Article 1 In order to standardize the construction and management of supporting educational facilities in residential areas, promote the balanced development of education, and meet the needs of school-age population to enter schools nearby, according to the Urban and Rural Planning Law of People's Republic of China (PRC), the Planning and Design Standards for Urban Residential Areas (GB50 180) and the Planning and Construction Measures for Primary and Secondary Schools and Kindergartens in Shaanxi Province, And the Guiding Opinions on Supporting Planning and Construction of Kindergartens and Primary Schools in Newly-built Urban Residential Areas jointly issued by the Provincial Department of Education and other five departments (Shaanxi Jiaofa [2011] No.32) and the Notice of the General Office of the Municipal Government on Strengthening the Construction and Management of Kindergartens in Supporting Public Compulsory Education Schools in Residential Areas in An City (the Municipal Government issued [2019] No.30)

Article 2 These Measures shall apply to all kinds of newly-built residential quarters in Xixian New Area, including commercial housing, affordable housing, relocation of immigrants, urban sheds and resettlement houses, etc.

Article 3 The term "supporting educational facilities" as mentioned in these Measures refers to primary and secondary schools and kindergartens that must be built in residential areas in order to ensure school-age children and adolescents to attend school nearby.

Chapter II Planning and Construction

Article 4 If the planned construction area of the residential area is 6,543,800+8,000 square meters (the number of households is 654.38+0.500) or above, the development and construction unit shall support the construction of kindergartens; Residential planning construction area of 360 thousand square meters (3000 households) and above, the development and construction units should support the construction of primary schools; Residential planning construction area1130,000 square meters (population 30,000) and above, the development and construction unit shall build a junior high school.

Fifth supporting educational facilities should match the scale of residential areas. Among them, the largest kindergartens, primary schools and junior high schools do not exceed 18 classes, 36 classes and 36 classes respectively; In principle, nine-year compulsory schools will not be built. If necessary, no more than 54 classes.

Article 6 The construction of supporting educational facilities shall be carried out in accordance with the design specifications, construction standards and "Quality Standards for School Construction in Xixian New Area (for Trial Implementation)" of the state and relevant schools in Shaanxi Province.

Article 7 The minimum standards for the construction and delivery of supporting educational facilities shall be that all sub-projects and outdoor projects of the building are completed, doors, windows, walls and floors are decorated, and water, electricity and heating facilities are complete and meet the use conditions.

Eighth education administrative departments should participate in the whole process of design approval, construction and acceptance of supporting educational facilities, to ensure that they meet the construction standards and use requirements. The administrative department of education shall, when examining and approving the design scheme, issue written examination opinions on supporting educational facilities.

Ninth development and construction units should bear the construction costs of kindergartens, primary schools and junior high schools that are suitable for the population size of their residential areas. If the residential area has not reached the corresponding construction scale or unconditionally completed the construction of kindergartens, primary schools and junior high schools, all the supporting educational facilities will be paid, and the new urban management committee and the garden office will make overall plans for the construction of regional educational facilities.

Due to the planning requirements, if a residential area is responsible for the overall construction or construction of educational facilities in the area, it will be returned to the development and construction unit of the residential area according to the construction cost after collecting the construction costs of other residential areas.

Chapter III Transfer

Tenth residential supporting educational facilities should be handed over to the territorial New Town Management Committee free of charge after completion.

Eleventh affordable housing (including low-rent housing, affordable housing, policy rental housing, etc.) and other supporting kindergartens. ), the relocation of immigrants, the transformation of urban sheds into resettlement houses, and the transfer to the education administrative department as a public kindergarten after completion; After the completion of supporting kindergartens in other residential areas, they will be handed over to the education administrative department as public kindergartens or entrusted as inclusive private kindergartens.

If the proportion of public kindergartens in new urban areas does not reach 50%, supporting kindergartens shall not be built according to the approval standards of private kindergartens.

Twelfth residential areas that meet the standards, supporting educational facilities including compulsory education stage (primary school, junior high school), after the completion of the transfer of education administrative departments as public schools.

Chapter IV Safeguard Measures

Thirteenth supporting educational facilities should be built simultaneously with residential projects (if they are developed and built by stages, they should be built simultaneously with the first residential project, accepted and delivered simultaneously).

Fourteenth new district regulatory detailed planning should fully plan and reserve land for educational facilities. When adjusting the land for primary and secondary schools, the New Town Management Committee and the Park Office shall solicit the opinions of the local education administrative departments in writing, and declare the adjustment in accordance with the Measures for the Administration of Regulatory Detailed Planning in Xixian New Area. The adjusted land area shall be no less than the original land area.

Article 15 Before the supply of land, the territorial education administrative department shall specify the nature of running schools, the ownership of property rights and the standard of construction fees for supporting educational facilities, which shall be incorporated into the preliminary plan for land transfer by the new district administrative committee and the park office, and shall be announced when the announcement on the transfer of the right to use state-owned construction land is issued in the new district after being deliberated and adopted by the new district land management leading group meeting.

Article 16 Before examining and approving the construction permit, according to the contents of the planning examination and approval and the land transfer contract, each new city management committee, garden office or relevant departments should sign a contract with the development and construction unit for the construction of supporting facilities for public construction in residential areas, and specify the construction content, location, opening and completion period, recipient, transfer period, delivery standard, delivery content and liability for breach of contract of supporting educational facilities.

Seventeenth supporting educational facilities did not start construction, did not sign the transfer agreement, the housing management department will not handle the first batch of housing projects pre-sale permit procedures; Do not have the delivery conditions, the construction administrative department shall not handle the completion and acceptance procedures for residential projects.

Eighteenth supporting educational facilities after the completion of acceptance, should be within 3 months of the transfer of property rights to the territorial new city management committee.

Nineteenth development and construction units must settle the construction costs of primary and secondary schools and kindergartens before the transfer, and bear the relevant safety responsibilities of the transfer facilities, as well as the corresponding quality warranty responsibilities and maintenance costs in accordance with relevant regulations. It is strictly forbidden to divide, transfer, lease, mortgage or change the use of supporting educational facilities.

Twentieth need to pay the construction fee of supporting educational facilities, development and construction units in accordance with the new district education administrative department issued the "residential supporting educational facilities construction fee payment notice", the construction fee and land transfer fees together to pay; Failing to pay in accordance with the regulations, the "Construction Project Planning Permit" for residential projects shall not be handled. The construction costs shall be managed by special financial accounts, which shall be earmarked for the infrastructure construction of educational facilities.
