Not only the sales offices, but also the external walls and light boxes of the community are affixed with the words "Hanlinxuan returns my real estate license". On July 27, nearly 100 owners poured into the sales office, questioning the developer's poor work and failing to solve the problem of real estate license for many years. One owner said: "We only need the real estate license. The dispute between the school and the developer has nothing to do with us. We can only find developers. " Another owner claimed that if the developer didn't solve the problem of real estate license, she would be dead. It is understood that the owners and developers have negotiated in groups for many times, but fortunately there is no conflict.

According to public information, Hanlinxuan was invested and built by Guilin Hanlin Real Estate Development Co., Ltd., with a total construction area of10.2 million square meters. The project consists of four high-rise buildings with mature peripheral facilities. The community is adjacent to high-speed railway station, Guilin, 20 minutes' drive from the core area of Guilin, and separated from the middle school attached to Normal University by a wall, which is very popular.

It is understood that the construction of the residential area began in 2008, and it was opened for sale in October 201165438 10, and the project was completed by the end of October 20 12, and the delivery conditions were met by the end of March 20/kloc-0. School: Build fences to ensure safety.

The failure to complete the acceptance of Hanlinxuan is the result of intentional obstruction by the middle school affiliated to Guangxi Normal University. In fact, "Hanlinxuan" is a cooperative project between the middle school affiliated to Guangxi Normal University and Hanlin Real Estate Company. Because the development time of the community was as long as 5 years, 20 12, and the principal changed, the new principal began to attack Hanlinxuan after taking office, obstructing its completion acceptance, and the means were very clumsy: planning fire exits in the community, forcibly building walls, and attacking developers by kidnapping the owner's real estate license.

At the beginning of 20 13, Liu, the new principal of the middle school attached to Normal University, set up fences and temporary canteens for students on the planned fire exits on the south and west sides of Hanlinxuan project, thus opening a three-year tug-of-war between the school and the community. In recent years, the school has been forced to build many times, while the community has been demolished many times, which has gone through several rounds. The apparent reason for building the fence in the middle school attached to Normal University is to maintain school safety. The letter also listed two campus safety cases: a student injury occurred in Longfan Primary School in Haikou City, and a man killed 10 students with a knife; A gangster in Henan Province drove a BYD car into a student, causing 12 students to be injured. Yuan Guiren, Minister of Education, said that the recent speech of Minister Yuan instructed that campus safety should be effectively strengthened.

On March 20th, the school again issued a letter to Hanlinxuan, which was copied to Lingchuan County Party Committee, county government and other departments, expressing the reasons and demands of the school. There are five requirements, which are summarized as follows: 1 Construction of demolished fences; 2. Give gifts and apologize; 3. Developers replace negotiators; 4. Negotiations can be conducted on the premise that the first three articles are met; If negotiation fails, the school will sue the law. At the same time, a compensation proposal is attached to the letter, and there are also five items: 1, and the compensation amount is calculated according to the developer's development profit; 2. Compensation for the construction cost of the school canteen; 3. Compensation for delayed delivery to teachers; 4. Compensation for losses caused by the removal of fences; 5. The original promise of 500,000 yuan to the school.

Developers believe that the above requirements of the school boil down to nothing more than asking for money, but they never give a clear figure, but endless asking prices. The developer once offered the school 6,543,800 yuan to solve this problem, but the school dismissed it as "Are you sending beggars away?"

Developer: The owner was kidnapped and helpless.

Regarding the owner's real estate license, director Hanlin Company thinks that he is also a victim. Hanlin said that this was originally a matter between the school and the developer, and both parties could solve it through judicial channels. However, the school maliciously blocked the fire escape, making the property unacceptable. The essence is to kidnap all owners and use their anger to put pressure on developers. The company is deeply helpless. At present, a large number of owners have actually moved in. In case of fire, the consequences would be unimaginable. The school is joking about public safety.

It is understood that from February to April, 2006, the Lingchuan Municipal Party Committee and the county government sent a working group headed by the Standing Committee of the County Party Committee to coordinate this matter, but it ended without results; In May, Hanlin Company sent a letter to Zhao Leqin, secretary of Guilin Municipal Party Committee, for help; In June, Hanlin Company petitioned Guilin Bureau for help. At the same time, in May this year, Hanlin Company filed a lawsuit with the court, which has filed a case, but has not yet notified the court time.

It is understood that the reason why the school interferes with and obstructs the completion acceptance of Hanlinxuan is not only that the principal changes and the new principal disagrees with the established cooperation plan of the former principal, but also that the school cooperates with the developer to build a house, and the school loses money and the developer makes money, so it must share more benefits before giving up.

The reason why the school put forward the fence problem is that although the fence built by the school is planned as a fire escape in the planning of the community, it is outside the red line of the community. In other words, this piece of land less than 1 mu still belongs to the school. If developers want this land, they have to pay extra for it.

The developer said that according to the common sense of the construction industry, the red line of land use is not equal to the building sideline, and it should be designed and constructed in strict accordance with the plan. In the planning and design drawings that have been submitted for approval (submitted by the school to the planning and construction department) and put on record, this road is a fire escape, and the school's blocking is unreasonable. To take a step back, it is not enough to pay 6,543,800,000 yuan according to the highest land price in Lingchuan County (900,000 yuan per mu) for this piece of fire escape land of less than 654.38+0 mu, but the school thinks that 6,543,800 yuan is "sending beggars away" and there is no basis for negotiation. Furthermore, in 2008, the school and the community also signed a supplementary agreement on this issue, stipulating that the developer would pay the school an additional 300,000 yuan, which has been paid. At first, it was not a problem, but it was brought up again, and it was looking for bones in eggs.

Regarding the cooperative development of "the school loses money and the developers make money", Hanlin Company said that the middle school attached to Normal University obtained the land for development at an ultra-low price, but there was no fund for development, so the cooperative development with Hanlin Company brought great practical benefits to the school. On the surface, Hanlin Company took the land at a low price, but after paying the land transfer fee and the land compensation (4 million yuan) to the Lingchuan County Bureau of Land and Resources, the land purchase price has been higher than the market price. Later, at a lower cost price, 100 apartment was sold to school staff, a 3,000-square-meter canteen was given to the school, 300,000 fire escape fees were paid, and a car worth more than 200,000 was given. The land acquisition price was already several times the market price. Just because the headmaster changed, the school ignored the old accounts and re-proposed the distribution plan, which required astronomical figures, which was really unreasonable. Even so, it can be solved in court. We can't deliberately block the fire escape to block the completion acceptance and take all the owners hostage, not to mention that 100 of these owners are school staff.
