Chapter I General Provisions Article 1 In order to strengthen the supervision and administration of production safety, prevent and reduce production safety accidents, and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Work Safety and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the safety production activities of units engaged in production and business operation within the administrative area of this Municipality (hereinafter referred to as production and business operation units). Article 3 The principle of safety first, prevention first and comprehensive management shall be adhered to in production safety. Article 4 The municipal and district people's governments shall formulate special plans for production safety, incorporate them into the overall plan for national economic and social development, and organize their implementation.

The municipal and district people's governments shall set up special funds for production safety. Special funds for production safety should be included in the fiscal budget of the government at the same level, and increase year by year with the growth of fiscal revenue. Article 5 The municipal and district people's governments shall set up a safety production committee as the deliberation and coordination body of safety production, which shall be responsible for coordinating and guiding the work of safety production within their respective administrative areas and coordinating and solving major problems in safety production. Article 6 The safety production supervision and management department of the municipal and district people's governments (hereinafter referred to as the safety supervision department) comprehensively manages the work of safety production within their respective administrative areas, exercises the functions of safety production supervision and management according to law, and organizes the implementation of these Regulations.

Other relevant government departments shall, within the scope of their respective duties, do a good job in the supervision and administration of production safety according to law. Article 7 The administrative committee of economic functional zones shall formulate special plans for production safety and set up special funds for production safety.

The Administrative Committee of the Economic Functional Zone shall set up a safety production committee, establish a safety production supervision and management institution, and be equipped with safety production supervision and management personnel to be responsible for the safety production supervision within its jurisdiction. Eighth town people's government, street offices should be equipped with safety production supervision and management personnel, responsible for the supervision of production safety in towns and streets under their jurisdiction. Article 9 The production and business operation entity is the main body responsible for production safety. Production and business units shall strengthen the management of production safety according to law, establish and improve the responsibility system for production safety, improve the conditions for production safety and ensure production safety. Tenth people's governments at all levels and their relevant departments should take various forms to strengthen the publicity of safety laws, regulations and knowledge, and enhance the safety awareness and safety prevention ability of the whole society.

Newspapers, radio, television and other news media in this Municipality shall carry out publicity and education on public welfare safety production free of charge, and supervise the illegal acts of safety production by public opinion. Eleventh people's governments at all levels shall establish a safety production reward system to commend and reward units and individuals that have made remarkable achievements in safety production. Chapter II Responsibility and Guarantee of Safety in Production Article 12 The principal responsible person of a production and business operation entity is the first responsible person of the unit for safety in production and is fully responsible for the safety in production of the unit; The person in charge of production safety is the person directly responsible for production safety and bears direct leadership responsibility for production safety; Other responsible persons shall be responsible for the work of production safety within their respective business scope. Thirteenth production and business units shall meet the following conditions for safe production:

(a) the production and business premises, equipment and facilities meet the requirements of relevant laws, regulations and mandatory standards for production safety;

(two) establish and improve the safety production management system, formulate safety production operation procedures;

(three) the establishment of safety production management institutions or equipped with safety production management personnel;

(four) to equip employees with labor safety protection articles that meet the mandatory standards;

(five) the main person in charge and the safety production management personnel have passed the safety production training and assessment;

(six) employees have received education and training in production safety;

(seven) other safety conditions stipulated by laws, regulations and mandatory standards. Fourteenth production and business units shall establish the following safety production management system:

(a) the responsibility system for production safety;

(2) Safety education and training system;

(3) The reward and punishment system for production safety;

(4) Safety production document system;

(5) Management system for dangerous operations;

(six) the safety management system of production and business premises, equipment and facilities with greater risk factors;

(seven) the system of safety production inspection and hidden danger registration and rectification;

(eight) labor safety protection equipment and management system;

(9) Emergency rescue system;

(ten) production safety accident reporting and investigation and handling system;

(eleven) other rules and regulations to ensure safety in production. Fifteenth production and business units shall ensure the necessary investment in production safety. Mines, construction units and production and business units in high-risk industries such as dangerous chemicals, fireworks and firecrackers, civil blasting equipment, transportation, electric power and metallurgy. Safety expenses shall be drawn in accordance with the prescribed proportion. Safety expenses are included in the production cost, stored in special accounts and used exclusively for safety production. Sixteenth production safety funds or safety expenses of production and business units shall be used for the following safety matters:

(1) safety technical measures for engineering construction;

(2) Updating and maintenance of safety equipment and facilities;

(3) Publicity, education and training on production safety;

(4) Equipment of labor safety protection articles;

(5) Monitoring and management of major hazard sources and assessment and rectification of hidden dangers of accidents;

(six) emergency rescue equipment, materials and emergency rescue drills;

(seven) other matters to ensure safety in production.
