The punishment of prostitutes by public security organs must be commensurate with the facts, nature, circumstances and social harm of the illegal act, and it is strictly forbidden to replace punishment, reeducation through labor, education and administrative detention with fines.

When dealing with prostitutes, public security organs shall be punished according to the following standards.

(1) Those who engage in prostitution or whoring shall be detained for more than 10 and less than 15, and may be fined up to 5,000 yuan;

(2) Those who engage in prostitution or whoring with people who have reached the age of 14 but have not reached the age of 16, who engage in prostitution for the first time, and those who are forced to engage in prostitution for the first time because of life, are "minors" and shall be detained for not more than 5 days or fined for not more than 500 yuan; Prostitutes can receive education in accordance with the law, in addition to being punished for public security management;

(3) Persons over 16 years old but under 18 years old have been engaged in prostitution for many times, and persons over 18 years old have been engaged in prostitution for more than two times. , and receive education according to law;

(4) Those who engage in prostitution or whoring after being dealt with by the public security organs shall be given reeducation through labor, and the public security organs shall impose a fine of not more than 5,000 yuan.

Administrative detention should be given, but if a person over 70 years old is engaged in prostitution because of pregnancy or breastfeeding 1 baby under one year old, administrative detention will not be imposed.

Legal basis: Article 67 of the Law on Public Security Punishment, whoever lures, shelters or introduces others to prostitution shall be detained for more than 10 days and less than 15 days, and may also be fined less than 5,000 yuan; If the circumstances are minor, they shall be detained for not more than five days or fined not more than five hundred yuan.

Article 359 of the Criminal Law of People's Republic of China (PRC) shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance, and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years and fined.

Whoever lures a young girl under the age of 14 into prostitution shall be sentenced to fixed-term imprisonment of not less than five years and fined.
