Article 1 These Regulations are formulated in order to strengthen the management of kindergartens and promote the development of preschool education. ?
Article 2 These Regulations shall apply to kindergartens that recruit preschool children over three years old and provide them with care and education. ?
Article 3 Kindergarten conservation education should promote the harmonious development of children in physical, intellectual, moral and aesthetic aspects. ?
Article 4 Local people's governments at all levels shall formulate plans for the development of kindergartens according to the local social and economic development. ?
The establishment of kindergartens should adapt to the local population. ?
Kindergarten development planning in townships, towns, municipal districts and cities without districts shall include kindergarten layout planning. ?
Article 5 Local people's governments at various levels may set up kindergartens according to these regulations, and encourage and support enterprises, institutions, social organizations, residents' committees and villagers' committees and citizens to set up kindergartens or donate money to run parks. ?
Article 6 Kindergarten management follows the principles of territorial responsibility, hierarchical management and division of responsibilities among relevant departments. ?
The State Education Commission is responsible for the management of kindergartens throughout the country; The education administrative departments of local people's governments at all levels shall be in charge of kindergarten management within their respective administrative areas. ?
Chapter II Basic conditions and approval procedures for holding kindergartens?
Article 7 Kindergartens must be located in safe areas. It is strictly forbidden to set up kindergartens in polluted areas and dangerous areas. ?
Article 8 Kindergartens must have parks and facilities that meet the requirements of conservation and education. Kindergarten buildings and facilities must meet the national health standards and safety standards. ?
Ninth the establishment of a kindergarten shall be equipped with nursing, preschool education, medical care and other staff who meet the following conditions:
(a) kindergarten directors and teachers should have graduated from preschool normal schools (including pre-school education majors in vocational schools), or passed the examination by the administrative department of education. ?
(2) Doctors should have graduated from medical colleges, and doctors and nurses should have graduated from secondary health schools, or obtained the qualification recognition from the health administrative department. ?
(three) health care workers should have graduated from high school and received infant health care training. (4) Nurses should graduate from junior high school and have received vocational training in child health care. ?
Patients with chronic infectious diseases and mental illness are not allowed to work in kindergartens. ?
Article 10 Units or individuals that run kindergartens must have sources of funds for conservation, education, maintenance or expansion and reconstruction of kindergartens' buildings and facilities. ?
Article 11 The state practices a kindergarten registration system. Without registration, no unit or individual may start a kindergarten. ?
Article 12 The establishment and closure of urban kindergartens shall be registered by the education administrative department of the municipal people's government of a district or a city not divided into districts. ?
The establishment and closure of rural kindergartens shall be registered by the local people's governments of townships and towns and reported to the education administrative departments of the people's governments at the county level for the record. ?
Chapter III Kindergarten Conservation Education?
Thirteenth kindergartens should implement the principle of combining conservation with education, create a harmonious environment suitable for children's education and development, and guide the healthy development of children's personality.
Kindergartens should protect children's health and cultivate children's good living and hygiene habits; Promote children's intellectual development; Cultivate children's feelings of loving the motherland and good moral behavior. ?
Fourteenth kindergarten enrollment and class arrangement shall comply with the provisions of the administrative department of education. ?
Fifteenth kindergartens should use Mandarin, which is commonly used throughout the country. Kindergartens that mainly recruit ethnic minorities can use the spoken and written languages commonly used by their own nationalities. ?
Sixteenth kindergartens should take games as the basic form of activities. ?
Kindergartens can arrange and choose the contents and methods of education according to the reality of the kindergarten, but they must not engage in activities that violate the laws of early childhood education and are harmful to the physical and mental health of young children. ?
Seventeenth corporal punishment and corporal punishment of children in disguised form are strictly prohibited. ?
Eighteenth kindergartens should establish a health care system to prevent food poisoning and infectious diseases. ?
Nineteenth kindergartens should establish a safety protection system, and it is strictly forbidden to set up dangerous buildings and facilities that threaten the safety of young children in kindergartens, and it is strictly forbidden to use toxic and harmful substances to make teaching AIDS and toys. ?
Article 20 When food poisoning or infectious diseases are prevalent in kindergartens, the units or individuals holding kindergartens shall immediately take emergency rescue measures and report to the local education administrative department or health administrative department in time. ?
Twenty-first kindergartens and their facilities may be in danger, the units or individuals holding kindergartens shall take measures to eliminate the danger and prevent accidents. ?
Chapter iv kindergarten administrative affairs?
Article 22 Education administrative departments at all levels shall be responsible for supervising, evaluating and guiding kindergarten conservation education, organizing kindergarten teacher training, assessing the qualifications of kindergarten teachers, assisting health administrative departments in inspecting and guiding kindergarten health care work, and formulating standards for kindergarten buildings and facilities jointly with construction administrative departments. ?
Twenty-third kindergarten directors are responsible for the work of kindergartens. ?
The kindergarten director shall be appointed by the unit or individual holding the kindergarten, and shall be filed with the kindergarten registration authority. ?
Kindergarten teachers, doctors, health workers, nurses and other staff are appointed by the kindergarten director, or by the units or individuals that hold kindergartens. ?
Article 24 Kindergartens may charge their parents for care and education according to the charging standards stipulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. ?
Kindergartens should strengthen financial management and rationally use all kinds of funds, and no unit or individual may deduct or misappropriate kindergarten funds. ?
Article 25. No unit or individual may occupy or destroy buildings and facilities that are dangerous, polluting or affect the lighting of kindergartens, and may not interfere with the normal working order of kindergartens. ?
Chapter v rewards and punishments?
Twenty-sixth units and individuals that meet one of the following conditions shall be rewarded by the administrative department of education and relevant departments:
(1) Remarkable achievements have been made in improving the conditions for running kindergartens:
(2) Having made remarkable achievements in protection and education; ?
(3) Remarkable achievements have been made in kindergarten management. ?
Article 27 In case of any of the following circumstances in violation of these regulations, the administrative department of education shall, depending on the seriousness of the case, give the kindergarten an administrative penalty of rectification within a time limit, stopping enrollment and closing down. ?
(1) Recruiting children without registration; ?
(two) gardens and facilities do not meet the national health standards and safety standards, which hinder children's health or threaten their life safety; ?
(three) the contents and methods of education violate the laws of early childhood education and damage the physical and mental health of young children. ?
Twenty-eighth units and individuals in violation of these regulations, under any of the following circumstances, the administrative department of education shall give administrative punishment of warning and fine to the person directly responsible, or the administrative department of education shall suggest the relevant departments to give administrative punishment to the person directly responsible.
Corporal punishment or corporal punishment of children in disguised form; ?
(two) the use of toxic and harmful substances to make teaching AIDS and toys; ?
(three) embezzlement and misappropriation of kindergarten funds; ?
(four) occupation, destruction of kindergarten buildings and equipment; ?
(five) interfere with the normal working order of kindergartens; ?
(six) the buildings and facilities around the kindergarten are dangerous, polluting or affecting the lighting of the kindergarten. ?
If the circumstances listed in the preceding paragraph are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law. ?
Twenty-ninth if a party refuses to accept the administrative punishment, it may, within fifteen days from the date of receiving the notice of punishment, apply for reconsideration to the organ at the next higher level of the organ that made the decision on punishment; If you are not satisfied with the reconsideration decision, you can bring a lawsuit to the people's court within 15 days from the date of receiving the reconsideration decision. If a party fails to apply for reconsideration or bring a lawsuit to the people's court within the time limit, and fails to perform the punishment decision, the organ that made the punishment decision shall apply to the people's court for compulsory execution. ?
Chapter VI Supplementary Provisions?
Article 30 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may formulate implementation measures according to these Regulations. ?
Article 31 The State Education Commission shall be responsible for the interpretation of these Regulations. ?
Article 32 These Regulations shall come into force on 1 February, 9901day.
