Chapter I General Principles

Article 1 In order to improve the leave system of school staff, standardize the leave behavior of staff, implement the salary and welfare during the leave period, and improve the management level of the school, according to the State Council Guofa [93] No.85, Shaanxi Industrial Development and Reform Commission 1 and xi Interim Provisions on Staff Leave, combined with the actual situation in our region, the Interim Provisions on Staff Leave in weiyang district are formulated.

Chapter II Vacation Categories and Vacation Duration

Article 2 Personal leave: When employees need to take time off for work, they can take time off.

Article 3 Marriage leave: faculty members get married and take 7 days off. According to the distance, you can give another round-trip holiday. Late marriage (male over 25 years old, female over 23 years old) plus 20 days, marriage leave should generally be in winter and summer vacation.

Article 4 Maternity leave: The maternity leave for female employees is 90 days. The number of dystocia increased 15 days; If a married woman over the age of 24 gives birth to her first child, it will increase by 15 days; Those who receive the one-child certificate during maternity leave will be increased by 30 days.

Female faculty members who have miscarried within 4 months of pregnancy are on leave 15-30 days; Give 42 days' leave after 4 months of abortion.

Article 5 Breastfeeding leave: A female faculty member who meets the provisions of the Shaanxi Family Planning Regulations and can leave the school after receiving the one-child certificate shall be granted one-year baby breastfeeding leave upon her own application and with the consent of the school.

Article 6. Funeral leave: After the death of relatives (parents, adoptive parents, parents-in-law, parents-in-law, spouse and children) of the faculty, they will be given 7 days of funeral leave. According to the distance, you can give another round-trip holiday.

Article 7 Home Visit Leave: All faculty members who have worked for 1 year, do not live with their fathers, mothers and spouses, and cannot be reunited on public holidays can enjoy the treatment of visiting relatives.

1. If the staff visit their spouses, they will be given family leave once a year, with a holiday of 30 days;

2. Unmarried faculty members visit their parents once a year and have a holiday of 20 days; .

3. Married employees who visit their parents are given leave once every 4 years, with a holiday of 20 days; .

4. If the spouses of faculty and staff are sent abroad to study, and the study period determined before going abroad is more than 3 years and the study period abroad reaches 1 year or more, faculty and staff can apply for going abroad to visit relatives, and the holiday is generally 3 months, but not more than 6 months at most.

Family leave should be arranged in winter and summer vacations, and the shortfall should be made up.

Article 8 Personal Leave: Returned overseas Chinese and their relatives who need to leave the country for personal reasons must obtain the consent of the school and report to the higher education bureau for approval before going through the exit formalities.

1. All faculty and staff who apply to go to Hong Kong and Macao will be given a three-month holiday (including the time required for round trip, the same below) from the date of obtaining approval from the local public security department;

2. From the date of obtaining the passport and visa, the applicant will be given a six-month holiday.

3. After the faculty and staff are allowed to leave the country, if there are special circumstances that need to extend their leave, they should go through the formalities of extending their leave. Extend the time limit of vacation, the teaching staff going to Hong Kong and Macao shall not exceed 1 month and the teaching staff going abroad shall not exceed 3 months.

Ninth sick leave; Teachers who can't stick to their normal work due to illness can take sick leave.

In case of winter and summer holidays, public holidays and legal holidays, the time of winter and summer holidays, public holidays and legal holidays shall be included in the vacation period.

Chapter III Holiday Treatment

Article 10 Personal leave treatment: If the employee takes personal leave for more than 7 days per semester, the average daily salary of the month will be deducted from the eighth day. Deduct the class fee during the personal leave within 7 days. If the accumulated personal leave exceeds 3 months within one year, it will not be assessed at the end of the year (calculated on an annual basis).

Eleventh marriage leave treatment: during the approved marriage leave and round-trip leave, pay the full salary.

Article 12 Maternity leave benefits: Pay as usual during maternity leave.

Article 13 Breastfeeding leave treatment: 60% of my salary (post salary+10%) is paid during the holiday, and no allowance is paid. You are not allowed to engage in paid social labor on holidays, and you will not be assessed this year.

Fourteenth funeral leave treatment: pay full salary during funeral leave and round-trip leave.

Fifteenth treatment of visiting relatives:

1. The faculty and staff visiting relatives in China will receive full salary during the prescribed home leave and round trip.

2. The staff and workers who go abroad to visit relatives will be paid as usual during their family leave.

Article 16 Personal leave treatment:

1, the teaching staff of returned overseas Chinese and their relatives shall deduct the class allowance during the holidays stipulated by the state.

2, returned overseas Chinese and their relatives who want to resign after their applications for leaving the country are approved shall be handled with reference to the relevant provisions of the Interim Measures for the Administration of Civil Servants in Xi.

Seventeenth sick leave benefits:

1. Salary during sick leave:

(1) If the sick leave is less than 2 months, the shift allowance will be deducted.

(2) Sick leave exceeding 2 months but not exceeding 6 months shall be paid from the third month. Among them, if the working experience is less than 10 years, it will be paid according to 90% of my salary (post salary 1 10%), and the category allowance will be deducted; If the working experience exceeds 10 years, only the category allowance will be deducted.

(3) If the sick leave lasts for more than 6 months, the sick pay shall be paid from the seventh month until the medical treatment expires or the medical treatment ends. Among them, if the working experience is less than 10 years, 70% of my post salary and 10% salary shall be paid; Those who have worked for 10 years or more shall be paid 80% of the post salary, 10% of the salary, without allowance.

(4) If the accumulated sick leave exceeds 6 months in a year, the assessment will not be made at the end of the year, and the working years in that year cannot be calculated continuously.

(5) Those who are awarded the title of combat hero by model workers in Xi City and above or units above the corps level and keep the honor will be paid as usual during their sick leave.

2. Medical care:

(1) The medical treatment period refers to the period during which employees are instructed to stop working and rest due to illness or non-work-related injuries.

(2) When the staff need to stop working for medical treatment, they are given a medical treatment period of 3 to 12 months according to their actual working years: 3 months for those who are less than 10 years, and 6 months for those who are more than 10 years; Work 15 years and less than 20 years is 9 months; 12 months for people who have worked for 20 years or more.

(3) If the medical treatment period is 3 months, the sick leave period shall be accumulated within 6 months; For 6 months, the accumulated sick leave time shall be calculated as 12 months; 9 months, and the sick leave time is accumulated within 15 months; 12 months, and the sick leave time is accumulated within 18 months.

(4) The downtime treatment time of teaching staff should be accumulated in the calculation time corresponding to the medical treatment period they enjoy. If the downtime treatment time reaches the corresponding medical treatment period, it is the medical treatment period; If the treatment is stopped within the specified calculation time, and the medical treatment period is not reached, the medical treatment period is not full.

(five) the staff who are sick or disabled due to non-work-related illness and whose medical treatment has expired may be identified and evaluated by the municipal or district/county labor appraisal committee according to their affiliation. Those who are identified as Grade I to Grade IV shall go through retirement or resignation procedures; Those who have been identified as Grade 5 to 10, if they can persist in their normal work, the school can arrange their appropriate work (probation period is 2 months) and enjoy the corresponding post salary; If you can't stick to your normal work, the school can persuade you to resign. If you don't listen to advice, the school can report to the higher education bureau for approval and be dismissed.

(6) The teaching and administrative staff shall submit an application for labor ability appraisal to the school in written form within 10 from the date of medical treatment expiration or medical treatment termination (which has nothing to do with winter and summer vacations, the same below), and the school shall submit the appraisal materials to the appraisal institution within 15 days after receiving the application. While waiting for the appraisal conclusion, the faculty and staff are still treated according to the medical treatment period and enjoy sick pay.

(7) The expenses required for faculty appraisal and disability assessment are generally borne by me (except for work-related disability). Refuse to identify the disabled without justifiable reasons, the school can be reported to the Education Bureau for approval, according to the expulsion.

Article 18 Treatment of absenteeism: If a faculty member leaves without authorization or fails to return within the time limit without justifiable reasons (including the extension of leave without approval) or is punished for absenteeism due to other circumstances, if he has been absent from work for more than 15 days in a row or accumulated more than 30 days in a year, he shall be treated as automatic resignation. If the continuous absenteeism does not exceed 15 days or the cumulative absenteeism does not exceed 30 days in a year, the average daily salary of the month will be deducted for each absenteeism day.

Chapter IV Allowance for Leave

Nineteenth principals leave must be submitted for approval according to the cadre management authority;

Twentieth vice president and middle-level leaders leave by the principal for approval;

Twenty-first staff leave within 2 days approved by the department head; Approved by the vice president in charge within 2 days and 5 days; More than 5 days must be approved by the person in charge. Personal leave accumulated more than 3 weeks, reported to the Education Bureau for the record.

Article 22 1, faculty members who suffer from illness or non-work-related injuries shall show the relevant hospital diagnosis certificate every month, and those who have accumulated sick leave for more than 6 months in one year shall be reported to the Education Bureau for the record. 2, continuous absenteeism 15 days or accumulated more than 30 days in a year, timely report to the Education Bureau.

Chapter V Leave Procedure

Twenty-third whoever needs to take time off must write a written application and attach relevant certificates, and can leave school only after being approved by the relevant leaders (units). If you can't ask for leave in person due to unexpected events, you should entrust others to perform the leave formalities on your behalf, and the approval will take effect.

Twenty-fourth schools can consult medical records, examinations and other relevant sick leave certificates at any time, and go to the hospital to understand the situation. If fraud is found, the number of days off will be treated as absenteeism, and criticism, education or disciplinary action will be given according to the seriousness of the case.

Chapter VI Supplementary Provisions

Twenty-fifth the Interim Provisions shall apply to all kinds of schools at all levels in the region. Material stations and thrifty companies can refer to this article.

Twenty-sixth the Interim Provisions shall be interpreted by the Personnel Department of the Education Bureau.

Twenty-seventh "Interim Provisions" in the full salary refers to the post salary +00% and allowance.

Twenty-seventh the Interim Provisions shall come into force as of the date of promulgation, and the original Notice of Xi Municipal Education Commission on Printing and Distributing the Interim Provisions on School Staff's Leave [No.47 Municipal Education Commission (1994)] shall be abolished at the same time.
