Interim provisions of the State Education Commission on running schools by social forces
Article 1 In order to encourage and support social forces to run schools, strengthen macro-management and promote the healthy development of running schools by social forces, these Provisions are formulated in accordance with Article 19 of the Constitution of People's Republic of China (PRC). Article 2 The term "social forces" as mentioned in these Provisions refers to state enterprises and institutions, democratic parties, people's organizations, collective economic organizations, social organizations, academic organizations with legal personality and sponsors of private schools approved by the state. Article 3 Running schools by social forces is an integral part of education in China and a supplement to running schools by the state. People's governments at all levels and education administrative departments should encourage and support social forces to organize various educational undertakings, safeguard the legitimate rights and interests of schools, protect the enthusiasm of running schools, try their best to help solve the difficulties existing in running schools when conditions permit, and commend and reward outstanding achievements in running schools. Article 4 In running schools, social forces must adhere to the Four Cardinal Principles, persist in serving the construction of socialist material civilization and spiritual civilization, abide by government decrees, implement the national education policy, and accept the leadership and management of the local people's government and its education administrative departments. Fifth social forces should follow the laws of education, do what they can, foster strengths and avoid weaknesses, pay attention to quality and stress practical results. Should be combined with the actual needs of local economic construction and social development, mainly to carry out all kinds of short-term vocational and technical education, job training, primary and secondary school teacher training, basic education, social culture and life education, self-study exam counseling schools (classes) and continuing education classes. Article 6 The establishment of schools of all levels and types by social forces qualified to issue academic certificates recognized by the state shall be handled in accordance with the relevant regulations on running schools promulgated by the state; The establishment of other schools (including classes and training departments, the same below) shall be handled with reference to these regulations. Article 7 Any unit applying for running a school must issue a certificate of consent by its superior competent department; On-the-job personnel applying for running a school must obtain the consent of their unit and issue a certificate of consent to running a school; Non-on-the-job personnel applying for running a school must have a certificate from the neighborhood office and the township (town) people's government. The department or unit that issued the certificate of consent to running a school should carefully examine the direction and purpose of running a school and the political thought, moral quality and professional ability of the person in charge of running a school, and issue written examination materials. Article 8 Schools run by social forces must be approved by the relevant education administrative departments according to the types and levels of schools, in accordance with the examination and approval authority, and may not run schools without approval. The administrative department of education shall, in accordance with these Provisions and relevant local regulations and the application materials of the school-running unit, review the direction, purpose, conditions, enrollment areas, teachers and teaching materials of the proposed school. Article 9 The name of a school run by social forces shall reflect the categories and levels, and be worthy of the name. Tenth approved schools, change the name, category, level, major, change the organizers or organizers, change the affiliation or closure, must be handled in accordance with the original examination and approval procedures. Eleventh social forces to hire employees as part-time teachers or part-time administrative personnel, must be approved by the employee's unit, and signed an employment contract or employment contract with the employee's unit and employees. Twelfth schools run by social forces should recruit students for the area where the school is located. If it is really necessary to enroll students or set up teaching management institutions across provinces, autonomous regions and municipalities directly under the Central Government, it must be approved by the provincial education administrative department where the school is located. Thirteenth recruitment advertisements run by social forces must be examined and approved by the administrative department of education and issued with certificates before they can be published, broadcast and posted. Fourteenth schools at all levels and types run by social forces that have not obtained the qualification to issue national academic certificates shall not issue graduation certificates. After students complete their studies, the school can issue a "certificate of completion", indicating the contents of the courses studied and the examination results of various subjects. The school principal must sign a "certificate of completion" and be responsible for the students' academic performance; Students who want to obtain a nationally recognized university or technical secondary school diploma can handle it according to the relevant provisions of the self-study exam. Fifteenth social forces to raise funds for running schools. Schools may charge students a reasonable amount of tuition and miscellaneous fees, but they may not make illegal profits in the name of running schools. The charging standards and measures shall be jointly formulated by the education administrative departments of provinces, autonomous regions and municipalities directly under the Central Government in conjunction with relevant departments. Sixteenth all the income and fixed assets of social forces in running schools belong to the school. Schools must establish and improve the financial management system, adhere to the principle of financial openness and thrift, strictly abide by the national financial discipline, and accept the supervision and inspection of relevant departments such as finance, banking, auditing and education. Seventeenth social forces to accept foreign investment in running schools and jointly run schools with foreign countries shall be handled in accordance with the relevant provisions of the state. Eighteenth schools closed, in addition to the cancellation procedures according to the original examination and approval procedures, should promptly clean up the property, by the organizer and the person in charge of running the school under the leadership of the local people's government and the administrative department of education to deal with the aftermath. Nineteenth school units or citizens must be fully responsible for the school work, conscientiously implement these provisions. In violation of these regulations, the local education administrative department shall order it to make corrections until it is closed. Article 20 The education administrative departments of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with these Provisions and in light of the actual situation in their respective regions, formulate specific management measures, which shall be implemented after being approved by the people's government at the provincial level.
