Article 1 In order to fully implement the Party's educational policy, consolidate the achievements of popularizing compulsory education, promote the balanced development of compulsory education, improve the quality and level of compulsory education, strengthen and standardize the school roll management in the compulsory education stage, and ensure school-age children and adolescents to complete compulsory education, these measures are formulated in accordance with the Compulsory Education Law of People's Republic of China (PRC) and other relevant laws and regulations, and combined with the actual situation of this province.
Article 2 These Measures shall apply to public and private schools in the stage of full-time compulsory education in this province.
Article 3 The term "school-age children and adolescents" as mentioned in these Measures refers to children and adolescents who should enter school according to law until they complete compulsory education.
Article 4 Under the leadership of the administrative department of education, school principals shall be responsible for organizing the implementation of these Measures.
Chapter II Admission and Registration
Article 5 Primary schools and junior high schools are enrolled in autumn. School-age children and adolescents can enter the school nearby without examination. Freshmen are divided into classes in a balanced way, and schools are not allowed to divide key classes and non-key classes in any name.
Local people's governments at or above the county level shall set up schools (classes) to implement special education according to needs, and implement compulsory education for school-age children and adolescents with visual disability, hearing and language disability and intellectual disability. Special education schools (classes) should have places and facilities to adapt to the learning, rehabilitation and life characteristics of disabled children and adolescents. Ordinary schools should accept disabled school-age children and adolescents who have the ability to receive general education to study in regular classes and provide help for their study and rehabilitation.
Article 6 Freshmen in public schools are admitted.
Rural schools shall, according to the list of school-age children and adolescents within their jurisdiction, issue the Compulsory Education Admission Notice (hereinafter referred to as the Admission Notice) to the legal guardians of school-age children and adolescents at the latest before the start of the new school year 10, and the legal guardians will send the school-age children to the designated schools within the specified time by virtue of the Admission Notice.
The local people's government or the education administrative department entrusted by the local people's government shall calculate the distribution of students according to the household registration and housing conditions of legal guardians and their school-age children, and reasonably delimit the school districts of primary schools and junior high schools. The legal guardians of school-age children and adolescents shall register with the corresponding schools on time. After checking with the administrative department of education, the school will publish the list of school-age children and adolescents in the school district in time, and the school will issue the admission notice to the legal guardian of school-age children and adolescents before the start of the new school year 10 at the latest according to the published list. The legal guardian will send the school-age children to the designated school within the specified time with the admission notice.
Seventh school-age children, adolescents and legal guardians are not in the same place of residence, or the place of residence and permanent residence is inconsistent, the local education administrative department shall make overall arrangements for admission according to the actual situation.
If the children of floating population receive compulsory education in the school where they flow in, the legal guardian shall apply to the administrative department of education in the inflow area, and the administrative department of education in the inflow area shall arrange admission in accordance with the relevant regulations and give them a student status. The education administrative department of the inflow area shall notify the education administrative department of the place where the student's household registration is located for the record before September 20 of the new school year.
Article 8 The enrollment of private schools shall be conducted under the management of the local education administrative department. The list of freshmen shall be reported to the local county-level education administrative department for the record, and the freshmen recruited across administrative regions shall be reported to the county-level education administrative department where the students' household registration is located before September 20 of the new school year for the record.
Article 9 If school-age children and adolescents are unable to attend school on time for some reason, or if they study in other places and request to be transferred back to their domicile, the education administrative department at the domicile shall arrange for them to attend the corresponding schools.
Tenth primary school, junior high school freshmen, the school must register their student status, and before the end of September of the new school year, the student list will be reported to the county education administrative department.
Eleventh freshmen, the school uses the electronic student status management system to establish students' electronic student status files.
Students changed their names in primary schools and junior high schools according to law, and the original names were kept as their previous names.
Chapter III Suspension and Resumption of Classes
Article 12 Those who can't adhere to their normal studies due to their physical condition or other special reasons may apply in writing by themselves and their legal guardians for suspension from school, issue certificates of medical institutions designated by the education administrative departments at or above the county level or other valid certificates, and go through the formalities of suspension from school upon examination by the school and approval by the education administrative departments at the county level. The school shall issue a certificate of suspension and record the suspension in the student status file.
Thirteenth students who go abroad or study abroad should go through the formalities of suspension. I and my legal guardian shall submit a written application for suspension from school, and issue visas, passports and other related materials, which shall be suspended after being audited by the school and filed by the county-level education administrative department.
Fourteenth suspension period is generally one academic year. After the expiration of the suspension period, the student or the legal guardian shall apply to the school for resumption of schooling with the suspension certificate and the health certificate or other valid certificate issued by the medical unit designated by the county-level education administrative department. He can't resume school until the school agrees. Students who drop out of school will be put into suitable classes by the school. If you can't resume school as scheduled after the expiration of the suspension period, you will continue to go through the suspension procedures.
Fifteenth graduation school year is generally not suspended.
The fourth chapter transfer
Article 16 If it is necessary to transfer to a scholar because of the transfer of legal guardian, the change of household registration and home address or other legitimate reasons, the student or his legal guardian shall apply, and the transfer formalities can only be handled after the consent of the transfer to or from the school and the approval of the local education administrative department. The education administrative department of the emigration place will transfer the student's electronic student status file to the education administrative department of the emigration place through the electronic student status management system, and the transfer application and transfer certificate stub will be filed by the original school. The school in the place of immigration arranges students to attend with the transfer certificate of the school in the place of emigration.
Students are not allowed to transfer at will. Transfer should generally be handled at the beginning of the semester, and no grade change is allowed.
Seventeenth fresh graduates generally do not apply for transfer procedures. Students are not allowed to transfer during the suspension period.
Eighteenth inter provincial transfer students should promptly send and receive the "student registration form". If other provinces are transferred to our province, it is necessary to hold a valid certificate of student status management from the administrative department of education at or above the county level, and the administrative department of education at the county level where the receiving school is located shall re-establish students' electronic student status files.
Chapter V Borrowing
Article 19 Borrowing refers to students attending schools where their household registration is not located or designated by the administrative department of education according to relevant regulations. Borrowing may be allowed under the following circumstances:
(1) School-age children of foreigners;
(two) students whose parents have worked abroad for a long time and need the care of their relatives;
(three) students whose parents are engaged in geological exploration, frontier defense or mobile work and need the care of their relatives;
(4) Students whose parents do not work in the student's domicile and need to live with their parents or other legal guardians; Or students whose parents don't work in the student's domicile and need to live with their parents who are not in the student's domicile;
(five) parents are unable to perform their duties or parents divorced, parents are unable to perform their guardianship duties, lose their guardianship ability, and need to be raised and supervised by their relatives;
(6) Disabled students who need the care of others other than legal guardians.
Article 20 Where a student's legal guardian requests to borrow a school, he shall submit a written application to the borrowing school with relevant valid documents and proof that his children attend the school, and the borrowing school shall give approval after examination and approval by the borrowing school and the education administrative department. Borrowing students will submit a copy of the audit certificate of the borrowing school to the school for future reference.
Twenty-first students stay in the original school to study. Students' achievements and performance during the borrowing period are evaluated by the borrowing school and provided to the attending school. The certificate that the borrower has completed compulsory education is issued by the school where the student's household registration is located.
Twenty-second loans should be handled at the beginning of the semester. Borrowing is not allowed to change grades.
Chapter VI Evaluation and Evaluation
Twenty-third establish a multiple assessment and evaluation mechanism for students' grades and physical and mental development. Evaluate students from two aspects: academic performance and comprehensive quality evaluation, and record the results in the student status file. Students' academic performance and comprehensive quality evaluation should be graded.
Twenty-fourth primary schools conduct final examinations, examinations or evaluations every semester, and the subjects of examinations, examinations or evaluations are those prescribed by the national or provincial education administrative departments. Students' semester grades are comprehensively evaluated according to their usual academic achievements, final exams, exams or assessment results.
Junior high schools conduct mid-term and final exams, examinations or evaluations every semester, and the subjects of the exams, examinations or evaluations are the subjects stipulated by the national or provincial education administrative departments. Students' semester grades are comprehensively evaluated according to their usual academic performance, mid-term and final exams, exams or assessment results.
The evaluation of students' comprehensive quality is carried out in accordance with the requirements stipulated by the provincial education administrative department.
Twenty-fifth students' academic performance and comprehensive quality evaluation results are recorded in the students' electronic student status files. The school shall fill in the report on students' comprehensive quality according to the results of students' examination, assessment and evaluation, and report to the legal guardian.
Schools and teachers are not allowed to queue up or publish rankings according to test scores and comprehensive quality evaluation results in any form.
Twenty-sixth students in compulsory education stage are not allowed to repeat the grade.
Pupils and junior high school students, with all-round development in morality, intelligence and physique, have excellent academic performance and can by going up one flight of stairs. Students and their legal guardians can apply for advanced placement with the approval of the school. Skipping classes should be done at the beginning of the school year. Students in the graduating class will not be advanced.
Twenty-seventh primary and junior high school students who have completed their studies and passed the evaluation of academic performance and comprehensive quality shall be issued a certificate of completion of compulsory education (primary school) and a certificate of completion of compulsory education (junior high school).
Twenty-eighth students died and lost their learning ability for some reason, the school reported to the administrative department of education, cancel their enrollment.
Chapter VII Reward and Punishment
Article 29 rewards and punishments are a way to educate students. Priority reward. Rewards and punishments should be carried out on the basis of serious ideological education.
Thirtieth outstanding students in moral, intellectual, physical, aesthetic, labor and other aspects, the education administrative departments at all levels and schools can give praise, recognition and reward, and recorded in the student status file.
Article 31 Students who make mistakes should be given help or criticism and education, and a few students who seriously violate the code of conduct for primary and secondary school students, daily code of conduct and various school rules and regulations can be given warnings, serious warnings and demerits respectively. The school shall set up a student complaint handling committee to review the complaints made by students who refuse to accept the punishment decision. Students and their legal guardians who are dissatisfied with the school's disciplinary decision may lodge a complaint with the local competent education administrative department, which will make a ruling. Those who violate the law and constitute a crime shall be dealt with by the judicial department according to law.
In the compulsory education stage, schools shall not expel or dissuade students.
Thirty-second students during the period of punishment, positive performance, correct mistakes, by the students themselves to submit a written application, approved by the school, can revoke the punishment.
Thirty-third students with serious bad behavior, where conditions permit, can be sent to school according to regulations.
Work-study schools make corrections and receive education. Those who are not qualified for the time being can take corresponding measures to help them complete the nine-year compulsory education.
Article 34 A school shall not revoke the student status of a minor student who has been subjected to criminal compulsory measures. Students who are exempted from punishment, suspended execution, released on parole or sentenced to non-imprisonment by the people's court shall continue to be allowed to stay in school and take effective measures to assist the judicial organs in education aid.
The administrative department of education shall arrange receiving schools for minors who have completed compulsory education after the termination of criminal compulsory measures, reeducation through labor and punishment, and ensure that they have completed compulsory education for a specified number of years.
Chapter VIII Management of electronic student status
Thirty-fifth education administrative departments at all levels and schools should establish archives of electronic student status in compulsory education. Electronic student status archives include student status archives and school basic information archives. Electronic student status archives should be kept permanently.
Thirty-sixth electronic student status archives adopt the electronic student status management system which is required by the national unity. Student registration number is divided into main number and auxiliary number. The main number adopts the student ID number, and the auxiliary number implements unified numbering and management in the whole province. Changes in student status, such as transfer, borrowing, etc., do not change the student's student status number. Electronic student status implements the responsibility system of provincial, city and county (district) education administrative departments at three levels and the responsibility system of each school at different levels. The provincial education administrative department is responsible for formulating the "Regulations on the Administration of Compulsory Education in electronic student status" and establishing the provincial student status data center. The municipal education administrative department is responsible for formulating the detailed rules for the implementation of electronic student status management, and inspecting, guiding and coordinating the management of counties (districts) in electronic student status. County-level education administrative departments specifically implement electronic student status management in the compulsory education stage. Central schools and junior high schools actively cooperate to do a good job in the management of compulsory education in electronic student status.
Thirty-seventh freshmen should register in electronic student status after obtaining the official student status, and the relevant information of the students should be officially transferred to the electronic student status database. The school is responsible for entering the student status information. School administrators should check the data, report the student information and school information together, and upload them to the county-level education administrative department.
Thirty-eighth student information approved by the county education administrative department, the school shall not be arbitrarily modified. When a school needs to change its student status, it must be approved by the county-level education administrative department through the electronic student status management system and synchronized with the server data of the county-level education administrative department.
Thirty-ninth education administrative departments and school administrators are responsible for the daily maintenance and data backup of electronic student status management system, and do a good job in keeping school information confidential according to relevant laws and regulations.
Article 40 County-level education administrative departments and schools should strengthen the management and training of data entry and maintenance personnel, conduct an annual review of school enrollment every academic year, strengthen the process supervision and management of school enrollment, and ensure the timely, accurate, complete and safe data.
Forty-first education administrative departments at the county level shall designate specialized technical personnel to do a good job in the hardware and network maintenance of the student status server, as well as technical support and training for the management of electronic student status in schools within their jurisdiction.
Forty-second schools should be equipped with special computers for electronic student status management system, and education administrative departments at all levels should be equipped with special servers and set IP addresses of external networks.
Chapter IX Supplementary Provisions
Article 43 These Measures shall come into force as of the date of promulgation. The previous Regulations on the Management of Students' Status in Compulsory Education ceased to be implemented.
Forty-fourth city and county (District) education administrative departments may, according to these measures, combined with the actual situation, formulate detailed rules for implementation, and report to the Provincial Department of Education for the record.
The student status management of special education schools in the compulsory education stage shall be implemented with reference to the Measures.
