Regulations of Xuzhou Municipality on the Safety Supervision and Administration of Agricultural Machinery
Chapter I General Provisions Article 1 In order to strengthen the safety supervision and management of agricultural machinery, prevent and reduce agricultural machinery accidents, and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the provisions of the Law of the People's Republic of China on the Promotion of Agricultural Mechanization, the Regulations of Jiangsu Province on the Administration of Agricultural Machinery and other laws and regulations, combined with the actual situation of this Municipality. Article 2 Units and individuals engaged in the safety supervision and management of agricultural machinery, driving (operating) agricultural machinery and related to the operation safety of agricultural machinery within the administrative area of this Municipality shall abide by these regulations. Article 3 The administrative departments of agricultural machinery in cities, counties (cities) and jiawang district are responsible for the safety supervision and management of agricultural machinery within their respective administrative areas, and their subordinate agricultural machinery safety supervision institutions (hereinafter referred to as agricultural machinery safety supervision institutions) are specifically responsible for the management of agricultural machinery registration, safety inspection and technical inspection, scrap recycling and driver (operator) examination according to law.

Public security, transportation, safety supervision and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the safety supervision and management of agricultural machinery. Article 4 People's governments at all levels shall strengthen their leadership over the safety supervision and management of agricultural machinery, incorporate the safety supervision and management of agricultural machinery into the safety production plan, implement the responsibility system for safety production of agricultural machinery, and include the business funds required for the safety supervision and management of agricultural machinery in the fiscal budget at the same level.

Town (street offices) agricultural machinery technology promotion institutions shall designate full-time personnel to assist agricultural machinery safety supervision institutions in the implementation of agricultural machinery safety supervision and management.

The villagers' (residents') committee shall assist in the supervision and management of agricultural machinery safety and publicity and education. Fifth agricultural machinery safety supervision institutions and the traffic administrative department of the public security organ shall establish a tractor and other agricultural machinery safety management information exchange system and case handling convergence mechanism.

Agricultural machinery safety supervision institutions shall regularly provide tractor registration, safety technical inspection and tractor driving (operation) license information and data to the traffic management department of the public security organ at the same level. The traffic administrative department of the public security organ shall notify the agricultural machinery safety supervision institution at the same level if the tractor driver (operator) is punished by withholding or revoking the driving (operation) license. If the driving (operation) certificate is revoked, the driving (operation) certificate shall also be copied to the agricultural machinery safety supervision institution at the same level. Article 6 People's governments at all levels shall gradually bring the related insurance of tractors, combine harvesters and other agricultural machinery into the scope of agricultural policy insurance.

Encourage and support the owners or drivers of agricultural machinery to set up agricultural machinery safety mutual aid organizations voluntarily according to law, improve the rescue mechanism and reduce business risks. Chapter II License Management Article 7 Before combine harvesters, large and medium-sized tractors and other agricultural machinery are put into use, they shall register with the agricultural machinery safety supervision agency in the owner's residence and apply for a license before they can be used. If it is necessary to temporarily use or newly purchase agricultural machinery on the road without registration, it shall obtain a temporary license.

Agricultural machinery safety supervision institutions shall complete the registration and examination within five working days from the date of accepting the application if the application materials are complete and meet the requirements. Those who meet the prescribed conditions shall be issued with the corresponding registration certificate, number plate and driving license. If the application materials are incomplete or inconsistent with the statutory form, the applicant shall be informed of all the contents that need to be supplemented at one time. Do not meet the prescribed conditions, it shall inform in writing the reasons for rejection. Article 8 Small tractors and other agricultural machinery that need to be put on record according to national and provincial regulations shall, within 30 days from the date of purchase, put on record with the agricultural machinery safety supervision institution or agricultural machinery technology popularization institution in the town (street office) where the owner lives.

If agricultural machinery is put on record, it shall submit the identity certificate of the owner, the certificate of origin of agricultural machinery and the factory qualification certificate or import certificate of the whole agricultural machinery.

Small tractors engaged in transportation business on the road shall be registered in accordance with the provisions of Article 7 and apply for a license plate. Article 9 Drivers (operators) of tractors and combine harvesters shall receive professional technical training from qualified agricultural machinery driving (operation) training institutions, pass the examination of agricultural machinery safety supervision institutions, and obtain driving (operation) certificates before driving (operation) the corresponding agricultural machinery. Tenth agricultural machinery safety supervision institutions shall, in accordance with the law, conduct regular safety and technical inspections of agricultural machinery that have obtained licenses. Without inspection or unqualified inspection, it should be suspended and can be used only after inspection or maintenance.

Agricultural machinery safety supervision institutions shall regularly inspect the driving (operation) certificates of agricultural machinery according to law. Chapter III Safety Regulations Article 11 The number plates of agricultural machinery shall be hung in accordance with the regulations, kept clear and complete, and shall not be blocked or defiled. Tractors and their trailers driving on the road shall be equipped with reflectors or marker lights, and enlarged numbers shall be painted on the rear of the car body or carriage, with correct words and clear handwriting. Twelfth agricultural machinery operation, the driver (operator) shall abide by the rules of safe operation of agricultural machinery, and set up safety protection devices in dangerous parts of agricultural machinery; Fire prevention equipment should be equipped at the work site prone to fire. Lighting equipment for night operation should be complete and effective. Thirteenth any unit or individual shall have the following acts:

(1) assembling agricultural machinery without authorization or changing the registered structure, structure or main features of agricultural machinery;

(2) Changing the model, engine number, frame number or vehicle identification code of agricultural machinery;

(three) the use of forged or altered agricultural machinery license plate, driving license, inspection mark, driving (operation) certificate;

(four) the use of other agricultural machinery license plate, driving license and inspection marks.
