Some application developers illegally resell personal information or illegally use personal information for other purposes in pursuit of greater interests, which seriously infringes on the rights and interests of users.
Recently, the case of personal information protection dispute between Wang and Shenzhen Tencent Computer System Co., Ltd. was selected as one of the top ten Internet-related cases in Guangdong Province in 20021year. In this case, the "Microvision" App operated by Tencent collected and used Wang's WeChat personal information and all WeChat friends' information without being informed or authorized. After hearing the case, the court decided that Tencent should compensate Wang 65438+100000 yuan.
In the information age, personal information is everywhere. ID number, mobile phone number, bank card number, Alipay account number, WeChat wallet, flower garden ... Many things you think or don't think of actually contain all kinds of personal information. For most people, personal information seems to be "insignificant" in most cases, but once personal information is leaked, telephone harassment, bank card theft or even marriage occurs, the importance of personal information can be imagined. The emergence of these problems is obviously closely related to all kinds of apps we use every day.
According to the relevant provisions of the Law of People's Republic of China (PRC) on the Protection of Personal Information, the collection of personal information for processing purposes should be limited to a minimum range, and personal information should not be excessively collected; If an individual agrees to handle personal information, he shall express his consent voluntarily and clearly on the premise that the individual is fully informed. From the reality, some apps require users to enter their ID numbers, bind their mobile phone numbers or verify their faces during the download and installation process. If these programs are not completed, they cannot be installed and used normally. However, after obtaining the personal information of users, application developers illegally resell personal information or illegally use personal information for other purposes in pursuit of greater interests, which seriously infringes on the rights and interests of users.
Strengthening the protection of personal information must be multi-pronged. First of all, individuals should overcome the psychology of following the trend, adhere to the principle of "not installing unless necessary", and try not to install unnecessary apps for personal entertainment. Secondly, software developers should improve their awareness of the rule of law, improve the scientific nature of software research and development, and obtain and use users' personal information reasonably and legally, especially not to seize citizens' personal information by means of "compulsory authorization". Third, the Ministry of Industry and Information Technology and other relevant departments should strengthen daily supervision, accurately monitor and identify illegal application developers, promptly investigate and deal with clues reported by users, and rectify problems within a time limit. Those who fail to make rectification shall be severely punished according to law. Fourth, law enforcement and judicial departments should carefully choose typical criminal and civil cases involving personal information protection, strengthen publicity and guidance, strengthen the popularization and interpretation of laws, effectively expand the effect of warning education, and protect the safety of personal information.
