1 article 1: these rules are formulated in accordance with the education law, the teachers' law, the law on the protection of minors, the law on the prevention of juvenile delinquency and other laws and regulations and the relevant provisions of the state, in order to implement the fundamental task of moral education, ensure and standardize schools and teachers to perform their education, teaching and management duties according to law, protect the legitimate rights and interests of students, and promote the healthy growth and all-round development of students.
2. Article 2. These Rules shall apply to ordinary primary and secondary schools, secondary vocational schools (hereinafter referred to as schools) and their teachers who punish students in the process of education, teaching and management.
3. Article 3 Schools and teachers should follow the laws of education, perform their duties according to law, correct students' wrong words and deeds in time through active discipline and educational punishment, and cultivate students' awareness of rules and responsibilities.
4. Article 4: The implementation of educational punishment shall conform to the educational laws and pay attention to the educational effect; Follow the principle of rule of law, be objective and fair; Choose appropriate measures according to the degree of students' mistakes.
5. Article 5 Schools shall formulate and improve school rules and regulations according to the characteristics of students, clarify students' behavior norms, and improve the specific circumstances and rules for implementing educational punishment.
6. Article 6. Schools should publicize and explain school rules and regulations to students and parents by means of entrance education, class meetings and other appropriate means. Unpublished school rules and regulations shall not be implemented.
7. Article 7. In any of the following circumstances, schools and their teachers should stop students and criticize and educate them. If necessary, educational sanctions may be given: (1) deliberately failing to complete the requirements of teaching tasks or disobeying educational management; (2) disturbing the classroom order and the school education and teaching order.
8.(3) Smoking, drinking or misbehaving violate the student code; (four) the implementation of dangerous behavior harmful to their own or others' physical and mental health; (5) Beating and scolding classmates and teachers, bullying classmates or infringing upon the legitimate rights and interests of others; (six) other acts in violation of school rules and regulations.
Article 8. In classroom teaching and daily management, teachers can impose the following educational penalties on students who slightly violate rules and regulations: (1) naming and criticizing; (two) ordered to apologize, make an oral or written review; (3) Appropriate additional teaching or class public welfare tasks.
10, (4) standing in the classroom during the first class; (5) after-school teaching; (6) Other appropriate measures stipulated by school rules and regulations or class rules.
1 1, Article 9. If a student violates the rules and regulations of the school, if the circumstances are serious or refuses to correct after on-site education and punishment, the school may give the following education and punishment, and shall inform the parents in time: (1) The person in charge of moral education in the school shall admonish him; (two) to undertake the public service tasks of the school.
12, (3) arrange to receive special education on school rules and regulations and code of conduct; (four) to suspend or restrict students from participating in off-campus collective activities such as sightseeing and off-campus collective activities; (five) other appropriate measures stipulated by the school rules and regulations.
13, Article 10: If students in primary schools, junior high schools and senior high schools seriously violate discipline or have a bad influence, the school can give the following education and punishment, and should inform parents in advance: (1) suspension of classes shall not exceed one week, and parents are required to educate and discipline at home; (two) by the vice president of the rule of law or the rule of law counselor to be admonished.
14, (3) arrange special courses or educational places for social workers or other professionals to provide psychological counseling and behavioral intervention. For students who seriously violate the rules and regulations, or fail to correct after repeated education and punishment, the school may give a warning, a serious warning, a demerit or stay in school for probation. For high school students, they can also be expelled from school.
15. For students with serious bad behavior, the school can cooperate with parents and relevant departments to transfer them to special schools for education and correction according to legal procedures.
