Detailed rules for the implementation of compulsory education law
Chapter I General Provisions

Article 1 These Detailed Rules are formulated in accordance with Article 17 of the Compulsory Education Law of People's Republic of China (PRC) (hereinafter referred to as the Compulsory Education Law).

_ _ Article 2 _ School-age children and adolescents mentioned in Article 4 of the Compulsory Education Law refer to children and adolescents who should enter school according to law until they have completed compulsory education for a specified number of years.

_ _ School-age children and adolescents' school age and years of compulsory education, as well as the school age that needs to be extended due to delayed admission or other special circumstances, shall be determined by the provincial people's government according to the provisions of the Compulsory Education Law and the actual situation in the region. The school age and school age for blind, deaf-mute and mentally retarded children and adolescents to receive compulsory education may be appropriately relaxed.

_ _ Article 3 _ Under the leadership of the State Council, the local people's governments at all levels are responsible for the implementation of compulsory education, which is managed at different levels according to provinces, counties and townships. Under the leadership of the people's governments at the corresponding levels, the education departments at all levels are specifically responsible for organizing and managing the implementation of compulsory education within their respective administrative areas.

_ _ Article 4 _ The people's governments at the provincial level shall gradually implement nine-year compulsory education according to local economic and social development and local conditions.

_ _ Article 5 _ Compulsory education shall be organized and implemented by the city as a unit; The rural areas are organized by the county and implemented by the township (town). The administrative divisions for organizing compulsory education in industrial and mining areas, agricultural reclamation areas and forest areas shall be formulated by the provincial people's government.

_ _ Article 6 _ Schools that undertake the task of compulsory education are: full-time primary schools, full-time ordinary middle schools, nine-year compulsory education schools, junior secondary vocational and technical schools, various forms of simple primary schools or teaching points (classes or groups), schools for the blind, schools for the deaf, schools for mentally retarded children (classes), and work-study schools.

Literature, art, sports, special crafts and other units should ensure that school-age children and adolescents receive compulsory education. The implementation of compulsory education and teaching by the above-mentioned units shall be approved by the education authorities at or above the county level.

Chapter II _ Implementation Steps

Article 7 The implementation of nine-year compulsory education is divided into two stages. The first stage, the implementation of primary compulsory education; In the second stage, compulsory primary and secondary education will be implemented on the basis of compulsory primary education. If primary education meets the requirements of the Compulsory Education Law, primary and secondary compulsory education can be directly implemented.

_ _ Article 8 _ The implementation of compulsory education shall meet the following basic conditions:

_ _ (1) School buildings and other basic teaching facilities suitable for the number of school-age children and adolescents;

(two) in accordance with the "compulsory education law" provisions of the preparation standards and the source of teachers with teachers;

(three) have a certain economic ability, can gradually in accordance with the provisions of the standard configuration of teaching instruments, books and materials and entertainment, sports, health equipment.

_ _ Local people's governments at all levels and other institutions running schools shall actively take measures to continuously improve the conditions for implementing compulsory education.

_ _ Article 9 _ If it is difficult to directly implement compulsory primary education and it needs to be implemented in two steps, the people's government at the city or county level divided into districts shall report it to the provincial people's government for decision or handle it in accordance with local regulations.

_ _ Article 10 _ People's governments at all levels should strive to popularize compulsory primary education by the end of this century. Nine-year compulsory education or compulsory education in primary and secondary schools should be basically popularized in most parts of the country.

_ _ The people's governments at the provincial level shall formulate plans for the implementation of compulsory education, and stipulate the objectives, duration and measures for the implementation of compulsory education. The people's governments of cities and counties divided into districts shall, according to the planning of the provincial people's government, formulate specific plans for the implementation of compulsory education.

Chapter III _ School

Article 11 The grass-roots people's government or the schools authorized by it to implement compulsory education shall send the admission notices of children and adolescents receiving compulsory education to their parents or other guardians at the latest 15 days before the start of the new school year. Parents or other guardians of school-age children and adolescents must send their children or other wards to school in accordance with the notification requirements.

_ _ Article 12 _ If school-age children and adolescents need to be exempted from studying or suspended from school, their parents or other guardians shall apply and obtain the approval of the education authorities at or above the county level or the people's governments at the township level. If you apply for exemption or suspension from school due to physical reasons, you should attach the certificate of the medical institution designated by the education department at or above the county level.

_ _ If you can't come to school at the end of the semester, you should reapply for suspension.

Article 13 If parents or other guardians refuse to send their school-age children or other wards to school, or if their school-age children or other wards drop out of school after receiving compulsory education at school, the people's governments of cities and municipal districts and their education departments, as well as the people's governments at the township level in rural areas shall take measures to send their children or other wards to school.

_ _ Article 14 _ School-age children and adolescents who receive compulsory education in the place where they are not registered, with the approval of the county-level education department or the people's government at the township level where they are registered, may apply for borrowing in accordance with the relevant provisions of the people's government of their place of residence.

The length of compulsory education for school-age children and adolescents shall be subject to the provisions of their domicile.

_ _ Article 15 _ Schools shall issue certificates of completion of compulsory education to children and adolescents who have completed compulsory education for a specified number of years. The format of compulsory education certificate shall be uniformly formulated by the Provincial Department of Education.

_ _ The graduation certificate or graduation certificate obtained after completing compulsory education for a specified number of years in the local area can be regarded as the certificate for completing compulsory education.

_ _ Sixteenth _ School-age children and adolescents who have reached the graduation level of primary education or junior high school education corresponding to compulsory education in advance due to their excellent academic performance shall be deemed to have completed compulsory education.

_ _ Article 17 _ Schools that implement compulsory education may collect miscellaneous fees. The standards and specific measures for collecting miscellaneous fees are proposed by the provincial education, price and finance departments and submitted to the provincial people's government for approval. If it has been stipulated that miscellaneous fees will be exempted, its provisions can continue to be implemented.

_ _ For students with financial difficulties, reduce or exempt miscellaneous fees as appropriate.

_ _ Other administrative organs and schools shall not set their own charging items and standards in violation of relevant state regulations; Students are not allowed to charge fees at will.

_ _ Article 18 _ The poor students who enjoy financial aid according to the provisions of the second paragraph of Article 10 of the Compulsory Education Law refer to the students with financial difficulties in junior middle schools and special education schools, and the students with financial difficulties in primary schools and other boarding primary schools in ethnic minority areas, economically disadvantaged areas and remote areas. The specific measures for the implementation of the scholarship system shall be formulated by the provincial people's government.

Chapter IV Education and Teaching

Nineteenth _ the implementation of compulsory education must implement the national education policy, adhere to the socialist orientation, combine education with productive labor, and educate students in morality, intelligence, physique, beauty and labor.

_ _ Twentieth _ Schools that implement compulsory education must carry out education and teaching activities in accordance with the guiding teaching plan, syllabus and teaching plan formulated by the provincial education department issued by the the State Council education department.

_ _ Article 21 Schools implementing compulsory education should choose textbooks approved by the education administrative department of the State Council or its authorized provincial education administrative department. Textbooks that have not been approved shall not be used. Unless otherwise stipulated by the state.

_ _ Article 22 The implementation of education and teaching in compulsory education schools shall meet the needs of the physical and mental development of all students.

_ _ Schools and teachers shall not impose corporal punishment on students, corporal punishment in disguised form or other acts that insult human dignity; Children and adolescents with moral defects and learning difficulties should be given help without discrimination.

_ _ Article 23 Schools that implement compulsory education may, according to the actual situation of urban and rural economic and social development and students' own development, carry out vocational guidance education, vocational preparatory education or labor skills education for students in a planned way.

_ _ Article 24 Schools that implement compulsory education shall promote the use of Putonghua, which is commonly used throughout the country, in education, teaching and various activities.

_ _ Normal universities should use Putonghua in education, teaching and various activities.

Article 25 National autonomous areas shall organize and implement compulsory education in their own areas in accordance with the Compulsory Education Law and other relevant laws. The establishment, educational system, school-running form, teaching content and teaching language of compulsory education schools shall be decided by the organs of self-government of ethnic autonomous areas in accordance with relevant laws.

_ _ Schools that teach in the common languages of ethnic minorities should offer Chinese courses in primary schools or senior middle schools, or they can offer them in advance according to the actual situation.

Chapter V _ Implementing Safeguard Measures

Twenty-sixth _ the establishment of compulsory education schools is planned by the municipal and county people's governments, and the layout is reasonable.

The establishment of _ _ primary schools should be conducive to the admission of school-age children and adolescents to the nearest school. Boarding primary schools can be properly concentrated. The establishment of ordinary junior middle schools and junior secondary vocational and technical schools should be relatively centralized according to population distribution and geographical conditions.

_ _ The establishment of schools (classes) for blind children shall be organized and implemented by the provincial or municipal people's governments with districts. The establishment of deaf-mute schools (classes) and supplementary schools (classes) for mentally retarded children shall be arranged by the municipal and county people's governments.

_ _ Article 27 _ The people's government at the provincial level shall set the expenditure quota of all kinds of schools that implement compulsory education, and formulate the standards of public expenditure, staffing, school building construction, books and materials, equipment configuration and so on according to the average number of students.

_ _ Local people's governments at all levels shall formulate implementation plans to make schools meet the standards for running schools listed in the preceding paragraph by stages, and conduct inspection and acceptance.

_ _ Article 28 _ Local people's governments at various levels shall be responsible for raising business funds and capital construction investment for compulsory education schools. The growth ratio of financial allocation for compulsory education should be higher than the growth ratio of recurrent financial revenue, and the average education funds should be gradually increased according to the number of students in school.

_ _ The operating expenses and capital construction investment of schools run by social forces to implement compulsory education shall be raised by the school-running unit or the private school-run operators approved by the state.

_ _ The central and local governments shall, according to specific conditions, give appropriate subsidies to economically disadvantaged areas and areas where ethnic minorities live in concentrated communities to implement compulsory education.

_ _ The local people's governments at all levels shall encourage all social forces and individuals to make voluntary donations to aid students.

_ _ Twenty-ninth _ education fees collected according to law shall be included in the urban budget management, and the competent education department shall make overall arrangements and put forward a distribution plan, which shall be used to improve the conditions for running schools in primary and secondary schools with the consent of the financial department at the same level; Rural people's governments at the township level are responsible for overall arrangements, which are mainly used to pay teachers' salaries subsidized by the state and paid collectively, improve school conditions and supplement public funds of schools.

_ _ part of the school's work-study income should be used to improve school conditions.

_ _ Thirtieth _ The new construction, reconstruction and expansion of all kinds of schools that implement compulsory education shall be incorporated into the overall planning of urban and rural construction and coordinated with the permanent population and the implementation planning of compulsory education.

The funds needed for the new construction, renovation and expansion of compulsory education schools shall be included in the capital construction investment plan by the local people's governments in cities and towns, or raised through other channels; In rural areas, townships and villages are responsible for raising funds, and the people's governments at the county level may give subsidies to difficult townships and villages as appropriate.

_ _ Article 31 Local people's governments at various levels shall take practical measures to ensure that all types of schools that implement compulsory education supply textbooks and stationery paper on time, with good quality and quantity.

_ _ Article 32 People's governments at the provincial level shall make plans and take measures to strengthen and develop normal education, and organize other institutions of higher learning to train teachers for the implementation of compulsory education.

Teachers in schools for blind, deaf-mute and mentally retarded children are trained by the provincial people's government according to the actual situation.

_ _ Article 33 _ Education authorities at all levels shall strengthen teacher training in compulsory education schools, so that teachers' ideological and political quality and professional level can meet the requirements stipulated in the Compulsory Education Law.

_ _ People's governments at all levels should strengthen training and improve the ideological and political quality and management level of school principals who implement compulsory education.

_ _ On-the-job training for principals and teachers shall be organized by local education authorities at or above the county level.

Chapter VI Management and Supervision

Thirty-fourth _ local people's governments at all levels and their education departments shall establish a target responsibility system for the implementation of compulsory education, and take the implementation of compulsory education as an important part of the performance evaluation of relevant responsible persons.

_ _ Article 35 The people's governments at or above the county level shall establish a system of supervision, guidance and inspection on the implementation of compulsory education.

_ _ Article 36 Schools and other institutions that implement compulsory education shall accept the management, guidance and supervision of the local people's governments and their education administrative departments on the implementation of compulsory education.

Article 37 Local people's governments at various levels shall reward enterprises, institutions, schools, social organizations, armed forces, residents' (village) organizations and citizens who have made outstanding contributions in the implementation of compulsory education.

Chapter VII Punishment

Thirty-eighth _ in any of the following circumstances, the local people's government or the relevant departments shall give administrative sanctions to the responsible person according to the management authority:

_ _ (1) Failing to achieve the planned goal of implementing compulsory education as scheduled due to dereliction of duty;

_ _ (2) Failing to meet the requirements for running compulsory education schools as scheduled without special reasons;

_ _ (3) Failing to take necessary measures to solve the problem of students dropping out of school;

_ _ _ (4) refusing to accept school-age children and adolescents who should receive compulsory education in their own areas and schools without justifiable reasons;

_ _ (five) lease, transfer or use the school buildings and sites for other purposes, which hinders the implementation of compulsory education;

_ _ (six) the use of textbooks that have not been approved according to law, causing adverse effects;

_ _ (seven) other obstacles to the implementation of compulsory education.

_ _ Article 39 _ In any of the following circumstances, the local people's government or the relevant department shall give administrative sanctions to the relevant responsible person according to the management authority; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law:

_ _ (a) occupation, deduction, misappropriation of compulsory education funds;

_ _ (two) dereliction of duty caused the collapse of the school building, causing casualties among teachers and students.

_ _ Fortieth _ If parents or other guardians of school-age children and adolescents fail to send their children or other wards to school for compulsory education in accordance with regulations, the people's governments of cities and municipal districts or their designated institutions shall criticize and educate them in rural areas; Those who refuse to send their children or other wards to school after education may be fined according to the specific circumstances and take other measures to make their children or other wards attend school.

_ _ Article 41 Whoever recruits school-age children and adolescents who should receive compulsory education to work, engage in business or engage in other employment-related jobs shall be punished in accordance with the relevant provisions of the state prohibiting the use of child labor.

_ _ Forty-second _ One of the following acts shall be given administrative sanctions by the relevant departments; Violation of the Regulations of the People's Republic of China on Administrative Penalties for Public Security shall be given administrative punishment by the public security organs; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

_ _ (1) disturbing the order of compulsory education schools;

_ _ (2) insulting or beating teachers and students;

_ _ (three) the circumstances of corporal punishment of students are serious;

_ _ (four) occupation or destruction of school buildings, venues and equipment.

_ _ Article 43 If a party refuses to accept the decision on administrative punishment, it may apply for reconsideration in accordance with the provisions of laws and regulations. If a party refuses to accept the reconsideration decision, it may bring a lawsuit to the people's court in accordance with the provisions of laws and regulations. If a party fails to apply for reconsideration, bring a lawsuit to the people's court or perform the punishment decision within the time limit, the organ that made the punishment decision shall apply to the people's court for compulsory execution, or enforce it according to law.

Chapter VIII Supplementary Provisions

Forty-fourth school-age children's school age should be based on the age reached before the start of the new school year.

_ _ Article 45 _ The State Education Commission shall be responsible for the interpretation of these Detailed Rules.

_ _ Article 46 These Rules shall come into force as of the date of promulgation.
