The Constitution of People's Republic of China (PRC) establishes that governing the country according to law is the general plan of our country, which marks the great transformation and development of our party's leadership and governance. The 16th National Congress of the Communist Party of China regards developing socialist democratic politics and building socialist political civilization as one of the important goals of building a well-off society in an all-round way, and clearly puts forward "strengthening the supervision of law enforcement activities and promoting administration according to law". In 2006, the State Council promulgated the "Implementation Outline for Comprehensively Promoting Administration according to Law", which put forward specific requirements for administrative organs to administer according to law. Education is related to thousands of families and the interests of the people. As a part of the municipal government, the Municipal Education Bureau shoulders the important mission of implementing the Party's educational policy and cultivating successors to the socialist cause. The level of education administration according to law is directly related to the image of the party and the government, the healthy development of education, the vitality of independent development of schools and the satisfaction of the people. To this end, all comrades in the bureau must fully understand the importance and urgency of accelerating the administration of education according to law from the perspective of implementing the Party's fundamental purpose and practicing Theory of Three Represents, enhance the sense of responsibility and mission of administration according to law, take Scientific Outlook on Development as the guide, consciously and scientifically administer according to law, and continuously deepen administration according to law.
Second, improve the mechanism of administration according to law and comprehensively promote administration according to law.
1. Improve the local education laws and regulations system and create a good legal environment for education reform and development.
Education legislation is the basis and premise of promoting administration according to law. Each department should, according to the needs of building a modern national education system and a lifelong education system in an all-round way, put forward suggestions on education legislation in view of the new situations, new problems, hot and difficult problems in the development of education reform, and the policies and regulations department will submit them to the Municipal People's Congress and the municipal government for deliberation, so as to further improve the local education laws and regulations system in our city. To further improve the quality of legislation, we should listen to the opinions of relevant organs, organizations, citizens, experts and front-line educators through forums, expert argumentation meetings, hearings, written comments and online comments on the basis of full investigation and study, so as to make China's education legislation more scientific, local and operable.
Establish a system of regular cleaning of documents. According to the national laws, regulations and policies, according to the principle of "who formulates and cleans up", regularly clean up the local laws, government regulations and normative documents related to education in our city, and maintain the unity of the legal system in our city.
Further standardize the formulation of normative documents of the bureau. Normative documents refer to generally binding provisions, measures, rules, implementation details, notices and other documents formulated in accordance with legal authority and procedures, involving the rights and obligations of administrative counterparts (schools, organizations, citizens, teachers and students). Bureau of normative documents shall not set administrative licensing, administrative punishment, administrative enforcement, administrative fees and other matters; Specific provisions made for the implementation of laws, regulations and rules shall not impose additional obligations on citizens, legal persons or other organizations, and shall not restrict the rights of citizens, legal persons or other organizations. Normative documents formulated by various offices shall be reviewed by the Policy and Regulation Department of the Bureau. Officially published normative documents, policies and regulations department shall promptly report to the Legislative Affairs Office of the municipal government for the record.
2. Establish and improve a scientific and democratic decision-making mechanism.
Bureau office meeting system. Major issues concerning the overall situation must be considered by the bureau's office meeting, and scientific decisions must be made on the basis of full argumentation.
Investigation and research system. Every month is the investigation month of our bureau. In view of the reality of educational reform and development and the hot and difficult problems of education, extensive investigation and research are carried out to improve the quality of investigation and provide decision-making basis for faster and better development of education.
The contact point system of administrative law enforcement. The leaders of the bureau and the heads of relevant functional departments respectively contacted the education administrative department of a district (county) to understand the education administrative law enforcement situation of each contact point.
Decision-making consultation system for major issues. The introduction of major policies on enrollment and fees should be carried out in accordance with the requirements of relevant documents at higher levels, listen to opinions from all sectors of society through forums or hearings, strengthen coordination and research with relevant departments, and put forward implementation plans, which can only be implemented after being approved by higher levels.
3, the full implementation of the administrative law enforcement responsibility system
In accordance with the principle of "administration according to law, reasonable administration, due process, high efficiency and convenience, honesty and trustworthiness, and unity of powers and responsibilities", we will speed up the establishment of an administrative law enforcement responsibility system with clear powers and responsibilities, standardized behavior, effective supervision and strong guarantee.
Clarify the administrative law enforcement responsibility. According to the statutory authorization, decompose the administrative law enforcement responsibility of each law enforcement post of the Education Bureau, and clarify the responsibilities, authority, scope, objectives and legal responsibilities of each law enforcement post.
Strengthen the inspection of administrative law enforcement. In view of the hot and difficult issues concerned by the masses, we should conscientiously carry out administrative law enforcement inspections, promptly investigate and correct illegal acts in school-running activities, improve the guidance and supervision of school-running activities of private schools, ensure the implementation of the national education policy, and safeguard the legitimate rights and interests of educatees, teachers, principals and organizers according to law.
Strict administrative law enforcement procedures. Educational administrative law enforcement personnel must show their law enforcement style when performing their law enforcement duties. The implementation of administrative punishment shall be in strict accordance with the requirements of summary procedure, general procedure and hearing procedure, and the parties concerned shall be punished according to law.
Establish and improve the evaluation system of administrative law enforcement files. The files related to administrative punishment, administrative license and other administrative law enforcement shall be filed, and the records of supervision and inspection, evidential materials and law enforcement documents of citizens, legal persons and other organizations shall be filed in accordance with the requirements of administrative law enforcement files.
Establish the guarantee mechanism of administrative law enforcement system. Formulate the detailed rules for the implementation of the responsibility system for administrative law enforcement of the Municipal Education Bureau, the accountability system for administrative law enforcement of the Municipal Education Bureau, and the evaluation system for administrative law enforcement of the Municipal Education Bureau to ensure the implementation of the responsibility system for administrative law enforcement of education.
4. Handle administrative reconsideration and administrative litigation according to law.
Conscientiously implement the Administrative Reconsideration Law and strengthen the work of administrative reconsideration. An application for administrative reconsideration that meets the statutory requirements must be accepted according to law. In the trial of administrative reconsideration cases, there must be more than two case-handling personnel with administrative reconsideration qualifications, strictly fulfill the requirements of reconsideration procedures, pay attention to the basis, evidence and procedures, and make an administrative reconsideration decision fairly. Resolutely correct illegal and obviously improper administrative acts and protect the legitimate rights and interests of citizens, legal persons and other organizations. Implement the accountability system for administrative reconsideration.
Conscientiously implement the "Administrative Procedure Law" and actively appear in court to defend and defend administrative cases accepted by the people's courts. The effective administrative judgments and rulings made by the people's courts according to law shall be consciously fulfilled by our bureau.
5. Increase the openness of government affairs.
According to the "Opinions of the Education Working Committee of the CPC Municipal Committee and the Municipal Education Bureau on Further Strengthening the Openness of Government Affairs", we will further increase the openness of government affairs. Except for matters involving state secrets, commercial secrets and personal privacy that are protected according to law, all matters that are closely related to the vital interests of the people and can be made public should be made public. Our bureau mainly publicizes government affairs information through the following channels: (1) Establish a spokesman system for the bureau, hold regular press conferences, and publicize policies that the masses care about; (2) Strengthen information management, educate news media in a unified way, and strengthen communication and exchange with news media; (3) Give full play to the advantages of the Internet, improve the construction of the "Education Information Network", and set up a column of "Government Publicity" on the "Education Information Network" to keep abreast of government affairs trends, policies, normative documents, service guides, etc. For the convenience of the masses; (4) Do a good job in the "Education" government propaganda album, and compile education laws, regulations and policy documents regularly; (five) hold regular briefings on education, inform the deputies to the National People's Congress, CPPCC members and veteran cadres about education, and consciously accept supervision.
6. Improve administration.
Conscientiously implement the "People's Republic of China (PRC) Administrative Licensing Law", standardize administrative licensing behavior, and reform administrative management methods. For the administrative licensing items reserved according to law, the administrative licensing items shall be legal, procedural and standardized. According to the spirit of "People's Republic of China (PRC) Administrative Licensing Law", further improve the administrative licensing procedures, and make the contents, offices, basis, conditions, procedures and time limit six public. For internal management matters that do not belong to administrative license and must be strengthened in administrative management, we should do a good job in strict accordance with the law and regulations and procedures in accordance with the requirements of the Notice of the Municipal Education Bureau on Publishing Administrative License Matters and Internal Management Matters.
Three, strengthen the leadership of administrative education according to law.
Strengthen the leadership and supervision of administration according to law. The leading group for the work of administering education according to law of the Municipal Education Bureau shall regularly study the work of administering education according to law, formulate the work plan of administering education according to law, and timely solve the difficulties and problems existing in the work. The person in charge of each office should conscientiously do a good job in administration according to law, incorporate administration according to law into the annual work target, strive to change work functions and work methods, and fully implement various tasks of administration according to law. The implementation of administrative accountability system, the administration according to law, causing adverse effects and heavy losses to the work of the Municipal Education Bureau, should be investigated for administrative responsibility according to law.
Firmly establish the concept of administration according to law. Administration according to law involves all aspects of education management and is an important task related to education reform and development. From the height of "building the party for the public and governing for the people", all departments of the overall organs should truly regard administration according to law as the basic criterion of our bureau's work, combine the promotion of administration according to law with the promotion of our bureau's transformation of functions, improvement of work style and strengthening the building of its ruling ability, and strictly administer according to law.
Constantly improve the ability of administration according to law. It is necessary to adhere to the learning center group of the Party Committee of the Bureau and the system of studying law for civil servants, adopt the method of combining self-study with centralized training and focusing on self-study, strengthen the study of legal knowledge, and continuously improve the legal quality of leading cadres and civil servants. The learning center group of the Party Committee of the Bureau concentrates on learning the law not less than 2 times a year, and the study and training of civil servants is not less than 40 hours a year; Administrative law enforcement personnel should consciously strengthen the study of legal knowledge, especially laws and regulations closely related to their own work, constantly improve the level and ability of administrative law enforcement, and enhance their ability to control and solve new situations and problems.
