The term "hotel" as mentioned in these Measures refers to the business units that provide accommodation services with compensation. Third people's governments at all levels should strengthen the leadership of the local hotel industry security management. Public security organs at all levels are responsible for the public security management of the hotel industry, and relevant departments and units shall provide assistance. Fourth hotel business units and individuals must abide by the laws and regulations on public security management, establish a responsibility system for internal public security management in hotels, and assist public security organs in preventing and investigating illegal and criminal activities.
The competent unit of the hotel should urge the hotel operators to strengthen public security. Chapter II Examination and Approval for Opening Business Article 5 To open a hotel, the following conditions must be met:
(1) The architectural design of the hotel conforms to the relevant provisions of the Fire Protection Law of People's Republic of China (PRC) and other fire protection laws and regulations, and the safe distance between the hotel and the factory (warehouse) that produces or stores inflammable, explosive, toxic, radioactive and corrosive dangerous goods conforms to the provisions of the competent department of the State Council;
(two) the use of civil air defense projects to run the hotel, ventilation, lighting and safety facilities are complete and effective, and there are more than two spacious entrances and exits;
(three) equipped with full-time (part-time) security personnel, large hotels can set up security agencies;
(four) the passenger accommodation registration personnel have passed the examination by the public security organs and obtained the "Household Registration Certificate". Article 6 Units and individuals operating hotels must apply to the local county (city) Public Security Bureau and the Municipal Public Security Bureau for the Special Trade License before going through the industrial and commercial registration, and report the following matters in writing:
(1) The name and address of the hotel operator;
(2) The size and address of the hotel;
(3) Distribution of hotel service facilities;
(4) Mode of operation and time limit;
(5) Description of the contents specified in Article 5 of these Measures.
After receiving the application for opening a hotel, the public security organ shall make a written decision within 30 days and notify the applicant. License, and issued a "special trade license"; If the license is not granted, the reasons shall be explained. Article 7 Where a hotel closes down, changes jobs, merges, moves, changes its name or changes its operator, it shall, within three days from the date when the administrative department for industry and commerce handles the change registration, file with the public security organ that originally issued the special trade license. Chapter III Public Security Management Article 8 Hotel operators are fully responsible for the public security prevention work of hotels, organize and implement the internal public security responsibility system, implement public security prevention measures, carry out safety knowledge education and training, assist public security organs in public security management, support and cooperate in investigating and handling illegal and criminal activities, and encourage employees to fight against illegal and criminal activities.
Hotel employees shall actively undertake public security work and shall not engage in illegal and criminal activities or provide conditions for others to engage in illegal and criminal activities. Article 9 Hotel operators and employees shall immediately report to the public security organ when they find illegal and criminal acts in the hotel or criminals wanted by the public security organ, and assist the public security organ in the investigation. Article 10 When a hotel receives domestic tourists, it shall examine the identity card of the residents, register the accommodation according to the regulations, and submit the registration form to the local public security organ within the prescribed time limit.
Reception of foreigners or overseas Chinese, residents of Hong Kong, Macao and Taiwan provinces shall examine passports, visas or other valid identity documents, handle accommodation registration in accordance with the provisions, and submit the registration form to the exit-entry administration department of the local public security organ within the prescribed time limit. Article 11 The hotel shall report to the local public security organ for the passengers staying for 1 month or more, and assist in the management of the temporary population. Twelfth hotels are not allowed to store inflammable, explosive, toxic, radioactive, corrosive and other dangerous goods. Thirteenth hotels should establish a valuables storage system. The hotel should compensate for the loss, theft or damage of the property left by the passengers in the hotel.
Articles left by passengers should be properly kept and returned to their original owners or publicly claimed. Claimed unclaimed for three months, should be registered according to the collection of goods sent to the local public security organs.
Any contraband or stolen goods notified by the public security organ shall be reported to the public security organ immediately, and shall not be concealed, transferred or disposed of without authorization. Fourteenth hotels should pay special trade management fees to the public security organs according to regulations, and accept annual inspection and verification. Fifteenth in the hotel, no drinking, fighting, gambling, taking or injecting drugs, and no obscene and pornographic activities. Article 16 No unit or individual may engage in hotel business activities without an industrial and commercial registration certificate. Chapter IV Supervision and Guidance Article 17 The specific duties of public security organs in the public security management of the hotel industry are:
(a) according to the hotel safety audit, issuing the "special trade license" and establishing the hotel safety file;
(two) to investigate and deal with illegal and criminal activities in the hotel in time to ensure the legitimate operation of the hotel and the personal and property safety of passengers;
(three) to supervise and guide the hotel to establish a responsibility system for public security, do a good job in public security prevention, and prevent the occurrence of public security disasters and accidents;
(four) to assist the hotel to carry out safety business training.
