National extracurricular tutoring policy
People's governments of all provinces, autonomous regions and municipalities directly under the Central Government, ministries and commissions and institutions directly under the State Council:

The off-campus training institutions for primary and secondary school students (hereinafter referred to as off-campus training institutions) carry out non-academic education and training, which is a supplement to school education and plays an active role in meeting the selective learning needs of primary and secondary school students, cultivating their interests and developing their comprehensive quality. However, in recent years, some off-campus training institutions have carried out "exam-oriented" training in violation of the laws of education and the growth and development of teenagers, which has caused excessive extracurricular burden on primary and secondary school students, increased the family's economic burden, destroyed the good educational ecology, and aroused strong social reaction. In order to effectively reduce the excessive extracurricular burden of primary and secondary school students and promote the standardized and orderly development of off-campus training institutions, with the consent of the State Council, we hereby put forward the following opinions.

I. General requirements

(1) guiding ideology. Guided by Socialism with Chinese characteristics Thought in the new era, we should thoroughly implement the spirit of the 19th National Congress of the Communist Party of China and the Second and Third Plenary Sessions of the 19th Central Committee, fully implement the Party's education policy, adhere to moral education first, develop quality education, focus on promoting the physical and mental health of primary and secondary school students, focus on establishing and improving the supervision mechanism of off-campus training institutions, strive to build a long-term mechanism for the standardized and orderly development of off-campus training institutions, effectively solve the problem of excessive extracurricular burden of primary and secondary school students, and form a good situation of collaborative education inside and outside the school.

(2) Basic principles.

Standardize according to law. In accordance with the law, the off-campus training institutions shall be approved and registered, special treatment shall be carried out, daily supervision shall be strengthened, and the order of off-campus training shall be effectively regulated. Off-campus training institutions carry out training business and related activities according to laws and regulations, and consciously safeguard the legitimate rights and interests of primary and secondary school students and their parents.

Classification management. Encourage training aimed at cultivating primary and secondary school students' hobbies, innovative spirit and practical ability, focus on standardizing the knowledge training of Chinese, mathematics, English, physics, chemistry, biology and other disciplines, and resolutely prohibit the behavior of taking exams, exceeding the standard, leading training and linking with enrollment.

Comprehensive policy. To coordinate school, society and family education, we should not only standardize the training behavior of off-campus training institutions, but also improve primary and secondary education and teaching, improve the quality of school education and the ability of after-school service, strengthen the dominant position of school education, and actively promote parents to change their educational concepts, so as to treat both the symptoms and the root causes and achieve practical results.

Collaborative governance. Strengthen the overall planning of provinces (cities) and implement county-based management responsibilities. Establish and improve the work coordination mechanism, the relevant departments perform their duties, division of labor and cooperation, co-ordinate the examination and approval, registration, supervision and management, form a comprehensive management force, and ensure active and steady progress.

Second, clearly set standards.

(3) Determine the setting standards. The provincial education department shall, in conjunction with relevant departments and in light of local conditions, study and formulate specific standards for the establishment of off-campus training institutions; If there is a big gap between cities in the province, the municipal education department may be authorized to jointly formulate with relevant local departments and report to the provincial education department and relevant departments for the record.

(4) Follow the basic requirements. Local standards must meet the following basic requirements. In terms of site conditions, off-campus training institutions must have fixed sites that meet safety conditions, with an average annual area of not less than 3 square meters during the same training period to ensure that they are not crowded and easy to evacuate; Must meet the requirements of national laws and regulations on fire control, environmental protection, hygiene and food management. By purchasing personal safety insurance for participants and other necessary means, the risk of safety accidents can be prevented and resolved. On the condition of teachers, off-campus training institutions must have a relatively stable teaching staff, and may not employ in-service teachers in primary and secondary schools. Personnel engaged in training must abide by the Constitution and laws, love education, and have good ideological and moral character and corresponding training ability; Teachers engaged in Chinese, mathematics, English, physics, chemistry, biology and other disciplines should have corresponding teacher qualifications. Training institutions shall sign employment contracts, labor contracts or labor service agreements with employees according to law. The employment of foreigners must comply with the relevant provisions of the state. In terms of management conditions, off-campus training institutions must uphold and strengthen the leadership of the party to ensure the correct direction of running schools. There must be standardized articles of association and corresponding management system, and the training purpose, business scope, deliberation and decision-making mechanism, fund management, guarantee conditions, service commitment, etc. must be clearly defined.

Three. Examination and approval of registration according to law

(five) to ensure that the license is complete. Off-campus training institutions must obtain a school license after examination and approval, and obtain a business license (or a certificate of legal person of a public institution or a registration certificate of a private non-enterprise unit, the same below) before they can carry out training. If the school license and business license have been obtained, if they do not meet the set standards, they should be rectified according to the standards. If the rectification is not in place, the school license shall be revoked, the training activities shall be terminated, and the registration shall be changed or cancelled according to law.

(6) Strict registration and approval. The approval and registration of off-campus training institutions shall be subject to localized management. The education department at the county level is responsible for examining and approving the issuance of school licenses. Without the approval of the education department, any off-campus training institution may not carry out training business for primary and secondary school students in the name of tutoring, consulting and cultural communication. If an off-campus training institution establishes a branch or training point in the same county, it must be approved; The establishment of a branch school or training point across counties needs to be approved by the county-level education department where the branch school or training point is located. Primary and secondary schools shall not hold or participate in holding off-campus training institutions.

Fourth, standardize training behavior.

(7) Refine the training arrangement. The contents, shifts, enrollment targets, progress and class hours of off-campus training institutions in Chinese, mathematics, English, physics, chemistry, biology and other disciplines shall be filed with the local county-level education department and announced to the public; The training content shall not exceed the corresponding national curriculum standards, the training frequency must match the grade of enrollment, and the training progress shall not exceed the same level of primary and secondary schools in the county (district). The training time of off-campus training institutions shall not conflict with the teaching time of local primary and secondary schools, and the end time of training shall not be later than 20: 30, and no homework shall be left; It is strictly forbidden to organize and hold subject level examinations, competitions and rankings for primary and secondary school students.

(8) Practice honesty and trustworthiness. Off-campus training institutions should formulate enrollment brochures realistically, make enrollment advertisements, file with the examination and approval authorities and publicize them to the public, and consciously accept supervision. We should conscientiously fulfill our service commitments and put an end to improper use of words in training content. Students shall not be forced to receive training by violence or threats. We should constantly improve education and teaching, improve the quality of training, and strive to improve students' satisfaction.

(nine) standardize the management of fees. Strictly implement the state regulations on financial and asset management, and the charging period should be coordinated with the teaching arrangement, and it is not allowed to charge for more than three months at a time. Local education departments should strengthen cooperation with financial departments, and explore ways to strengthen the supervision of training institutions' funds by establishing special accounts for tuition and miscellaneous fees, strictly controlling the minimum balance of accounts and the flow of large amounts of funds. The charging items and standards of training institutions shall be publicized to the public and subject to the supervision of relevant departments. No other fees shall be charged outside the publicized items and standards, and no fees shall be apportioned to students or compulsory fund-raising shall be conducted in any name. For the unfinished training courses, the refund of fees shall be handled in strict accordance with the contractual agreement of both parties and relevant laws and regulations.

Verb (abbreviation of verb) strengthens supervision and management

(10) Improve daily supervision. All localities should earnestly strengthen the daily supervision of the school-running behavior of off-campus training institutions, insist on who approves who supervises and who is in charge of who supervises, prevent heavy examination and approval from neglecting supervision, improve the supervision responsibility system and working mechanism, and earnestly strengthen the construction of supervision teams. The education department is responsible for investigating and dealing with illegal institutions that have not obtained the school license. On the basis of doing a good job in the examination and approval of the school license, it focuses on supervising the training content, training courses, enrollment targets, teacher qualifications and training behavior, and takes the lead in organizing comprehensive law enforcement in the off-campus training market; Market supervision departments should focus on the supervision of relevant registration, fees, advertising and anti-monopoly; The human resources and social security department focuses on the supervision of vocational training institutions that carry out training for primary and secondary school students without approval; Organizations and civil affairs departments should focus on the supervision of off-campus training institutions in violation of relevant registration management regulations; Public security, emergency management, health and food supervision departments should focus on the safety, hygiene and food conditions of off-campus training institutions; Network information, culture, industry and information technology, radio and television and other departments cooperate with the education department to do a good job in network education supervision within their respective responsibilities.

(eleven) the implementation of annual inspection system. The education department at the county level shall, jointly with the relevant departments, improve the management measures in accordance with the standards for the establishment of off-campus training institutions, the conditions for examination and approval, the requirements for running schools and the relevant provisions on registration management, and seriously organize the annual inspection and annual report publicity. Information such as periodic reports publicly disclosed by overseas listed off-campus training institutions and interim reports that have a significant adverse impact on the company's business activities shall be simultaneously disclosed in Chinese on the company's website (if there is no company website, it shall be on the securities information disclosure platform) and subject to supervision. If it is found that the off-campus training institutions conceal the truth, practise fraud, run schools in violation of regulations, or refuse to accept the annual inspection or submit the annual report, they shall be dealt with severely according to law until the school license is revoked, and the legal responsibilities of the relevant personnel shall be investigated.

(12) Publish the black-and-white list. Fully implement the white list system, publish the list and main information of off-campus training institutions that have passed the examination and registration on the government website, and update them in time according to the daily supervision and annual inspection and annual report publicity. All localities can establish a negative list according to the requirements for the establishment and management of off-campus training institutions. The off-campus training institutions that have been approved for registration but have acts listed in the negative list should be promptly removed from the white list and blacklisted; Off-campus training institutions registered without approval and held in violation of laws and regulations will be severely investigated and blacklisted. Blacklist information will be included in the national credit information sharing platform, and joint punishment will be implemented in accordance with relevant regulations. The administrative licensing information, administrative punishment information, blacklist information and spot check results of for-profit off-campus training institutions are collected into the national enterprise credit information publicity system, recorded in the names of corresponding enterprises and publicized according to law. Credit management shall be carried out in accordance with the relevant provisions on credit information management of social organizations for non-profit off-campus training institutions, and publicity shall be made according to law.

Sixth, improve the educational ability of primary and secondary schools.

(thirteen) to improve the quality of teaching. Effectively strengthen the construction of teachers' morality and style in primary and secondary schools, and encourage teachers to be teachers and devote themselves to teaching and educating people. Primary and secondary schools must strictly follow the curriculum plan, curriculum standards and school teaching plan promulgated by the state, and open every course completely, neatly and well. Local education departments should guide primary and secondary schools, judge and rectify according to the relevant standards of school management, strictly regulate education and teaching behavior, strive to improve the quality of education and teaching, and create conditions for effectively reducing the extracurricular burden of primary and secondary school students. Adhere to the strict administration of education according to law, and resolutely investigate the responsibility of principals and teachers for behaviors such as non-compliance with teaching plans and "non-zero starting point teaching" in primary and secondary schools; The behavior of primary and secondary school teachers "not talking to off-campus training institutions after class", inducing or forcing students to participate in off-campus training institutions, etc. , should be dealt with seriously until the relevant teachers are disqualified.

(14) Strict enrollment discipline. Strict primary and secondary school enrollment discipline, resolutely prohibit joint enrollment of primary and secondary schools and off-campus training institutions, resolutely investigate and deal with the behavior of linking the training results of off-campus training institutions with enrollment of primary and secondary schools, and investigate the responsibilities of relevant schools, off-campus training institutions and related personnel according to law.

(15) Do a good job in after-school service. All localities should create conditions, increase investment, improve policies, strengthen the role of primary and secondary schools as the main channel in after-school services, and generally establish a flexible school leaving system. Primary and secondary schools should fully tap the potential of school teachers and construction conditions, actively use off-campus resources, give full play to the role of parents' committees, and strive to open up various appropriate channels to help students cultivate their interests, develop their specialties, broaden their horizons, strengthen their practice, continuously improve the level of after-school services, and provide free counseling for individual students with learning difficulties. Resolutely prevent after-school services from becoming collective teaching or disguised remedial classes. According to the nature of after-school service, all localities can raise funds by means of financial subsidies, service charges or fees on behalf of others. Relevant departments should give due consideration to the after-school service factors of schools and units when approving the total performance pay; Schools and units shall, within the approved total performance pay, give appropriate concessions to teachers who participate in after-school services. To formulate service charging standards or charging standards on behalf of others, we should adhere to the principles of cost compensation and non-profit, and implement them after being examined and approved by the Provincial Department of Education and the competent pricing department in conjunction with the provincial people's government in accordance with relevant regulations. Whether primary and secondary school students participate in after-school services is voluntary choice by students and parents, and it is strictly forbidden to charge fees in the name of after-school services.

Seven, strengthen organizational leadership

(sixteen) improve the working mechanism. All localities should earnestly improve their ideological understanding and put the development of off-campus training institutions on the important agenda. Establish a joint meeting system led by the education department and participated by relevant departments, formulate a detailed work plan, refine the division of labor, compact responsibilities, and vigorously promote. Sum up experience in time, study new situations and problems, and constantly improve policies and measures. Give full play to the role of relevant industry associations in industry development, standardization and self-discipline. Pay attention to multi-party linkage, develop community functions, strengthen the construction of venues such as children's palace and practice base, meet the individual needs of primary and secondary school students through multiple channels, and form a joint force of school, family and social education.

(seventeen) do a good job in special governance. All localities should carry out special management work of off-campus training institutions, make comprehensive arrangements, carefully establish work ledgers, improve classified management, and rectify existing training institutions one by one. It is necessary to strengthen supervision and guidance, and ensure the effectiveness of special governance through self-examination, cross-examination and special supervision.

(eighteen) to strengthen the accountability assessment. Education supervision departments should strengthen the supervision and evaluation of local governments' standardized development of off-campus training institutions, and the evaluation results will serve as an important reference for the comprehensive evaluation of leading cadres. The establishment of accountability mechanism, the responsibility is not implemented, the measures are not in place, resulting in excessive extracurricular burden of primary and secondary school students, the people's reaction is particularly strong, and the relevant responsible persons should be seriously accountable. Counties (districts) that regulate the management of off-campus training institutions and reduce the extracurricular burden of primary and secondary school students may not declare the assessment of the basic balance and high-quality balanced development of compulsory education; Has passed the appraisal, to issue a special supervision notice, rectification within a time limit.

(nineteen) pay attention to publicity and guidance. All localities should strengthen policy propaganda and interpretation through various channels, so that the spirit of reform and policy essentials are well known and a good social atmosphere is formed. Through parent-teacher conferences, parent-teacher conferences, home visits, special reports and other forms, parents are encouraged to establish a correct concept of education and success, not to blindly compare with others, to understand scientifically, and to effectively reduce students' excessive extracurricular burden. Give publicity to outstanding off-campus training institutions, guide off-campus training institutions to enhance their sense of social responsibility, strengthen self-discipline and establish a good social image.
