Not abolished. If necessary, the government may accept and educate people under the age of 16 who have not been subjected to criminal punishment.

As of February 6, 20 18, the updated Criminal Law of People's Republic of China (PRC) stipulates as follows:

Article 17 A person who has reached the age of 16 shall bear criminal responsibility for committing a crime.

A person who has reached the age of 14 but under the age of 16 commits the crime of intentional homicide, intentional injury, serious injury or death, rape, robbery, drug trafficking, arson, explosion and poisoning, and shall bear criminal responsibility.

If a person who has reached the age of 14 and is under the age of 18 commits a crime, he shall be given a lighter or mitigated punishment.

If a person is not given criminal punishment because he is under the age of sixteen, his parents or guardians shall be ordered to discipline him; When necessary, it can also be taken in for reeducation by the government.

The system of reeducation through detention was established in accordance with Article 17 of the Criminal Law of People's Republic of China (PRC) and Article 38 of the Law of People's Republic of China (PRC) on the Prevention of Juvenile Delinquency, which stipulates that "minors under the age of 16 shall be ordered by their parents or other guardians to be strictly disciplined, and when necessary, they may also be accepted and educated by the government according to law".

Reeducation through labor is an administrative punishment according to the relevant laws of the State Council.
