Article 4 Martyrs' memorial facilities shall be protected at different levels, including national martyrs' memorial facilities, provincial martyrs' memorial facilities, municipal martyrs' memorial facilities with districts and county-level martyrs' memorial facilities.
In line with the conditions of national and provincial martyrs memorial facilities, in accordance with the relevant provisions.
In order to commemorate the martyrs who have important influence in this city, the martyrs memorial facilities can be declared as municipal martyrs memorial facilities in districts.
In order to commemorate the martyrs who have an important influence in this county (city, district), the martyrs memorial facilities built can be declared as county-level martyrs memorial facilities. Article 5 For eligible martyrs memorial facilities, the relevant departments shall, in accordance with the procedures, actively declare the martyrs memorial facilities at the next higher level.
The following procedures shall be followed to declare the municipal martyrs memorial facilities with districts:
(a) the people's government at the county level to which the martyrs memorial facilities belong applies to the Municipal People's government with districts;
(2) The municipal people's government with districts shall transfer it to the department of veterans affairs at the corresponding level, and after investigation and verification, the department of veterans affairs at the corresponding level shall put forward examination and approval opinions for those who meet the requirements and report them to the municipal people's government with districts for examination and approval;
(III) If it is identified as a municipal martyrs memorial facility with districts, it shall be announced by the municipal people's government with districts and reported to the provincial veterans affairs department for the record.
The following procedures shall be followed to declare the memorial facilities for martyrs at the county level:
(1) Eligible facilities for commemorating martyrs shall be reported to the people's government at the county level for approval by the department of veterans affairs at the county level;
(two) identified as a memorial facility for martyrs at the county level, announced by the people's government at the county level, and reported to the Municipal Department of Veterans Affairs for the record. Sixth martyrs memorial facilities at or above the county level shall set up protective signs. Seventh martyrs memorial facilities at or above the county level shall determine the protection units, strengthen the work force, and clarify the management responsibilities. Scattered martyrs memorial facilities not included in the grade shall be protected and managed by the local county-level veterans affairs department. The department of veterans affairs at the county level may entrust the relevant units and individuals with protection and management, and the expenses required shall be borne by the county-level finance. The county-level veterans affairs department shall sign an entrustment agreement with the trustee to clarify the responsibility for protection and management. Eighth martyrs memorial facilities should be neat, solemn and solemn, and open to the public free of charge, for the public to pay tribute to and mourn the heroic martyrs, and to carry out memorial education activities to comfort the martyrs. Article 9 Where there are martyrs' praise areas and non-martyrs' praise areas within the protection scope of martyrs' memorial facilities, the areas shall be strictly divided and guiding signs shall be set up.
No non-martyr memorial facilities shall be built in the martyrs' praise area. Tenth martyrs memorial facilities protection units shall apply for land use rights certificates of martyrs memorial facilities, and the relevant units shall support and cooperate. Eleventh martyrs memorial facilities protection units should improve the funeral, post responsibility, safety management and other internal systems and work norms, formulate emergency plans, equipped with emergency facilities, and regularly carry out vocational education and business training for staff. Twelfth martyrs memorial facilities protection units should carry out the collection of historical materials and relics of martyrs, do a good job of protection and display, constantly enrich the content of Chen Zhan, innovative Chen Zhan way.
Special memorial facilities for martyrs shall be set up at or above the county level to record the local revolutionary history of Chen Zhan. Thirteenth martyrs memorial facilities protection units shall organize all kinds of martyrs memorial activities, and formulate special publicity plans to publicize the heroic deeds, dedication and noble quality of martyrs, and carry forward the spirit of heroism. Article 14 The protection unit of martyrs' memorial facilities shall give full play to the advantages of red resources, actively promote the inclusion of eligible martyrs' memorial facilities in relevant development plans such as red tourism, patriotic education bases at all levels, national defense education bases and red tourist attractions, and the relevant units shall support and cooperate. Article 15 The facilities for commemorating martyrs that meet the requirements of cultural relics protection units at the city or county level shall be approved and promulgated by the cultural relics administrative department of the people's government at the city or county level and submitted to the people's government at the corresponding level for the record; In line with the national key cultural relics protection units and provincial cultural relics protection units, in accordance with the provisions of relevant laws and regulations. Sixteenth martyrs memorial facilities within the scope of protection to prohibit the following activities:
(a) occupation of land and buildings within the scope of protection of martyrs memorial facilities;
(2) destroying or defacing facilities for commemorating martyrs;
(3) Building memorial facilities, placing ashes and burying remains for people other than martyrs;
(four) to engage in activities unrelated to or detrimental to the environment and atmosphere of commemorating martyrs within the scope of protection of memorial facilities for martyrs;
(five) other prohibited acts as prescribed by laws and regulations.
Units protecting martyrs memorial facilities shall set up prohibition or warning signs within the scope of protection of martyrs memorial facilities.
