How to calculate the salary for legal holidays in calendar 2, 2022?

The second and third paragraphs of Article 44 of the Labor Law stipulate that if workers are arranged to work on rest days but cannot be arranged for compensatory rest, they shall be paid no less than 200% of their wages; If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.

There is a misunderstanding in this respect. For example, the National Day holiday lasts for seven days, but according to Article 2 of National Statutory Holidays and Remembrances, the national holiday is the first three days of 10. Accordingly, if you work overtime during the National Day, you will only enjoy three times the salary for the first three days and double the salary for the remaining four days. Therefore, for the workers who work overtime on the 11th statutory holidays, the overtime pay shall not be less than three times the daily wage base, and the overtime pay shall be twice the standard for public holidays on June+10/October 4th, 4538 and thereafter.

Is there overtime pay for 7 days of National Day?

Working hours system is related to overtime, which can be divided into three situations: delayed overtime (usually manifested as working days), overtime on rest days (usually manifested as weekends) and overtime on legal holidays.

If the laborer works overtime, the employer shall pay the corresponding overtime wages.

Under the standard working hours system, overtime pay shall be no less than 150% of the hourly wage base; If overtime cannot be arranged on weekends, overtime pay on rest days shall be paid at least 200% of the daily or hourly wage base; For those who work overtime on legal holidays, overtime pay shall be paid at not less than 300% of the daily or hourly wage base.

Under the system of comprehensive calculation of working hours, overtime pay shall be paid at 150% of the hourly wage base; For those who work overtime on legal holidays, overtime pay shall be paid at not less than 300% of the daily or hourly wage base.

Some workers think that the Spring Festival and National Day have a holiday of 7 days, and the Dragon Boat Festival and Mid-Autumn Festival have a holiday of 3 days as legal holidays. If you have overtime, you can claim overtime pay for legal holidays. This understanding is wrong. Take National Day as an example. Although there are seven days off, only three days (that is, 65438+ 10/kloc-0, 2 and 3) are legal holidays, and the other four days are actually weekends. Workers who work overtime can claim overtime pay for three statutory holidays and four rest days (of course, the premise of claiming overtime pay for rest days is that overtime is not arranged).
