Legal basis: Article 7 of the Organic Law of the Central People's Government stipulates that the Committee of the Central People's Government shall exercise the following functions and powers according to the common program formulated by the plenary session of the China People's Political Consultative Conference:
1. Formulate and interpret national laws, promulgate decrees and supervise their implementation.
Second, stipulate national policies.
Three, repeal or amend the the State Council resolutions and orders that contravene the laws and decrees of the state.
4. Ratify, abrogate or amend treaties and agreements concluded between People's Republic of China (PRC) and foreign countries.
5. Deal with the issues of war and peace.
6. Approve or modify the state budget and final accounts.
Seven, the promulgation of national Amnesty and Amnesty.
Eight, formulate and issue national medals, medals, formulate and award national honorary titles.
Nine, the appointment and removal of the following government staff:
To appoint and remove the Prime Minister, Vice Premiers, Political Councillors, Secretaries-General and Deputy Secretaries-General, chairmen, vice-chairmen and members of committees, ministers and deputy ministers of ministries, presidents and vice-presidents of Academy of Sciences, directors and deputy directors of various departments, and presidents and vice-presidents of banks.
According to the State Council's proposal, appoint, remove or approve the appointment and removal of the chairman, vice-chairman and main administrative personnel of major administrative regions and provincial and municipal people's governments.
To appoint and remove ambassadors, ministers and plenipotentiaries abroad.
To appoint and remove the chairman, vice-chairmen and members of the People's Revolutionary Military Commission, the commander-in-chief and deputy commander-in-chief of the People's Liberation Army, the chief of staff and deputy chief of staff, and the director and deputy director of the General Political Department.
To appoint and remove the President, Vice President and members of the Supreme People's Court, and the Procurator-General, Deputy Procurator-General and members of the Supreme People's Procuratorate.
