The safety training, assessment, certification, review, supervision and management of special operations personnel in coal mines shall be implemented in accordance with the Provisions on the Administration of Safety Technical Training and Assessment of Special Operations Personnel. Article 3 The main person in charge of a coal mining enterprise as mentioned in these Provisions refers to the chairman and general manager of a coal mining company limited by shares, a limited liability company and its subsidiaries and branches, the director of a mining bureau, the mine manager and other personnel. Article 4 The person in charge of production safety in coal mining enterprises mentioned in these Provisions refers to the vice chairman, deputy general manager, deputy factory director, deputy mine manager, chief engineer, deputy chief engineer or technical person in charge of production safety in coal mining enterprises, the person in charge and manager of production safety management institutions, and the person in charge of production, technology, ventilation, electromechanical, transportation, geological survey, dispatching and other functional departments (including coal mines, districts, departments and teams). Article 5 The principle of "centralized management, graded implementation, unified standards and separation of teaching and examination" shall be implemented in coal mine safety training.
The State Administration of Coal Mine Safety is responsible for guiding and managing the training, assessment and certification of safety qualification certificates, mine managers' qualification certificates and special operations personnel's operation certificates of coal mine enterprises, organizing the formulation of coal mine safety training syllabus and assessment standards, and establishing an examination question bank.
Provincial coal mine safety supervision institutions and departments responsible for coal mine safety training of the people's governments of provinces (autonomous regions and municipalities directly under the Central Government) shall, in accordance with the division of responsibilities, guide and manage the training, assessment and certification of relevant qualification certificates of coal mine enterprises within their respective administrative areas, and implement the safety training, assessment and certification of provincial coal mine enterprises. The training, examination and certification of the qualifications of coal mine subsidiaries and branches of central enterprises within their respective administrative areas, the main responsible persons and safety production management personnel, as well as coal mine managers. Article 6 The safety qualification certificates and mine managers' qualification certificates of the principal responsible persons and safety production management personnel of coal mining enterprises are valid throughout the country. Article 7 Coal mining enterprises shall establish and improve the safety training management system, equip full-time or part-time safety training management personnel, and draw funds for education and training according to the proportion stipulated by the state. Among them, the safety training funds shall not be less than 40% of the total education and training funds. Article 8 The State encourages coal mining enterprises to change recruitment into enrollment. Coal mining enterprises to recruit new employees underground, giving priority to technical schools or technical secondary school graduates majoring in coal mining. Article 9 The institutions responsible for coal mine safety training (hereinafter referred to as safety training institutions) shall obtain corresponding qualifications according to law, establish and improve safety training systems and training files, implement safety training plans, employ full-time teachers who have passed the examination, and conduct training according to the unified national coal mine safety training outline. Chapter II Access Conditions for Employees Article 10 Coal mine employees shall meet the following basic conditions:
(1) Being in good health and having no occupational contraindications;
(2) At least 18 years old, not exceeding the national statutory retirement age;
(3) Having a junior high school education or above;
(4) Other conditions stipulated by laws and administrative regulations. Article 11 The mine manager, deputy mine manager, chief engineer, deputy chief engineer or technical person in charge of a coal mine with an annual production capacity of 300,000 tons or above or a coal and gas outburst coal mine shall, in addition to meeting the provisions of Article 10 of these Provisions, have a college degree or above in coal mine-related major and have engaged in coal mine-related work for 3 years or above.
The mine manager, deputy mine manager, chief engineer, deputy chief engineer or technical person in charge of a coal mine with a production capacity or approved capacity of less than 300,000 tons shall, in addition to complying with the provisions of Article 10 of these Provisions, have a technical secondary school degree or above in coal mine-related majors and have engaged in coal mine-related work for more than 3 years. Article 12 The person-in-charge of the safety production management organization in coal mines with a production capacity or an approved capacity of over 300,000 tons/year, and coal and gas outburst coal mines shall, in addition to meeting the provisions of Article 10 of these Provisions, also have a technical secondary school degree or above in coal mine-related majors and have more than 2 years of experience in coal mine safety production.
The person in charge of the safety production management institution of a coal mine with a production capacity or an approved capacity of less than 300,000 tons/year shall, in addition to complying with the provisions of Article 10 of these Provisions, also have a high school education or above, and have more than 2 years of experience in safety production in coal mines. Thirteenth coal mining enterprises shall not arrange personnel who have not passed the safety training to engage in production activities.
Safety training institutions shall review the basic conditions of trainees; Only those who meet the requirements can receive training. Chapter III Safety Training Article 14 The principal responsible persons and safety production management personnel of coal mining enterprises shall receive safety qualification training, and they can only take up their posts after passing the examination and obtaining corresponding safety qualification certificates. In addition to obtaining the safety qualification certificate of the main person in charge of the coal mining enterprise, the mine manager shall also receive the qualification training of the mine manager according to law, and can only serve after passing the examination and obtaining the qualification certificate of the mine manager. Mine manager qualification and safety qualification should be combined with training, examination and issuance respectively.
Team leader engaged in coal mining, tunneling, electromechanical, transportation, ventilation, geological survey, etc. Coal mine workers should receive special safety training, and only after passing the training can they work at their posts.
Other employees other than those specified in the preceding two paragraphs of this article shall receive safety training corresponding to their posts, and only after passing the training can they work at their posts.
