The land for primary and secondary schools and kindergartens as mentioned in these Regulations includes land for education and teaching, sports venues, living facilities for students (children) and green land. Article 3 The municipal and county (city) people's governments shall strengthen the planning, management and protection of the land for primary and secondary schools and kindergartens. City, county (district, city) education department is responsible for the supervision and management of the protection of primary and secondary schools and kindergartens.
Development and reform, planning, land and resources, construction, environmental protection, urban management and other relevant competent departments shall, within the scope of their respective duties, do a good job in the protection of land for primary and secondary schools and kindergartens. Chapter II Protection of Planned Land Article 4 The planning and construction of primary and secondary schools and kindergartens shall be incorporated into the national economic and social development planning, the overall land use planning and the overall urban planning of this Municipality, with overall arrangement, rational layout and supporting construction. Fifth city and county (city) education departments shall, jointly with the planning departments at the same level, according to the overall urban planning, prepare a special plan for the construction and layout of primary and secondary schools and kindergartens in this area, and report it to the people's government at the same level for approval. The approved special plan for the construction and layout of primary and secondary schools and kindergartens shall not be changed by any unit or individual without authorization. If it is really necessary to change the construction of major infrastructure in urban and rural areas, it shall be submitted for approval in accordance with the original examination and approval procedures.
The competent department of planning shall obtain the consent of the competent department of education before determining the location of the land for the construction of new primary and secondary schools and kindergartens. Sixth planning departments in the preparation of new district, development zone, old city planning and approval of new residential district planning, should be based on the special planning of primary and secondary schools, kindergartens, construction land and projects. Seventh primary and secondary schools, kindergartens, construction land should meet the requirements of environmental functional areas, and keep a corresponding distance from industrial areas and polluting construction projects. Article 8 Urban and rural construction shall be planned according to the following principles:
(1) Set up a kindergarten with 12 classes per 10,000 permanent population areas;
(two) the establishment of a class of twenty-four primary schools for every ten thousand residents;
(3) Establish a middle school with 36 classes for every 20,000 residents. Ninth new primary and secondary schools and kindergartens shall meet the following requirements:
(a) the kindergarten land for each student is not less than fifteen square meters;
(two) the land for each primary school student is not less than twenty-three square meters;
(3) The land for each junior high school student is not less than 30 square meters;
(4) The land for each senior high school student shall not be less than 35 square meters.
When planning the land for the construction of primary and secondary schools and kindergartens, it is necessary to appropriately reserve development space. Boarding schools and schools that cannot meet the requirements of the general layout because of the irregular shape of land should appropriately increase the land area. Tenth shall not be reserved for primary and secondary schools and kindergartens planning land for other purposes. If it is necessary to adjust due to public interests, the competent department of planning, land and resources shall solicit the opinions of the competent department of education at the same level and report to the people's government at the same level for approval. Eleventh due to urban and rural construction, it is really necessary to temporarily occupy the reserved land for primary and secondary schools and kindergartens, and shall go through the formalities for temporary land use in accordance with relevant regulations. After the expiration of the term of temporary land use, the construction unit shall return the land and restore it to its original state.
It is forbidden to build permanent buildings, structures and other facilities in the reserved land for primary and secondary schools and kindergartens that have been temporarily occupied with approval. Chapter III Protection of Existing Land Article 12 After applying for land registration according to law, the existing land of primary and secondary schools and kindergartens shall be issued with certificates by the competent department of land and resources. Thirteenth primary and secondary schools and kindergartens, new construction, renovation and expansion planning, should be reviewed by the competent department of education, the planning department for approval.
The construction unit shall carry out the construction in accordance with the approved planning scheme of primary and secondary schools and kindergartens and the construction standards stipulated by the state. Fourteenth no unit or individual may occupy the land of primary and secondary schools and kindergartens or change the nature of the land without authorization. If urban and rural construction really needs to occupy the existing land for primary and secondary schools and kindergartens, the competent department of planning and construction shall solicit the opinions of the competent department of education and report to the people's government at the same level for approval.
Requisition of primary and secondary schools and kindergartens, the construction unit shall, according to the requirements of urban and rural planning and the standards for the construction of primary and secondary schools and kindergartens, give priority to the nearby reconstruction in accordance with the principle of "building before levying". Occupation of teaching land in primary and secondary schools and kindergartens shall be supplemented on the basis of the original area. Fifteenth primary and secondary schools, kindergartens, the existing land shall not be built for teaching staff and their families and buildings, structures and other facilities unrelated to teaching.
Buildings, structures and other facilities shall not be built outside the walls of primary and secondary schools and kindergartens.
