The administrative departments of finance, planning, land, price, civil affairs, sports, auditing, public security, taxation, etc. shall do a good job in the management of private education within their respective functions and duties. Chapter II Establishment, Change and Termination Article 5 The establishment of private schools shall be subject to classified management and graded examination and approval in accordance with the following provisions:
(a) ordinary technical secondary schools (except health and normal classes) shall be examined and approved by the Municipal People's government and submitted to the provincial education administrative department for the record;
(II) Secondary vocational schools, elementary vocational schools, ordinary senior high schools, online schools that conduct distance education through the Internet, and self-study exam auxiliary training schools shall be examined and approved by the municipal education administrative department and submitted to the provincial education administrative department for the record;
(three) ordinary junior high schools, primary schools, all kinds of technical secondary schools and non-academic education and training institutions below technical secondary schools shall be examined and approved by the county (district) education administrative department.
Involving multiple school levels, it shall be handled in accordance with the examination and approval authority and procedures of the highest school level.
Schools applying for hosting sports, art and other majors shall, in accordance with the relevant provisions of the state, be submitted to the education administrative department for examination and approval after being examined and approved by the competent business department at the same level.
Private schools with vocational skills-based vocational qualification training and vocational skills training shall be reported to the municipal and county human resources and social security administrative departments for examination and approval, and reported to the superior human resources and social security administrative departments and the education administrative departments at the same level for the record. Article 6 The municipal administrative department of education, the administrative department of human resources and social security shall formulate and publish the standards for the establishment of various private schools in this Municipality with reference to the standards for the establishment of various public schools, and the examination and approval authorities shall conduct examination and approval according to the standards within the prescribed time limit. Article 7 Those who meet the requirements for running a school and meet the set standards may directly apply for the formal establishment of a private school, and the sponsor shall submit the following materials to the examination and approval authority:
(a) the bid report, which mainly includes: the basic information of the sponsor, training objectives, school scale, school level, school form, school conditions, internal management system, fund raising and management, etc. ;
(two) the source of assets, the amount of funds and valid documents, and indicate the property rights; Among them, the donation agreement must be submitted to donate school property, indicating the name of the donor, the amount, purpose, management method and relevant valid documents of the donated assets;
(3) The articles of association of the school and the list of members of the first school council, board of directors or other decision-making bodies;
(4) Qualification certificates of principals, teachers and accountants. Article 8 The examination and approval authority shall make a decision on administrative license within 60 days from the date of accepting the application and serve it on the applicant. The examination and approval authority shall issue a school license to a formally established private school; If it is not approved, it shall explain the reasons in writing.
After obtaining a school license, a private school shall register as a legal person with the registration authority according to law. The registration authority shall, in accordance with the relevant provisions, deal with it in a timely manner and make an announcement. Article 9 The sponsor shall fulfill the obligation of capital contribution in accordance with the bid report or the articles of association of the school.
Sponsors may contribute capital in cash, in kind, land use rights, intellectual property rights or other assets. Capital contribution in non-monetary assets shall be appraised by an asset appraisal institution; In the form of intellectual property rights or other intangible assets, the proportion shall not exceed 30% of the total capital contribution. Article 10 Where two or more social organizations or individuals run private schools, they shall sign a joint school-running agreement, specifying the mode of capital contribution, proportion, rights and obligations. Article 11 The assets invested by the sponsor in the school shall be separated from other assets of the sponsor, and the capital verification and transfer procedures shall be handled within 3 months from the date of approval of the establishment. Twelfth private schools to change the sponsor, proposed by the sponsor, and financial liquidation according to law. With the consent of the board of directors, the Council or other decision-making bodies of private schools (hereinafter referred to as the decision-making bodies of private schools), it shall be reported to the examination and approval authority for approval.
Changes in the name, level and category of private schools shall be approved by the decision-making body of private schools and reported to the examination and approval authority for approval. Thirteenth private schools, after the financial liquidation according to law, the decision-making body of private schools shall report to the examination and approval authority for approval. Article 14 When a private school terminates, it shall carry out financial liquidation according to law, and the examination and approval authority shall assist the sponsor in properly arranging the students. When a private school that implements compulsory education terminates, the education administrative department shall arrange for students to continue their education.
