Regulations on Planning and Construction of Urban Primary and Secondary Kindergartens in Hohhot (202 1 Revision)
Article 1 These Regulations are formulated in accordance with the Education Law of the People's Republic of China, the Urban and Rural Planning Law of People's Republic of China (PRC) and other relevant laws and regulations in order to ensure that the planning and construction of urban primary and secondary schools and kindergartens are compatible with urban development and promote the development of education. Article 2 The primary and secondary schools and kindergartens mentioned in these Regulations include full-time primary schools, junior high schools, ordinary high schools, secondary vocational schools, special education schools and kindergartens organized by people's governments at all levels and social forces according to law. Article 3 These Regulations shall apply to the planning and construction of primary and secondary schools and kindergartens within the urban planning area of this Municipality. Article 4 The people's governments at the municipal and district levels shall, in accordance with the division of responsibilities, incorporate the planning and construction of primary and secondary schools and kindergartens into the national economic and social development plan and the urban construction and development plan, and be responsible for organizing the implementation of these Regulations.

Education, planning, development and reform, land, finance, construction, real estate and land purchasing and storage and other relevant administrative departments and units shall, within the scope of their respective duties, jointly do a good job in the planning and construction of primary and secondary schools and kindergartens. Article 5 The planning and construction of urban primary and secondary schools and kindergartens shall be in line with urban development and population growth, and adhere to the principles of unified planning, priority arrangement, rational layout, convenience and safety, and supporting construction. Sixth city planning administrative departments in conjunction with the administrative departments of education, land and development and reform, the preparation of the city's primary and secondary schools, kindergartens layout planning, after the approval of the Municipal People's government announced the implementation. The district people's governments shall, according to the layout planning of primary and secondary schools and kindergartens in this Municipality, prepare the layout planning of primary and secondary schools and kindergartens in this district, and determine the location and boundary of construction land for primary and secondary schools and kindergartens.

Due to urban development and population changes, it is really necessary to adjust or change the layout planning of urban primary and secondary schools and kindergartens, which shall be proposed by the District People's Government and approved by the municipal education planning administrative department. Seventh planning administrative departments in the preparation and approval of new district development, residential planning, urban renewal planning, should be in accordance with the layout planning of primary and secondary schools, kindergartens, primary and secondary schools, kindergartens construction land reserved. Article 8 The land for primary and secondary schools and kindergartens in urban planning shall meet the following standards:

Classes in primary and secondary schools and kindergartens shall meet the standards set by the state. Ninth primary and secondary schools, kindergartens, per capita land standards, shall meet the following requirements:

(a) the development and construction of primary and secondary schools and kindergartens in the new area, the average land for middle school students is not less than 20 square meters, the average land for primary school students is not less than 15 square meters, and the average land for kindergarten students is not less than 13 square meters;

(2) The average land for middle school students, primary school students and kindergarten students in the old city is not less than 15 square meters, and the average land for kindergarten students is not less than 12 square meters;

(3) Vocational secondary schools and boarding schools should appropriately raise the standard of land use per student according to needs. Tenth existing primary and secondary schools, kindergartens, land area does not meet the standards stipulated in these regulations, in urban construction and transformation, planning administrative departments should be based on the needs of primary and secondary schools, kindergartens to co-ordinate the reserved school land. Eleventh primary and secondary schools and kindergartens organized by the government, the construction funds raised by the municipal and district people's governments and included in the financial budget.

The Municipal People's Government shall, from the income from the collection of supporting fees for urban construction and the transfer of land use rights, respectively extract 20% from the actually available funds as special funds for the construction of primary and secondary schools and kindergartens, incorporate them into the fiscal budget, store them in special accounts, and fully use them for the construction of primary and secondary schools and kindergartens, and shall not use them for other purposes.

Governments at all levels should take measures to encourage social forces to run schools or donate money to build schools, and give preferential policies in accordance with relevant state regulations. Twelfth new construction and expansion of primary and secondary schools and kindergartens, the municipal and district people's governments shall be implemented in accordance with the relevant provisions of the state public welfare land. Article 13 For the development of new urban areas and the transformation of old urban areas, the municipal and district people's governments shall build primary and secondary schools and kindergartens in accordance with the layout planning of primary and secondary schools and kindergartens in this Municipality and the design norms and construction standards stipulated by the state. Fourteenth primary and secondary schools and kindergartens built according to the plan during the development of new urban areas should be planned, requisitioned, designed and delivered at the same time as the development and construction projects. Article 15 With the approval of the Municipal People's Government, if it is really necessary to demolish or occupy the campus buildings of primary and secondary schools and kindergartens due to urban construction and transformation, it shall be rebuilt or rebuilt in the nearby area in accordance with the layout planning of primary and secondary schools and kindergartens and the principle of first building before demolition, but it shall not affect or interrupt the normal teaching work; The income from the disposal of primary and secondary schools and kindergartens that need to be revoked due to the adjustment of layout planning shall be fully included in the construction funds of primary and secondary schools and kindergartens. Sixteenth primary and secondary schools and kindergartens shall properly manage and maintain the campus buildings they use, and shall not use the land for education and teaching for other purposes.

In the existing primary and secondary schools and kindergartens, buildings, structures and other facilities unrelated to education and teaching shall not be built; Shall not engage in real estate development activities within the scope of educational land by joint construction or other means; Shall not occupy the educational land for the construction of staff dormitory.
