The "Regulations" set a positive list for teachers to exercise their right to education punishment, and clarified students' disobedience, disorder, misconduct, danger and infringement of rights and interests. Schools and teachers can simultaneously impose educational penalties according to the degree of violations, ranging from naming and criticizing to suspending classes or suspending classes for no more than three weeks, giving teachers the legal right to exercise the right of educational punishment. From the perspective of rules, educational punishment is not only the right of education, but also a means that can be used. This is also the obligation of teachers and the measures that should be taken. For example, schools and teachers should stop students from committing bad behaviors or serious bad behaviors stipulated in the Law on the Prevention of Juvenile Delinquency, impose educational penalties and strengthen discipline.
On the other hand, the regulations also explicitly prohibit seven kinds of improper educational behaviors, delineate the red line of teachers' behavior, and stipulate the punishment methods for teachers who cross the border. The setting of negative list is not only conducive to distinguishing education punishment from corporal punishment, but also conducive to social supervision and better protecting students' physical and mental rights. According to the definition of rules, the purpose of educational punishment is education, not punishment. The frontier of punishment is education. Therefore, it is necessary to improve the educational management ability and legal governance level of schools and teachers. Teachers should not only correctly grasp the implementation law of the right of educational punishment, but also strengthen the training of teachers to improve their awareness and ability to perform their duties correctly.
At the same time, the exercise of teachers' educational punishment right cannot be separated from parents' understanding and cooperation, and cannot be separated from the promotion of home-school cooperative education. Otherwise, if parents care too much about their children, don't respect teachers' educational rights and don't cooperate with teachers' educational management behavior, teachers may still be vulnerable to criticism and dare not seize this legal right.
