the people's government at the corresponding level; Schools at all levels and below secondary level.
Article 3 Educational supervision must be based on laws, regulations, rules and policies related to education, adhere to the principle of seeking truth from facts, be objective and fair, and combine supervision, evaluation and guidance.
Chapter II Educational Supervision Institutions, Supervisors and Duties
Article 4 The education supervision office is a specialized institution for the government to exercise the function of education supervision. The municipal, district and county people's governments shall set up education supervision offices, which shall be in charge of education supervision within their respective administrative areas on behalf of the people's governments at the corresponding levels, and accept the guidance of higher education supervision institutions.
The director and deputy director of the Education Supervision Office shall be appointed and removed by the people's government at the corresponding level.
Article 5 The Education Supervision Office of the Municipal People's Government shall perform the following duties:
(a) overall planning, organization and implementation of the city's education supervision work, to guide the counties to carry out education supervision work;
(two) to supervise the implementation of the education laws, regulations, rules and policies of this Municipality;
(three) to supervise the leadership and management of the relevant administrative departments of the city, the district and county people's governments and their education administrative departments;
(four) according to the division of labor, supervise the direction of running schools and the quality of education at all levels and below the secondary level;
(five) to guide the work of the district and county education supervision offices;
(six) in conjunction with the administrative department of education to organize and coordinate the city's education evaluation work;
(seven) to investigate and study major issues in education, report and reflect the situation to the Municipal People's government and its education administrative department, and make suggestions;
(eight) training city and district and county inspectors;
(nine) to organize information exchange and carry out educational supervision and scientific research;
(ten) to perform other duties authorized by the Municipal People's government.
Sixth District and County People's government education supervision office shall perform the following duties:
(a) to organize the implementation of education supervision in this district and county;
(two) to supervise the implementation of laws, regulations, rules and policies related to education in this district and county;
(three) to supervise the leadership and management of the relevant administrative departments of the district and county and the township people's government on education;
(four) according to the division of labor, supervise the direction of running schools and the quality of education at all levels and below the secondary level;
(five) in conjunction with the administrative department of education organization and coordination of district and county education evaluation;
(six) to investigate and study the major issues in the education work of the district and county, report and reflect the situation to the district and county people's governments and their education administrative departments, and make suggestions;
(seven) to organize inspectors to study and carry out scientific research on educational supervision;
(eight) to perform other duties authorized by the county people's government.
Seventh inspectors are personnel who carry out educational supervision and must meet the following basic conditions:
(a) adhere to the party's basic line and love the cause of socialist education;
(two) familiar with the national laws, regulations and policies on education, with a high level of policy;
(three) with a bachelor's degree or equivalent, engaged in education below secondary level for more than seven years, with experience in education, teaching and management, with corresponding working ability;
(four) law-abiding, moral integrity, seeking truth from facts, adhere to principles, decent style, fair;
(5) good health.
Eighth education supervision office set up full-time inspectors, and according to the needs of the work, hire part-time inspectors.
Special education supervisors appointed by the people's governments of cities, districts and counties shall participate in the education supervision of cities, districts and counties.
Part-time inspectors and special education inspectors have the same authority as full-time inspectors.
Article 9 The appointment and removal of full-time inspectors shall be handled in accordance with the personnel management authority and procedures of the relevant administrative organs.
The inspector shall be awarded the inspector certificate by the people's government at the corresponding level.
Tenth inspectors should conscientiously perform their duties. The people's governments at the corresponding levels and their education administrative departments shall provide conditions for inspectors to carry out their work.
Eleventh inspectors should receive training in political theory, education laws and regulations, education management, education supervision and education evaluation.
Chapter III Implementation of Educational Supervision
Twelfth basic forms of educational supervision are comprehensive supervision, special supervision and regular inspection.
Thirteenth comprehensive supervision and special supervision shall be implemented in accordance with the following procedures:
(a) issued a supervision plan or supervision outline to the supervised unit, and issued a "supervision notice";
(two) to guide the supervised units to conduct self-examination;
(three) supervision and inspection or supervision and evaluation of the supervised units;
(four) to inform the supervised unit of the supervision results, put forward the supervision opinions, and issue a notice of the supervision results.
Fourteenth education supervision offices and inspectors have the right to supervise the supervised units in the following ways:
(a) listen to the report;
(two) access to relevant documents, files and materials;
(three) to participate in relevant meetings and educational activities;
(4) Holding symposiums, individual interviews, questionnaires and tests attended by relevant personnel;
(5) Field investigation.
Fifteenth education supervision office and inspectors shall exercise the following functions and powers in the supervision activities:
(a) to put forward suggestions on rewards and punishments for the work of the supervised units and their leading cadres;
(two) to make suggestions on the behavior of the supervised unit in violation of the relevant national education laws, regulations, guidelines and policies;
(three) found that endanger the personal safety of teachers and students, violations of the legitimate rights and interests of teachers and students, disrupting the normal teaching order and other emergencies, instructed the competent units to stop, and put forward suggestions;
(four) directly to the people's government at the same level and the people's government at a higher level and its education administrative departments and educational supervision institutions to reflect the situation.
Article 16 The supervised unit shall conduct self-examination and self-assessment according to the requirements of supervision, cooperate with the education supervision office and inspectors to carry out supervision work, take corresponding improvement measures for the supervision opinions, and report the improvement work in writing to the education supervision office in accordance with the regulations.
If the supervised unit has any objection to the supervision opinions, it may apply for review to the education supervision office that issued the Notice of Supervision Results within 0/5 days after receiving the Notice of Supervision Results. The education supervision office shall make a review conclusion within 30 days, and issue a Notice of the results of supervision and review.
Seventeenth education supervision office shall regularly report the supervision situation to the people's government at the same level and its education administrative departments and higher education supervision institutions, and put forward opinions and suggestions on improving education.
Eighteenth education supervision office shall establish a notification system of supervision results. With the consent of the people's government at the corresponding level, the supervision results can be announced to the public.
Nineteenth inspectors have an interest or other relationship with the supervised unit, which may affect the normal work of educational supervision, and should be avoided.
Chapter IV Legal Liability
Twentieth supervised units and related personnel in any of the following circumstances, by the competent department of the unit to give informed criticism, and the person directly responsible and the person in charge of the unit to give corresponding administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
(a) refusing to provide relevant information, documents and materials to the education supervision office and inspectors;
(two) obstruct the relevant personnel to reflect the situation to the education supervision office and inspectors;
(three) refusing to take improvement measures for the supervision opinions put forward by the education supervision office;
(four) resort to deceit, cheating education supervisors and inspectors;
(five) take revenge on inspectors or personnel who report the situation to the education supervision office and inspectors;
(six) other effects of supervision.
Twenty-first inspectors in any of the following circumstances, by their units to give criticism and education or administrative sanctions; If the circumstances are serious, the people's government at the corresponding level shall revoke its inspector position:
(1) Delaying work due to dereliction of duty;
(two) the use of authority for personal gain;
(three) the use of authority to shield or retaliate against others, and infringe upon the legitimate rights and interests of others;
(four) other acts of abuse of power.
Chapter V Supplementary Provisions
Article 22 Schools at all levels and below the secondary level mentioned in these Provisions refer to kindergartens, ordinary primary and secondary schools, vocational high schools, secondary specialized schools, technical schools, adult schools below the secondary level, schools run by social forces and other educational institutions.
Twenty-third specific issues in the implementation of these Provisions shall be interpreted by the municipal education administrative department.
