Legal analysis: Hangzhou Nanjiao Prison is located in Xinjie Street, Xiaoshan District, and belongs to Hangzhou Municipal Bureau of Justice. Formerly known as Hangzhou No.2 Labor Reform and Discipline Detachment, it was renamed Hangzhou Nanjiao Prison on June 1994. Since the establishment of the prison for more than 20 years, with the care and support of the Provincial Department of Justice, under the correct leadership of the Party Committee of the Hangzhou Municipal Bureau of Justice and under the guidance of the Provincial Prison Administration, certain achievements have been made in the supervision, education and reform of criminals. The prison has won the collective second-class merit of the Provincial Department of Justice and the collective third-class merit of the Provincial Prison Administration successively 1 time. The party committee of the prison was awarded the title of "Safe Prison" by committee of cpc zhejiang provincial committee and Hangzhou Municipal Committee respectively, and was awarded the title of "Advanced Grass-roots Party Organizations in provinces and cities and the satisfactory leading group of police officers in Hangzhou political and legal system for three consecutive years. In 2000, it was awarded "provincial modern civilized prison" by the Provincial Department of Justice, and in 2006, it was awarded as the advanced collective of the prison system in the province and the first "five-star second-class" unit of the prison system in the province. The prison, Xiaoshan District Labor Bureau and Justice Bureau set up the first "employment guidance station" for prisoners in the prison system of the whole province. In August 2006, the "Zhejiang Law and Discipline Education Base" jointly established by provinces, municipalities and districts was formally established in Nanjiao Prison.

Legal basis: Provisions on the Specific Application of Laws in Handling Cases of Commutation and Parole

Article 2 When handling a case in which a criminal meets the conditions of "commutation" stipulated in the first paragraph of Article 78 of the Criminal Law, factors such as the nature and specific circumstances of the crime committed by the criminal, the degree of social harm, the performance of the original judgment and the property judgment in the effective judgment, and the consistent performance after delivery shall be comprehensively investigated.
