Educatees who refuse to accept the punishment given by the school have the right to complain to the relevant departments, and those who violate their personal rights, property rights and other legitimate rights and interests by the school or teachers have the right to lodge a complaint or bring a lawsuit according to law. If they want to complain to the teacher, they can complain directly to the Education Bureau.
Article 37 of the Teacher Law of People's Republic of China (PRC) stipulates that a teacher shall be given administrative sanctions and dismissed in any of the following circumstances.
(1) intentionally fails to complete the education and teaching tasks, thus causing losses to the education and teaching work.
(2) corporal punishment of students, which is not changed after education.
(3) Bad conduct, insulting students and having a bad influence.
If a teacher falls under any of the circumstances listed in Items (2) and (3) of the preceding paragraph and the circumstances are serious enough to constitute a crime, he shall be investigated for criminal responsibility according to law.
If a teacher punishes a student, it violates the following laws:
The provisions of the Education Law of the People's Republic of China, the Compulsory Education Law of People's Republic of China (PRC), the Teachers Law of People's Republic of China (PRC) and the Law of People's Republic of China (PRC) on the Protection of Minors are serious and constitute a criminal offence.
