The remedy for being expelled from school is:
1. In the compulsory education stage, those who are not allowed to be expelled can negotiate with the school first, and those who seriously violate the school rules and regulations can be sent to the reform school for correction. If negotiation fails, you can report to the administrative department of education and bring a lawsuit to the people's court where the school is located when necessary. For students suspected of criminal offences, the school has the right to insure their school status. If you are dissatisfied with the school's decision on handling or punishment, you can submit a written complaint to the school student complaint handling Committee within 10 days from the date of receiving the school's decision on handling or punishment. If you have any objection to the review decision, you can submit a written complaint to the provincial education administrative department where the school is located within 15 days from the date of receiving the school review decision;
2. After the compulsory education stage, being expelled from school, being ordered to drop out of school and being expelled from school is the most severe punishment given to students who have made serious mistakes or violated the criminal law in politics, moral quality and organizational discipline. If expelled, it should be reported to the Education Bureau for the record, and the Academic Affairs Office will make a reasonable choice according to the contents of the report. Those who are expelled can appeal to the school and the education department under the school, or bring a lawsuit to the court. If there is a real fault or violation of school rules and relevant regulations, the appeal is unlikely to succeed.
To sum up, no school can expel any students at will. The education law stipulates that education is the right of minors. Schools and teachers should help students with poor grades and bad conduct, and should not discriminate against them, nor should they be given disciplinary sanctions at will, or even ordered to drop out of school or expel them from school. Schools should persuade, educate and help students who violate discipline. If it is really necessary to give punishment, they should first explain the reasons to minor students and their guardians and listen to their opinions, and make a punishment decision in accordance with the principle of fairness and justice. If they are not satisfied with the punishment given by the school, students or parents can lodge a complaint with the competent education administrative department, and they will handle it.
