Measures for the establishment and management of independent colleges
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Higher Education Law, the Private Education Promotion Law and the Implementation Regulations of the Private Education Promotion Law for the purpose of regulating the activities of independent colleges organized by ordinary colleges and universities in cooperation with social organizations or individuals, safeguarding the legitimate rights and interests of educatees and independent colleges, and promoting the healthy development of higher education. Article 2 The term "independent college" as mentioned in these Measures refers to an institution of higher learning that cooperates with social organizations or individuals other than state institutions and uses non-state financial funds to implement undergraduate education. Article 3 Independent colleges are an important part of private higher education and belong to public welfare undertakings.

The establishment of independent colleges should conform to the national and local higher education development plans. Article 4 Independent colleges and their sponsors shall abide by laws, regulations, rules and relevant provisions of the state, implement the national education policy, and adhere to the socialist direction of running schools and the principle of educational public welfare. Article 5 The State protects the legitimate rights and interests of independent colleges and their sponsors.

Independent colleges are entitled to various awards and support policies stipulated in the Law on the Promotion of Private Education and the Regulations on the Implementation of the Law on the Promotion of Private Education. Article 6 The education administrative department of the State Council shall be responsible for the overall planning, comprehensive coordination and macro management of independent colleges across the country.

The education administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the provincial education administrative departments) shall be in charge of the work of independent colleges within their respective administrative areas and perform the following duties according to law:

(a) the management of independent college license;

(two) independent college enrollment brochures and advertising review;

(3) Publishing information about independent colleges;

(four) the annual inspection of independent colleges;

(five) the recognition and reward of independent colleges;

(six) to investigate the illegal acts of independent colleges;

(seven) other duties as prescribed by laws and regulations. Chapter II Establishment Article 7 Ordinary institutions of higher learning participating in the establishment of independent colleges must have a high level of teaching management and good conditions for running schools, and generally should have the right to confer doctoral degrees. Article 8 Social organizations participating in the establishment of independent colleges shall have the qualifications of legal persons. The registered capital is not less than 50 million yuan, the total assets are not less than 300 million yuan, the net assets are not less than 65.438+0.2 billion yuan, and the asset-liability ratio is less than 60%.

Individuals who participate in the establishment of independent colleges should have political rights and full capacity for civil conduct. Personal total assets are not less than 300 million yuan, of which monetary funds are not less than 654.38+0.2 billion yuan. Article 9 The establishment standards of independent colleges shall be implemented with reference to the establishment standards of ordinary undergraduate colleges.

Independent colleges should have legal personality. Article 10 Ordinary institutions of higher learning shall sign a cooperative education agreement when participating in the establishment of independent colleges, social organizations or individuals.

A cooperative education agreement shall include the purpose of running a school, the training objectives, the amount and method of capital contribution, the rights and obligations of all parties, the term of cooperation, the way of dispute settlement, etc. Eleventh ordinary colleges and universities mainly use the school name, intellectual property rights, management resources, education and teaching resources to participate in running schools. Social organizations or individuals mainly participate in running schools with funds, objects and land use rights.

State grants, tuition fees charged to students, loans from independent colleges, and donated property accepted are not the contributions of the organizers of independent colleges. Article 12 The capital contribution of the sponsor of an independent college shall be verified according to law and transferred to the name of the independent college during the preparation period.

If the assets are not transferred to the name of an independent college before the implementation of these Measures, the transfer shall be completed within 1 year from the date of implementation of these Measures. Article 13 Intangible assets used for running colleges and universities shall be evaluated according to law. The evaluation of intangible assets shall be entrusted to an evaluation institution with the qualification of asset evaluation; The proportion of intangible assets to the total investment in running a school shall be agreed upon by both parties to the cooperative school according to the relevant provisions of national laws and administrative regulations, and relevant procedures shall be handled according to law. Article 14 The sponsors of independent colleges shall fulfill their capital contribution obligations on time and in full according to law. During the existence of an independent college, the sponsor shall not withdraw or misappropriate the running funds. Fifteenth eligible universities can only participate in the establishment of 1 independent colleges. Article 16 The establishment of an independent college is divided into two stages: preparation and formal establishment. Preparation period 1 to 3 years, and enrollment is not allowed during the preparation period. If the establishment fails to apply for formal establishment at the expiration of the establishment period, the establishment will naturally terminate. Seventeenth ordinary colleges and universities involved in the establishment of independent colleges shall apply to the provincial education administrative department where the independent college is to be established, and report to the education administrative department of the State Council for examination and approval in accordance with the procedures for the establishment of ordinary undergraduate colleges and universities. Article 18 To apply for the establishment of an independent college, the following materials shall be submitted:

(1) Application for establishment. The contents include: the sponsor, the name of the independent college to be established, the training objectives, the scale of running a school, the conditions for running a school, the internal management system, and the fund raising and management.

(2) Cooperation in running schools.

(3) Basic conditions for running a school, specialty setting, discipline construction, students, full-time teachers and administrators, evaluation of undergraduate teaching level and doctoral degree setting of ordinary colleges and universities.

(four) the legal person registration certificate or personal identity certificate of the social organization or individual.

(five) the source of assets, the amount of funds and valid documents, and indicate the property rights. Including not less than 500 mu of state-owned land use certificate or state-owned land construction land planning permit.

(six) the examination and approval opinions of the competent departments of ordinary colleges and universities.
