According to the provisions of the Marriage Law of the People's Republic of China and the Civil Code of People's Republic of China (PRC), parents are people with guardianship, and should fulfill their obligations of raising, educating and protecting their minor children according to law. Therefore, parents who give birth to children may be suspected of breaking the law if they do not fulfill their obligation to take care of their children.

Specifically, if after the parents who gave birth to the child divorce, the guardianship is exercised by one party, and the other party fails to perform the maintenance obligation, then the party exercising the guardianship can apply to the court for enforcement according to the Marriage Law. If the parents who gave birth to the child are still husband and wife, but they do not fulfill their guardianship obligations, the party exercising the right of supervision may apply to the relevant departments for compulsory execution, and may impose corresponding fines or administrative penalties.

In addition, according to the provisions of the Criminal Law of People's Republic of China (PRC), if the parents who gave birth to children intentionally fail to perform their guardianship duties, causing serious damage to the life, body and health of minors or causing other serious consequences, it may constitute a crime and be sentenced to punishment.

Therefore, parents who have given birth to children should consciously fulfill their obligations to take care of their children, otherwise they may face legal sanctions.
