Learning opportunity is the starting point of receiving any level of education, and the right to learning opportunity is the premise and basic right of the existence and development of the right to education. According to its manifestations, three rights can be derived: the right to enter school, the right to choose education and the right to students.
The right of fair and high-quality learning opportunity is the right of opportunity in the initial stage of receiving education, but it emphasizes the fairness and high-quality of the right of learning opportunity as the entrance to education. In other words, all citizens who have reached the legal age have the right to fair and high-quality learning opportunities. Relevant laws and policies at the international and domestic levels have clearly stipulated this.
For example, the Framework for Education Action in 2030 issued by UNESCO requires "ensuring inclusive and fair quality education so that everyone can get learning opportunities".
Articles 33 and 46 of the Constitution, articles 9 and 37 of the Education Law and articles 1, 3 and 4 of the Compulsory Education Law all make specific provisions on the right to a fair and high-quality learning opportunity. The educational principles and policies of the Party and the country all emphasize "striving to make every child enjoy a fair and quality education".
The right to success in fair and high-quality learning is the highest level of the right to fair and high-quality education, which pursues the realization of the right to education and the ultimate goal of education. International human rights law regards the development of human personality, intelligence and physical and mental ability as the ultimate goal of the right to education.
According to the definition of UNESCO, quality education is an education to cultivate "responsible citizens' values, attitudes and emotions, cognitive skills and non-cognitive skills, creativity and behavioral ability".
