Article 2 These Provisions shall apply to the activities of providing and using express delivery services in People's Republic of China (PRC) and their supervision and administration.
Where laws, administrative regulations and relevant departments of the State Council have other provisions on articles prohibited from entering or leaving the country, such provisions shall prevail.
Article 3 The prohibited items mentioned in these Provisions (hereinafter referred to as prohibited items) mainly include:
(a) all kinds of articles that endanger national security, disrupt social order and undermine social stability;
(two) explosive, flammable, corrosive, toxic, infectious, radioactive and other items that endanger the safety of delivery;
(3) Other articles prohibited by laws, administrative regulations and relevant departments of the State Council.
Please refer to the attached Directed Catalogue of Prohibited Articles for specific prohibited articles.
Article 4 The postal administration department shall urge and guide enterprises providing postal delivery services (hereinafter referred to as postal delivery enterprises) to implement the inspection system for receiving and delivering, and urge them to strengthen the safety management of postal delivery; Supervise and guide delivery enterprises to strengthen safety education and training for employees; Carry out safety supervision and inspection on delivery enterprises according to law, and investigate and deal with illegal acts of receiving and sending prohibited items.
Article 5 Users shall abide by laws, administrative regulations and provisions of relevant departments of the State Council on prohibited items, and shall not deliver prohibited items, carry prohibited items in mail or express mail, or conceal or falsely report prohibited items as other items.
Article 6 A delivery enterprise shall publicize these Provisions and related guidance catalogues in its business premises and other ways.
Seventh delivery enterprises should establish and improve the safety education and training system, strengthen the awareness of prevention, identification knowledge and the ability to dispose of prohibited items. Employees without safety education and training are not allowed to work at their posts.
Article 8 The delivery enterprise shall strictly implement the acceptance and inspection system, and check on the spot according to law whether the articles delivered by users belong to prohibited articles, and whether the name, nature and quantity of the articles are consistent with the contents filled in the delivery list, so as to prevent prohibited articles from entering the delivery channels.
Article 9 A delivery enterprise shall establish and improve a safety inspection system, equip it with safety inspection equipment conforming to national standards or industry standards, and arrange personnel with professional skills to conduct safety inspection on mail and express mail.
Article 10 A postal enterprise shall formulate a plan for the disposal of prohibited articles, revise it in a timely manner according to changes in the situation, and file it with the postal administration department. If prohibited items are found in the mailing process, they should be properly disposed of in accordance with the provisions of the plan.
Article 11 If a mailing enterprise finds prohibited items or suspected prohibited items after receiving and posting, it shall stop posting and immediately report to the postal administration department where the incident occurred, and handle it according to the following provisions:
(a) found all kinds of guns (including imitations, main parts), ammunition, control equipment and other items, should immediately report to the public security organs;
(two) found all kinds of drugs, precursor chemicals, should immediately report to the public security organs;
(three) found all kinds of explosives, inflammable and explosive dangerous goods, should immediately evacuate the crowd, isolate the scene, and report to the public security organs;
(4) When discovering all kinds of radioactive, toxic, corrosive, infectious and other dangerous goods, it shall immediately evacuate people and isolate the site, and report to the public security, environmental protection, health and epidemic prevention and production safety supervision and management departments as appropriate;
(five) found that endanger national security and social stability of all kinds of illegal publications, printed matter, audio-visual products and other promotional materials, shall promptly report to the state security, public security, press and publication departments;
(six) found all kinds of forged or altered currency, certificates, seals and counterfeit goods, shall promptly report to the public security, industry and commerce administration and other departments;
(seven) the discovery of various rare and endangered wild animals and their products shall be reported to the public security, wildlife administration and other departments in a timely manner;
(8) If articles prohibited from entering or leaving the country are found, they shall report to the customs, national security, entry-exit inspection and quarantine departments in a timely manner;
(nine) found that the use of non confidential channels to send documents, materials and other items involving state secrets, it should be reported to the state security organs in a timely manner;
(ten) found special spy equipment or suspected spy equipment, shall promptly report to the state security organs;
(eleven) found other prohibited items or suspected prohibited items, it shall report to the relevant government departments according to law.
Article 12 The postal administration department shall, after receiving the report that the postal delivery enterprise finds the prohibited articles, report to the superior in accordance with the regulations, and cooperate with the departments of public security, national security, health and epidemic prevention, customs, inspection and quarantine, press and publication, industry and commerce administration, production safety supervision and management, wildlife administration and so on as appropriate to deal with it according to law.
Article 13 The catalogue of prohibited articles shall be determined and published by the postal administration department of the State Council jointly with relevant departments, and adjusted in a timely manner.
Article 14 The postal administration and other departments may commend the units and individuals that discover and report prohibited articles in time, safeguard national security, public security and people's lives and property safety, or effectively avoid or reduce delivery safety accidents.
Fifteenth delivery enterprises illegally accept and send prohibited items, the postal administration department shall be punished in accordance with the provisions of the "People's Republic of China (PRC) Postal Law", "People's Republic of China (PRC) Anti-Terrorism Law" and other laws and administrative regulations.
Article 16 If a user, in violation of the provisions of these Regulations, carries prohibited items in mail or express mail, conceals or falsely reports that the prohibited items are other items, thus causing personal injury or property loss, he shall be liable for compensation according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law; If it does not constitute a crime, it shall be punished in accordance with the Law of People's Republic of China (PRC) on Public Security Administration Punishment and other relevant laws and administrative regulations.
Seventeenth the provisions shall come into force as of the date of promulgation. On June 6, 2007, the Catalogue of Prohibited Articles and Disposal Measures (Trial) issued by the State Post Bureau (You Guo Fa [2007] 152) was abolished at the same time.
