Experience of learning education law
The hope of revitalizing the nation lies in education, and the hope of revitalizing education lies in teachers. Teachers bear the historical responsibility of training the next generation for the country. The development and improvement of teachers directly affect the national quality and the cultivation of talents at all levels. After more than ten years of practice and exploration, the lifelong learning of teachers in China has initially embarked on the track of institutionalization, scientification and standardization. The idea and concept of lifelong learning are gradually accepted by teachers and become an important part of teachers' work and life. Law is the norm to regulate people's behavior. It is inextricably linked with each of us in our study, life and work, permeates all aspects of our lives and is our protector. As a teacher, I have gained a profound understanding by learning from others. In particular, the third chapter of the book: legal issues in teachers' teaching, has lit a bright light for my education and teaching career.

We should examine our teacher-student relationship from the perspective of the right to education and the right to education.

First, the relationship between teachers and students is the relationship between people and the right to education.

First of all, the relationship between teachers and students is not a hierarchical relationship under the framework of high and low dignity and mediocre authority, but a real interpersonal relationship. This real relationship between people and education is the relationship of mutual respect and being respected.

Article 1 of the Universal Declaration of Human Rights stipulates: "All human beings are born free and equal in dignity and rights. They are endowed with advantages and conscience and should treat each other in a brotherly spirit. " Article 26 stipulates: "The purpose of education is to fully develop human personality and strengthen respect for human rights and freedom of energy conservation." Obviously, according to the Universal Declaration of Human Rights, the right to be respected exists because of the existence of a person's life, whether as a student or a teacher. Teachers, as educators, should fully develop students' personality and strengthen respect for students' human rights and basic freedoms for the purpose of education. There is no reason to respect or disrespect students under certain conditions.

Secondly, the teacher-student relationship is not only the relationship between educators and educatees, but also the relationship between the right to education and the right to education. Students' right to education is an absolute right, which requires teachers to respect students, fulfill their obligations and guarantee their qualifications for education according to law.

Judging from the interpretation of the right to education in China's Constitution, the Convention on the Rights of the Child, the Declaration on the Rights of the Child and the Universal Declaration of Human Rights, the right to education is first a human right and then a legal right.

Second, the development of the right to education

Students' right to education has undergone and will undergo a process of continuous development and improvement in the practice of rule of law education. In modern society, the right to education is increasingly recognized by people because of its role in human development and its significance as one of the basic rights that people should enjoy. It has become a common concern of the international community to stipulate and guarantee the right to education according to law, which is manifested in the development trend of pursuing the learning right and education right of the disadvantaged groups in newspapers.

The right to study is a new expression of the right to education based on the new understanding of the right to education in modern society, and its significance lies in protecting the interests of the subject of the right to education to the maximum extent.

If social inequality hinders the progress of tomorrow's society, educational strategies must strive to determine and spread learning methods more widely. In this regard, China has made legal provisions to report the right to education of vulnerable groups according to law:

First, women's right to education is guaranteed. Article 9 of the Education Law stipulates: "People's Republic of China (PRC) citizens have the right and obligation to receive education. Citizens, regardless of nationality, race, sex, occupation, property status, religious beliefs, etc. , enjoy equal opportunities for education according to law. " Article 36 stipulates: "Educated people shall enjoy equal rights of admission, further studies and employment according to law." Schools and relevant administrative departments shall, in accordance with national and administrative regulations, ensure that women enjoy equal rights with men in enrollment, further studies, employment, conferring academic degrees, and sending them to study abroad. The Education Law specifically stipulates that schools and relevant administrative departments should guarantee women's equal rights to education under the condition of ensuring citizens' equal rights to education, which conforms to the basic principles established by China's Constitution and the Law on the Protection of Women's Rights and Interests, and is conducive to preventing gender discrimination and realizing the equality of educated people in educational opportunities and educational achievements.

Second, protect the right to education of children, teenagers and young people with financial difficulties. Article 37 of the Education Law stipulates: "The state and society provide various forms of financial assistance to children, adolescents and young people who meet the requirements for admission and have financial difficulties." Due to the unbalanced regional economic development in China, the enrollment of students from poor families has been affected, especially in the non-compulsory education stage, and the fee-paying school system has increased the burden of demotion for students. In this regard, the state guarantees the right to education of children, adolescents and young people with financial difficulties through scholarships, student loans, subsidies, work-study programs and tuition and miscellaneous fees reduction.

Third, guarantee the right to education for the disabled. Article 38 of the Education Law stipulates: "The state, society, schools and other educational institutions shall regularly educate disabled people according to their physical and mental characteristics and needs, and provide them with help and convenience." Disabled people are a particularly difficult social group. In order to protect the right of the disabled to receive education, the state has promulgated the Compulsory Education Law, the Law on the Protection of the Disabled, the Detailed Rules for the Implementation of Compulsory Education, the Regulations on Hot Education for the Disabled, Several Opinions on Developing Special Education, the Notice on Doing a Good Job in Recruiting Young Candidates with Disabilities in Secondary Specialized Schools, and the Trial Measures for Developing Children and Teenagers with Disabilities to Study in Regular Classes, and other laws and regulations to protect the disabled according to law.

Fourth, protect the right to education of juvenile offenders. Article 39 of the Education Law stipulates: "The state, society, families, schools and other educational institutions shall create conditions for minors who commit crimes to receive education." In order to protect minors' right to education, China has promulgated the Law on the Protection of Minors in People's Republic of China (PRC), the Prison Law in People's Republic of China (PRC) and other laws and regulations, which implement the principles of education, probation and salvation for minors who violate the law, and carry out cultural education, labor and technical education and vocational education while correcting their thoughts and behaviors, so as to protect minors' right to education and promote their transformation and healthy growth. Among them, schools and other educational institutions, judicial organs, government, families and society have the obligation to protect the right to education of minors who violate the law and commit crimes according to law.

Fifth, protect the right to education of children of floating population. The protection of migrant children's right to education is a new situation and problem in the process of reform and opening up in China. In the past, the basic education in China was based on the household registration system. However, under the market economy, the children of floating population have difficulties in enrolling and receiving education. Therefore, in 1998, the former State Education Commission and the Ministry of Public Security jointly issued the Interim Measures for the Education of Migrant Children and Adolescents, which provided a legal basis for the protection of migrant children's right to education and provided conditions for the implementation of the compulsory education law and the improvement of the quality of the whole people.

To sum up, the new relationship between teachers and students that we should establish is not based on the relative relationship between teachers and students, nor on whether students have transcendence and whether they are likely to become educators. Teachers' respect for students should be the respect for students' right to education as human beings, which is the absolute right of students. Teachers and other subjects should protect students' right to education according to law. Teachers should give more respect to the disadvantaged groups who lack knowledge and have limited transcendence ability. At the same time, teachers' respect for students is emphasized, and students are never excluded from respecting teachers. As educators, teachers also have the right to be respected. If we don't understand the relationship between teachers and students from the theoretical essence, then the phenomena of disciplining students, restricting their development, inhibiting their enthusiasm and creativity will emerge one after another.
