Legal analysis: 1. Party member's punishment procedure: ① party member's punishment must be discussed and decided by the branch meeting. (2) Report to the Party's grass-roots committee for approval. 2. Disciplinary procedure for party member under special circumstances: party constitution stipulates: "Under special circumstances, the party committees and disciplinary inspection committees at or above the county level have the right to directly decide to give disciplinary action to party member." Disciplinary inspection organs at or above the county level shall directly make disciplinary decisions on cases, and must solicit the opinions of the party organizations of the units where the punished persons work, and report them to the Standing Committee of the Disciplinary Committee at the same level for discussion. The case trial department will draft the punishment decision and notice, and report it to the leaders of the discipline inspection commission at the same level for issuance. 3. Procedures for handing over the disciplinary decision to the party branch where party member made the mistake: ① The case inspection organ (the higher-level party organization or the Commission for Discipline Inspection) sends the case investigation report, party member's written opinions and review materials on the wrong facts, and the case inspection team's explanation materials on party member's written opinions on the wrong facts to the party branch where party member made the mistake. The Party branch shall make a decision within one month, and submit it for approval according to the examination and approval authority of disposing party member. (2) Talk with party member who violates discipline, help educate him, and listen to his explanation and defense of wrong facts. (3) Convene a branch committee to discuss the punishment opinions of party member who made mistakes according to the materials provided by the case inspection organ, the provisions of the Party discipline and the punishment suggestions of the case inspection organ, and draw up a good punishment decision. (4) Hold a branch meeting and make a disciplinary decision on the basis of full discussion. When a branch meeting is held to punish party member, all party member, including party member who made a mistake, should be informed. Party member violated discipline, so he should check his mistakes at the party branch meeting, and at the same time, he has the right to explain and defend his mistakes. Other party member attending the branch meeting should criticize and educate party member for violating discipline, express their attitudes and opinions on the handling opinions put forward by the branch committee, and defend party member for violating discipline. The decision on punishment must be passed by more than half of party member who has the right to vote at the meeting. Party member, who made mistakes, also has the right to vote. ⑤ The branch committee will sign the disciplinary decision discussed and approved by the branch general meeting to the punished party member, and then report it step by step according to the examination and approval authority. The attached materials submitted for examination and approval shall include: investigation report on wrong facts, supporting materials, materials reviewed by myself, disciplinary decisions adopted by the branch meeting, my disciplinary opinions and other relevant materials. The organ that executes the punishment decision or the unit to which party member belongs shall report the implementation of the punishment decision to the organ that made or approved the punishment decision within six months. If the disciplinary decision and other relevant handling procedures are not implemented as required, the main responsible person and other directly responsible personnel shall be investigated for responsibility. If the circumstances are serious and disciplinary action should be taken, it shall be handled in accordance with the Regulations of China Municipality on Disciplinary Actions.
