(1) Educational institutions or educational service institutions with legal person qualifications;
(2) Having staff who are familiar with the policy of studying abroad at their own expense in China and relevant countries and engaged in educational services;
(3) Having established stable cooperative and exchange relations with foreign educational institutions;
(four) have the necessary funds to protect the legitimate rights and interests of students when their economic interests are damaged, and give compensation according to the agreement. Article 4 The intermediary service of studying abroad at one's own expense belongs to the franchise service industry. An institution applying to engage in intermediary services shall apply to the competent education department of the province, autonomous region or municipality directly under the Central Government where it is located, and report to the Ministry of Education and the Ministry of Public Security for qualification identification after examination and approval. Conditional institutions shall go through the enterprise registration formalities with the local administrative department for industry and commerce. At the same time, go to the exit and entry administration department of the public security organ where the institution is located for the record. Article 5 An institution applying for intermediary services shall submit the following materials when applying:
(1) an application;
(2) Certificate of legal person qualification;
(three) office conditions, office location, business personnel;
(4) Exchanges and cooperation with foreign institutions;
(5) Valid certificates of capital and fixed assets;
(6) The business scope and plan of the proposed intermediary service. Article 6 The business scope of intermediary services includes: relevant information and legal consultation, handling admission applications, providing visa services, training before going abroad, etc. Seventh intermediary services are mainly for China citizens who have completed senior secondary education or higher education and applied for studying abroad at their own expense. Students above junior college who study abroad at their own expense shall comply with the provisions of the Notice on Issues Concerning Studying Abroad at Their Own Expense (Liu Jiao [1993] No.81).
The business activities of intermediary service institutions shall be carried out locally, and the business activities of provinces, autonomous regions and municipalities directly under the Central Government shall be approved by the Ministry of Education in consultation with the Ministry of Public Security. Eighth intermediary service institutions shall directly sign relevant cooperation agreements with foreign universities and educational institutions, and report to the local provincial education administrative departments for the record. Article 9 An intermediary service institution shall sign an intermediary service agreement for studying abroad with students studying abroad at their own expense, and clarify the rights, obligations and responsibilities of both parties. Tenth intermediary service institutions should carry out intermediary services for the purpose of cultivating talents, abide by the relevant laws and regulations of the state, implement the policy of studying abroad at their own expense, and charge reasonable fees. Eleventh students studying abroad at their own expense can apply for passports with the relevant certificates issued by intermediary service agencies and foreign invitations. Among them, those with college education or above should issue relevant certification materials from the local education authorities when applying for passports. Article 12 Advertisements for self-funded study abroad intermediary services must be approved by the administrative authorities for industry and commerce at or above the provincial, autonomous region or municipality directly under the Central Government. Advertisements without the above-mentioned approval documents or inconsistent with the approval documents shall not be designed, produced, represented or published. In violation of the above provisions, the administrative department for industry and commerce shall punish the relevant responsible persons according to the Advertising Law of People's Republic of China (PRC). Article 13 The education departments of provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the public security and the administrative departments for industry and commerce, exercise management and supervision over intermediary service institutions in their respective regions. Intermediary service institutions engaged in illegal business activities, shall be ordered to make rectification within a time limit; If serious consequences are caused, legal responsibilities shall be investigated according to law, and the qualification of self-funded study abroad intermediary service shall be cancelled after approval by the Ministry of Education and the Ministry of Public Security. Apply to the administrative department for industry and commerce for cancellation of registration within a time limit, and if it refuses to do so, its business license shall be revoked according to law. Fourteenth institutions that have been approved by the relevant departments (including registered in the administrative department for Industry and Commerce) to carry out intermediary services for studying abroad at their own expense before the promulgation of these Provisions shall stop the corresponding business and go through the examination and approval procedures again according to these Provisions. Institutions without qualification and enterprise registration shall not engage in intermediary service activities for studying abroad at their own expense in any way. Institutions that carry out such business without authorization shall be investigated and dealt with by the local education authorities in conjunction with the local public security and industrial and commercial administrative departments according to law. Article 15 The Ministry of Education, the Ministry of Public Security and the State Administration for Industry and Commerce shall be responsible for the interpretation of these Provisions. Article 16 These Provisions shall come into force as of the date of promulgation.
