Regulations of Beijing Municipality on Guarding State Secrets
Chapter I General Provisions Article 1 In order to keep state secrets, safeguard national security and interests, and ensure healthy economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Guarding State Secrets, the Regulations for the Implementation of the Law of People's Republic of China (PRC) on Guarding State Secrets and other laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 State organs, political parties, social organizations, enterprises, institutions and other units and individuals responsible for guarding state secrets (hereinafter referred to as secrecy) in this Municipality shall abide by these Regulations. Article 3 The secrecy work adheres to the overall concept of national security, and follows the principles of party-managed secrecy, legal management, comprehensive prevention and innovation-driven, which not only ensures the security of state secrets, but also facilitates the rational utilization of information resources. Article 4 Adhere to China's leadership over confidentiality. Under the leadership of the Party committees at the same level and the secrecy committees at higher levels, the secrecy committees of the municipal and district Party committees shall be responsible for the secrecy work in their respective regions. Article 5 The municipal and district secrecy administrative departments are the functional departments in charge of secrecy work of the people's governments at the same level, and perform the duties of secrecy management according to law under the guidance of the secrecy administrative departments at higher levels. Article 6 The organs and units involved in state secrets in this Municipality (hereinafter referred to as organs and units) shall be responsible for the confidentiality work of their own organs and units, and perform the following confidentiality duties according to law:

(a) to establish and improve the confidentiality management system;

(2) Determination, alteration and termination of state secrets;

(3) conducting a confidential review of the information to be disclosed;

(four) to determine and manage the confidential personnel;

(five) to determine and manage the key departments of confidentiality;

(six) the management of state secrets;

(seven) to carry out the safety management of information systems and information equipment;

(eight) equipped with confidential technical facilities and equipment;

(nine) to carry out confidential publicity and education;

(10) Organizing safety inspection;

(eleven) to assist in investigating cases of violation of confidentiality laws and regulations;

(twelve) other confidentiality duties that should be performed according to law.

Municipal state organs shall, within the scope of their functions and powers, manage or guide the security work of this system.

Township and town people's governments and subdistrict offices shall designate personnel to be responsible for daily public security management, strengthen public security publicity and education and safety inspection, and supervise and guide the public security work of their subordinate units. Seventh organs and units to implement the responsibility system of confidentiality. The principal responsible person is fully responsible for the confidentiality work of the organ and the unit, the person in charge of confidentiality and business work is responsible for the corresponding leadership responsibility for the confidentiality work within the scope of duties, and the staff is directly responsible for the confidentiality work of this post.

State organs and units shall, in accordance with the provisions of the state, set up or clarify the security work institutions and equip them with necessary working forces. Article 8 The municipal and district people's governments shall strengthen the construction of confidential infrastructure and key confidential scientific and technological products and equipment. The municipal safety administrative department shall guide and promote the research and development and application of key safety technology products.

The funds required for the confidentiality administrative department to perform its duties shall be included in the budget at the corresponding level. The funds required by organs and units to carry out safety work shall be included in the annual budget or annual revenue and expenditure plan. Article 9 The municipal and district people's governments and their relevant departments shall guide and urge the organs and units to do a good job in confidential publicity and education, and encourage the mass media to carry out confidential publicity and education for the society.

The municipal and district departments in charge of civil servants shall incorporate confidential education into the civil servant education and training system. Institutions of higher learning and secondary schools should combine ideological and political, moral and legal teaching to carry out confidential education. The municipal and district secrecy administrative departments shall provide support and guidance. Article 10 This Municipality shall commend and reward units or individuals that have made remarkable achievements in secrecy work, and the specific measures shall be formulated by the municipal human resources and social security department in conjunction with the municipal secrecy administrative department. Chapter II Classified Management Article 11 State organs and units shall determine, change and dissolve state secrets in accordance with their classified authority. If it is really necessary for an organ or unit without confidentiality authority to determine state secrets, it shall report to the organ or unit at a higher level with confidentiality authority, the competent business department or the secrecy administrative department for determination.

If a higher-level organ, unit or competent business department finds that a lower-level organ or unit has an improper classification, it shall promptly notify it to correct it, or it may directly make a decision on confirmation, change or termination.

State secrets arising from the implementation of confidential matters of higher-level organs, units or other organs and units shall be classified according to the state secrets implemented or handled.

The scope and classification of state secrets shall be implemented in accordance with state regulations, and no organ or unit may expand the scope of determining state secrets. Twelfth organs and units can apply for or make secret authorization in accordance with the relevant provisions of the state.

The municipal secrecy administrative department shall, in accordance with the provisions of the state secrecy administrative department, publish the list of organs and units in this Municipality that have the right to determine the classification and can make the authorization of the classification within the relevant scope. Thirteenth organs and units shall abide by the following procedures when determining state secrets, and make a written record, indicating the undertaker, the person in charge of the classification and the basis of the classification:

(a) the undertaker shall, according to the scope of the relevant confidential matters or confidential matters, draw up the classification, duration of confidentiality, scope of knowledge, etc. , standardize and mark the state secrets on the carrier of state secrets and the equipment and products belonging to state secrets, and take security measures in advance;

(two) the person in charge of confidentiality shall review the basis, classification, duration and scope of confidentiality, and sign an opinion.

The alteration or dissolution of state secrets shall be handled in accordance with the above procedures.
