Regulations of Guangdong Province on Continuing Education of Professional and Technical Personnel (revised in 2009)
Chapter I General Provisions Article 1 In order to improve the quality of professional and technical personnel, enhance the ability of independent innovation, standardize continuing education activities and protect the rights and interests of professional and technical personnel, these Regulations are formulated in accordance with relevant laws and administrative regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to the continuing education activities of professional and technical personnel within the administrative area of this province and their supervision and management.

The term "professional and technical personnel" as mentioned in these Regulations refers to on-the-job personnel who have obtained professional and technical professional qualifications or professional and technical post qualifications at or above the junior level in accordance with state regulations, as well as professional and technical civil servants.

The continuing education of professional and technical personnel as mentioned in these Regulations (hereinafter referred to as continuing education) refers to the training activities of professional and technical personnel with new theories, new knowledge, new technologies and new methods as the main content and with the purpose of improving knowledge structure, improving innovation ability, professional level and comprehensive quality. Article 3 Continuing education should be guided by scientific theories and follow the principles of teaching according to needs, applying what you have learned, paying attention to actual results and ensuring quality. Article 4 Continuing education shall implement a management system combining comprehensive management with graded and classified responsibility.

The competent department of human resources and social security of the people's government at or above the county level is the comprehensive supervision and management department of continuing education within its jurisdiction, which formulates the overall plan of continuing education, coordinates, guides and supervises continuing education, and is responsible for organizing the implementation of these regulations.

The relevant administrative departments shall be responsible for the organization and management of continuing education in their own systems and industries according to their respective responsibilities.

Industry organizations assist relevant departments to do a good job in continuing education in their own industries. Article 5 People's governments at or above the county level shall incorporate continuing education into their economic and social development plans and take effective measures to ensure the development of continuing education.

The people's governments at or above the county level shall include the funds for continuing education in the fiscal year budget to ensure the needs of continuing education. Article 6 The competent department of human resources and social security and relevant administrative departments shall make use of existing educational resources and rely on training institutions established by institutions of higher learning, scientific research units, social organizations and large and medium-sized enterprises to strengthen the construction of continuing education and teaching institutions. Article 7 The competent department of human resources and social security shall strengthen the guidance, service and support for the continuing education of non-public economic organizations, and guide the establishment of a continuing education model that conforms to the characteristics of non-public economic organizations according to their demand for talents. Chapter II Rights, Obligations and Responsibilities Article 8 Professional and technical personnel have the right and obligation to receive continuing education.

Professional and technical personnel, regardless of nationality, gender, region, occupation, professional title, position, unit nature, etc. , all enjoy equal opportunities to receive continuing education according to law. Ninth professional and technical personnel to receive continuing education time, the annual cumulative should be not less than twelve days or seventy-two hours. Tenth professional and technical personnel shall enjoy the following rights in continuing education:

(a) during the continuing education, in accordance with the provisions of laws and regulations, enjoy the same wages and welfare benefits as employees;

(two) put forward opinions and suggestions on continuing education;

(3) Complaining that their right to receive continuing education has been violated;

(4) Other rights stipulated by laws and regulations. Eleventh professional and technical personnel shall perform the following obligations in continuing education:

(a) to abide by the laws, regulations and rules of continuing education;

(two) obey the unified arrangement of the unit, abide by the study discipline and related systems;

(three) to complete the required continuing education hours;

(four) to accept the examination, inspection and supervision of continuing education;

(five) to bear the continuing education expenses determined through consultation with the unit, which shall be paid by the individual. Twelfth professional and technical personnel unit (hereinafter referred to as the employer) shall perform the following duties:

(a) the implementation of continuing education laws, regulations, rules and policies, in accordance with the continuing education plan, formulate the continuing education plan of the unit and organize its implementation;

(two) to ensure the time for professional and technical personnel to participate in continuing education, to ensure their wages and welfare benefits, and to provide the necessary conditions;

(three) in accordance with the relevant provisions of the independent choice of continuing education teaching institutions (hereinafter referred to as teaching institutions), to determine the training content and methods suitable for the needs of the unit;

(four) registration, assessment of professional and technical personnel to receive continuing education, submit relevant statistical data to the relevant administrative departments;

(five) accept the guidance and supervision of the competent department of human resources and social security and the relevant administrative departments;

(six) from the staff education funds charged to the continuing education funds, the amount is not less than 1.5% of the total wages of professional and technical personnel in this unit. Chapter III Forms and Teaching Institutions Article 13 Continuing education is divided into three categories: public compulsory subjects, professional subjects and individual elective subjects, and professional subjects are the main contents of continuing education.

Public subjects refer to the knowledge of policies, laws and regulations, basic theories, technologies and information that all professional and technical personnel must master. The subject of public demand is determined by the competent department of human resources and social security of the provincial people's government in conjunction with relevant administrative departments and industry organizations, and organized and implemented by the competent department of human resources and social security of the people's government at or above the county level.

Professional subjects refer to the new theories, technologies and information that professional technicians in this industry must master, as well as the knowledge that different types of professional technicians in this industry must possess. Professional subjects are determined by the relevant administrative departments of the provincial people's governments or provincial industry organizations, and then reported to the competent departments of human resources and social security of the provincial people's governments for the record, and implemented by the relevant administrative departments or industry organizations of the people's governments at or above the county level.

Individual elective subjects refer to the theory and technology that professional and technical personnel must have to complete their post tasks, as well as the knowledge needed for personal career development. Individual elective subjects are determined through consultation between professional and technical personnel and employers.
