The family planning commission is not an education management department and has no right to charge fees. If the Education Law stipulates that schools and other educational institutions charge fees from educatees in violation of relevant state regulations, the education administrative department or other relevant administrative departments shall order them to refund the fees collected. The directly responsible person in charge and other directly responsible personnel shall be punished according to law.

According to the provisions of Article 78 of the Compulsory Education Law of People's Republic of China (PRC), if schools and other educational institutions collect fees from the educated in violation of the relevant provisions of the state, the education administrative department or other relevant administrative departments shall order them to return the fees collected. The directly responsible person in charge and other directly responsible personnel shall be punished according to law.
