Where laws and regulations have other provisions on fire safety, road traffic safety, railway traffic safety, water traffic safety and civil aviation safety, those provisions shall prevail. Article 3 Safety in production adheres to the policy of safety first, prevention first and comprehensive management, and follows the principles of unified leadership by the government, supervision by departments according to law, overall responsibility of production and business units and social participation in supervision. Article 4 The production and business operation entity is the main body responsible for production safety, and shall abide by the laws, regulations and standards of production safety, strengthen safety management, improve the responsibility system, strengthen safeguard measures and improve safety conditions.
The main person in charge of the production and business operation entity is fully responsible for the safety production work of the entity. Article 5 Employees of production and business operation entities shall have the right to obtain the guarantee of safety in production according to law and shall fulfill their obligations of safety in production. Article 6 A trade union shall organize its employees to participate in the democratic management and supervision of production safety, participate in the investigation of production safety accidents, put forward opinions and suggestions on ensuring production safety, urge its employees to correct illegal acts, eliminate hidden dangers of accidents and safeguard the legitimate rights and interests of employees. Article 7 The municipal and district people's governments shall incorporate the work of production safety into the national economic and social development plan, establish and improve the monitoring system, responsibility system and assessment and reward and punishment system, and urge the relevant departments to perform their duties of supervision and management of production safety.
The Town People's Government and sub-district offices shall, in accordance with the provisions of these Regulations, do a good job in the supervision and administration of production safety within their respective jurisdictions. Article 8 The supervision and administration department of production safety shall, in accordance with the law, carry out comprehensive supervision and administration over the work of production safety within its administrative area, and guide, coordinate and supervise the work of production safety management.
Public security, housing and urban and rural construction, quality and technical supervision, transportation and other departments responsible for the supervision and management of production safety (hereinafter referred to as special supervision departments) shall, in accordance with the provisions of relevant laws and regulations, respectively, implement special supervision and management of production safety in road traffic, construction, special equipment, transportation and other aspects.
Other departments responsible for the supervision and administration of production safety shall supervise and administer the work of production safety within the scope of their respective duties. Article 9 The municipal and district people's governments and their relevant departments shall strengthen the publicity of laws, regulations and knowledge about safety in production, organize education and training on safety in production, promote the construction of safety culture, and improve the public's awareness of safety in production and the ability to prevent accidents.
Newspapers, television, radio, internet and other media have the obligation to publicize and report on production safety and supervise the work of production safety by public opinion. Article 10 The municipal and district people's governments shall encourage and support the research and development of safety production science and technology, and encourage and support the popularization and application of advanced technologies, equipment and processes for safety production. Article 11 The municipal and district people's governments and their relevant departments shall commend and reward the units and individuals that have made remarkable achievements in improving safe production conditions, preventing production safety accidents and participating in emergency response. Chapter II Guarantee of Safety in Production Article 12 A production and business operation entity shall meet the conditions for safety in production stipulated by laws, regulations, national standards or industrial standards; Those who do not have the conditions for safe production shall not engage in production and business activities. Thirteenth production and business units shall establish the following safety production management system:
(a) the responsibility system for production safety;
(2) Regular meeting system of production safety;
(3) Management system for special operators and special equipment;
(four) the system of investigation and management of hidden dangers of production safety accidents;
(5) Occupational hazard prevention and control system;
(six) other safety production management systems as prescribed by laws and regulations. Article 14 The principal responsible person of a production and business operation entity shall perform the following duties:
(a) to determine the person in charge of production safety, equipped with safety management personnel;
(two) to ensure the investment and effective use of funds needed for safe production;
(3) Organizing the investigation and management of hidden dangers of accidents;
(4) Organizing the implementation of management measures for the prevention and control of occupational hazards;
(five) submit the safety production report of the unit to the safety production supervision and management department, special supervision department or relevant departments every year;
(six) other duties of production safety as prescribed by laws and regulations.
The person in charge of production safety shall assist the main person in charge to perform the duties of production safety, and organize the work of production safety education and training, scientific and technological research and application; Other responsible persons shall do a good job in production safety according to the division of responsibilities. Article 15 A production and business operation entity under any of the following circumstances shall set up a safety committee, and other production and business operation entities may set up a safety committee:
(1) It belongs to high-risk industries such as production, operation, use, storage and transportation of mines, buildings and dangerous goods (hereinafter referred to as high-risk industries) and employs more than 50 people;
(2) It belongs to major dangerous industries such as metal smelting, ship building and dismantling, electric power, loading and unloading and transportation. (hereinafter referred to as major hazardous industries) and the number of employees exceeds 100;
(3) There are more than 300 employees in production and business units in other industries.
The work safety committee of a production and business operation entity is composed of the main person in charge of the unit, the person in charge of work safety, the person in charge of work safety management institutions and related institutions, the personnel in charge of work safety management and representatives of trade unions. If a trade union organization has not been established, there shall be representatives of the staff and workers.
The Committee on Work Safety examines the annual work plan for work safety, the implementation of major technical projects for work safety and various inputs for work safety, studies and coordinates major issues of work safety, and urges the implementation of measures to eliminate hidden dangers of accidents. The safety production committee shall hold a meeting at least once every quarter, and the meeting shall be recorded in writing.
