The principle of who benefits and who bears in civil law
Legal analysis: it is not a principle of civil law that whoever benefits is responsible. The principles of China's civil law can be roughly divided into two categories: one is generally binding on the content of civil law, which is the basic norm guiding civil legislation, civil trial and civil activities, such as equality and voluntariness, and some are applicable to specific civil legal relations, such as fairness, honesty and credibility.

Legal basis: Article 183 of the Civil Law of People's Republic of China (PRC) (hereinafter referred to as "Civil Law") stipulates that if the infringer causes his own damage by protecting the civil rights and interests of others, the infringer shall bear civil liability and the beneficiary may give appropriate compensation. If no infringer or infringer escapes or is unable to bear civil liability, and the victim requests compensation, the beneficiary shall give appropriate compensation.
