Regulations of Henan Province on Continuing Education of Professional and Technical Personnel
Article 1 In order to improve the quality of professional and technical personnel and meet the needs of socialist modernization, these Regulations are formulated in accordance with the Education Law of the People's Republic of China and the Law of People's Republic of China (PRC) on the Progress of Science and Technology, combined with the actual situation of this province. Article 2 These Regulations shall apply to on-the-job professional and technical personnel of institutions and enterprises within the administrative region of this province. Article 3 The term "continuing education for professional and technical personnel" as mentioned in these Regulations refers to the education of updating, supplementing, expanding and improving the knowledge of professional and technical personnel. Article 4 Continuing education shall adhere to the principles of integrating theory with practice, combining learning with application, teaching according to needs and paying attention to actual results. Article 5 The content of continuing education should be targeted, practical and advanced, and professional and technical personnel should be encouraged to understand and master new theories, technologies, methods and information related to professional technology, improve the knowledge structure, and improve the professional technical level and innovation ability. Sixth professional and technical personnel to continue education and full-time study time, senior and intermediate professional and technical personnel accumulated not less than sixty-four hours a year, junior professional and technical personnel accumulated not less than fifty-six hours a year.

The implementation period of continuing education is three to five years. The study time in a cycle can be used centrally or dispersed. Article 7 Professional and technical personnel receiving continuing education shall enjoy the following rights:

(a) enjoy the prescribed full-time study time;

(two) continuous full-time employment for half a year and part-time employment within one year to receive continuing education, enjoy the same wages and benefits as employees. Unless otherwise agreed by the units and individuals;

(three) the right to appeal when the rights are infringed. Article 8 Professional and technical personnel receiving continuing education shall perform the following obligations:

(1) Abide by the laws, regulations and rules concerning continuing education;

(two) to obey the continuing education arrangement of the unit and complete the learning task on schedule;

(3) If the employer provides expenses and studies full-time at home and abroad for more than half a year or part-time for more than one year, after receiving continuing education, it shall conclude a written contract with the employer on service matters and perform the obligations stipulated in the contract. Article 9 Institutions and enterprises that implement continuing education shall perform the following duties:

(a) according to the laws, regulations and rules of continuing education, formulate and organize the implementation of the continuing education plan and management measures of the unit;

(two) to ensure the time for professional and technical personnel to participate in continuing education, and to provide necessary learning funds and other conditions in accordance with the provisions;

(three) according to the provisions of the assessment, registration and inspection of professional and technical personnel to receive continuing education;

(four) accept the guidance and supervision of the administrative department of personnel and administrative departments; Tenth enterprises with serious difficulties, according to the actual situation of the unit to determine the corresponding continuing education measures. It is necessary to make full use of the spare time of stopping production, semi-stopping production or changing production, and actively organize professional and technical personnel to study. Eleventh professional and technical personnel to receive continuing education, to participate in the system, the industry, the organization of self-study and assessment. It is necessary to improve the incentive mechanism and encourage professional and technical personnel to study by themselves.

Professional and technical personnel to receive continuing education can also take the following forms:

(a) to participate in advanced courses, seminars and training courses organized by institutions of higher learning, administrative institutions, scientific research institutes, social organizations and other training institutions;

(two) to carry out relevant practical activities in teaching, scientific research and production units;

(3) Attending academic conferences and lectures at home and abroad;

(4) Going abroad for further study and training;

(5) Other appropriate forms. Twelfth provincial personnel administrative department is responsible for the planning, management, coordination and guidance of continuing education in the province; City, county (city, district) personnel administrative department is responsible for continuing education within their respective administrative areas.

Education, science and technology, health and other administrative departments shall, within the scope of their respective functions and powers, cooperate with the personnel administrative department to do a good job in continuing education. Thirteenth social organizations and academic organizations should actively carry out continuing education activities, accommodate information, provide advice, and promote horizontal cooperation and international exchanges and communication. Fourteenth personnel administrative departments at all levels and relevant administrative departments should rely on institutions of higher learning, administrative colleges, research institutes, social organizations and training institutions of large and medium-sized enterprises to establish continuing education bases, and gradually establish and improve the implementation network of continuing education.

The personnel administrative department and the relevant administrative departments shall, in accordance with the management authority, regularly supervise, inspect and evaluate the continuing education and training institutions and bases. Fifteenth continuing education and training institutions, should undertake the corresponding training tasks in accordance with the education plan, and strengthen teaching management, strict requirements, and effectively ensure the quality of teaching. Teachers of continuing education shall, in accordance with the principle of combining full-time and part-time jobs, employ experts with theoretical level and practical experience or professional and technical personnel with senior and intermediate titles. Sixteenth provincial personnel administrative departments shall, according to the development trend of different disciplines, professions and industries and the requirements for the quality of professional and technical personnel, coordinate and guide the relevant administrative departments to formulate the subject guide for continuing education. Seventeenth continuing education funds should be shared by the government, units and individuals, and raised by the following ways:

(a) the people's governments at or above the county level according to the financial situation, the personnel administrative department of continuing education funds included in the fiscal budget at the corresponding level;

(two) institutions and enterprises of continuing education funds from the staff education funds charged, with the improvement of economic benefits, can be appropriately increased. The continuing education expenses for developing new technologies, new products and research projects can be arranged in the management expenses and project funds;

(3) Individuals who study full-time at home and abroad for more than half a year or study part-time for more than one year shall bear the corresponding expenses. Unless otherwise agreed in the contract;

(four) accept donations from all walks of life.

The provincial and municipal people's governments shall support the continuing education in mountainous areas and poverty-stricken areas.
